0 ill WHEREAS, the Board of County Commissioners of Weld County,

Colorado, pursuant to Colorado statute and the Weld County Home
O 1:4 Rule Charter, is vested with the authority of administering the

O affairs of Weld County, Colorado, and

✓ WHEREAS, the Board has been presented with a Road Maintenance
o a Agreement with C & M Companies, and
x WHEREAS, said Agreement concerns increased truck traffic due
g to a Special Review Permit granted to C & M Companies, and
w

• u WHEREAS, after study and review, the Board deems it advisable
1r z to approve said Agreement, a copy of which is attached hereto and
w incorporated herein by reference.

HI a NOW, THEREFORE, BE IT RESOLVED by the Board of County
ro p Commissioners of Weld County, Colorado, that the Road Maintenance
w Agreement with C & M Companies be , and hereby is, approved.

N hereby is, authorized to sign said Agreement.

ROAD MAINTENANCE AGREEMENT
N O THIS AGREEMENT, by and between the COUNTY OF WELD, STATE OF COLORADO,
c0 hereinafter called "County" and C & M Companies, hereinafter called

"Operator", is made and entered into this Z2 day of P

o w WHEREAS, Operator has been issued a Use By Special Review Permit for an
0 3 , open-cut gravel mine located in the E 1/2 of the NW 1/4, and the NE 1/4 of
the SW 1/4, and the SE 1/4 of the SW 1/4 of Section 30, and the N 1/2 of
� W the NE 1/4 of the NE 1/4 of Section 31 , all in Township 1 North, Range 66
aWest of the 6th Principal Meridian, Weld County, Colorado, known as the
O Platte Valley Pit; and

c> % WHEREAS, the truck access for the pit is located on Weld County Road 6
o 'a approximately 1000' east of U.S. Highway 85; and

W WHEREAS, there will be an increase in truck traffic that could do

N U substantial damage to Road 6 between the truck access and U.S. Highway 85;

E WHEREAS, the damage caused by increased hauling from the Use By Special
,i a Review area can be identified because the damage will occur between the
W truck access and U.S. Highway 85, and not on other sections of Road 6 in
N D the immediate area.

0 2 NOW, THEREFORE, the Operator agrees as follows:

1. The Operator agrees to repair damage on Road 6 between the
U a truck entrance and U.S. Highway 85 that is beyond normal
a g wear and tear by asphalt patching potholes, leveling ruts with
asphalt, removing asphalt from damaged areas and replacing base
V) � and asphalt, or other standard asphalt road repair
m m techniques.
M Gi IN WITNESS WHEREOF, the parties hereto have duly executed the Agreement
