AND SHIRLEY M. LEIS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 17th day of January, 1990, in a public meeting, the Board considered the request of Frederick W. and Shirley M. Leis for the resubdivision of part of Lot 3, located in the SEI SE} of Section 9, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, as platted by the Union Colony of Colorado, and WHEREAS, the Board reviewed the submitted evidence and heard the testimony of those present, and WHEREAS, the Board, having considered the recommendation of the Weld County Planning Commission, finds that the resubdivision request concerning part of said Lot 3 shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 6-4 B. of the Weld County Subdivision Regulations. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 6-4 E. of the Weld County Subdivision Regulations as follows: a. No lot or parcel of land will be created that is less than the minimum requirements for area as established by these regulations or other applicable ordinances. / f X:e , ee 900075 I Page 2 RE: RESUBDIVISION - LEIS b. Drainage easements or rights-of-way reserved for drainage will not be changed. c. The proposed resubdivision plat will not be altered in any way which will adversely affect the character of the plat filed. 3 . The following referral entities have reviewed this request and set forth no objections : Weld County Engineering Department, Western Hills Fire Department, and West Greeley Soil Conservation District. 4 . On April 27, 1989 , the Weld County Board of Adjustment approved a variance waiving the public sewer requirement of the R-1 (Low Density Residential) Zone District. The Weld County Health Department has recommended approval with conditions regarding the septic systems. 5. The Weld County Utilities Coordinating Committee recommended approval of this request at its meeting on December 21 , 1989 . 6 . The City of Greeley has reviewed this request and has recommended approval with certain conditions, which are addressed in conditions of approval. 7 . The Department of Planning Services staff has not received any objections from surrounding property owners. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Frederick W. and Shirley M. Leis for the resubdivision of part of Lot 3 , located in the SE} SEi of Section 9, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, as platted by the Union Colony of Colorado, be, and hereby is, approved subject to the following condition: 1 . The summary of the last regular meeting of the Weld County Planning Commission held on December 5, 1989, was approved pursuant to a correction being made on the top of Page 12. APPEARANCE: Vern Nelson, Engineer, Nelson Engineering, stated this is a limited impact gravel mine, (under ten acres) with only about 7.7 acres that are mineable. This will be a private mine and the owner intends to only sell gravel to people who come on-site to buy it. There will be no crushers or other commercial equipment. The estimated life of this gravel pit is approximately sixteen years. Reclamation plans include a recreational site upon completion of the mining operation. They have reviewed the recommendations, conditions, and Development Standards prepared by the staff. They are taking exception only to Development Standard #4. They would prefer it be amended not to say. .."No hauling shall be allowed south on Weld County Road 29."
