RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION NO. 1546 - SANDLIN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1546, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1546 was submitted by
George Sandlin for property which is described as Lot A of RE #472, located in
part of the NWINE* of Section 29, Township 1 North, Range 66 West of the 6th
P.M. , Weld County, Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A", said plat to be
recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 35 acres and 5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. A Weld County septic permit is required for the proposed home and
shall be installed according to the Weld County Individual Sewage
Disposal System (ISDS) regulations.
2. An ISDS must be located at least 100 feet from any well.
3. An ISDS Permit must be finalized and approved by an Environmental
Protection Specialist within one year of the application date.
4. The following note shall be placed on the recorded exemption plat
prior to recording:
The well permit on the 5-acre lot shall limit use to
ordinary household purposes inside one single family
dwelling, the watering of up to 4 domestic animals and
irrigation of 8,000 square feet of home lawn or garden.
5. For the benefit of Lot A, access to Lot A shall be from the private
road on the west boundary of the property located on Lot B. The
applicant shall supply to the Department of Planning Services an
access easement agreement for Lot A prior to recording the plat.

BE IT FURTHER RESOLVED by the Board that the applicant shall submit a mylar
plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The
plat shall be submitted within sixty days from the date of approval by the Board
of County Commissioners. The applicant shall be responsible for paying the
recording fees.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 27th day of October, A.D. , 1993.

Subject: Recorded Exemption 1546.
Dear Commissioners:
This request for a recorded exemption is submitted by George Sandlin. The parcel
of land is described as Lot A of RE-472, located in part of the NW4 NE4 of
Section 29, T1N, R66W of the 6th P.M. , Weld County, Colorado. The property is
located approximately 1-1/4 miles north of Brighton, Colorado. The request is
to divide the property into two parcels of 30 acres and 5 acres, more or less.
This parcel is the total contiguous land holding of the applicant.
Well water can provide water service to the property. Sewage disposal is
proposed as septic systems. The City of Brighton and the Division of Water
Resources have no objections to this request. The Weld County Health Department
has recommended conditional approval.
The staff has concerns that the proposed division will be inconsistent with
efficient and orderly development. As shown on the attached aerial photograph,
the development pattern that exists in this area and the potential for continued
divisions may evade the intent and purpose of the Weld County Subdivision
Ordinance. Five other recorded exemptions have been approved in the immediate
area of this request. In 1981 the Board of County Commissioners approved RE-472
allowing a 40 acre parcel to be split into 35 and 5 acres, more or less. There
are existing dwellings on both lots. The applicants are now requesting to
subdivide the parcel again to create a third building site.
It is the staff' s opinion that development in this area has reached a level where
continued divisions should be discouraged. The staff requests that the Board of
County Commissioners consider whether it wishes to allow this type of piecemeal
development to continue.

Dear Ms. Dunn: •
We have reviewed the above referenced proposal to split a 35 acre parcel into two lots of
30 and 5 acres. The proposed water supply is to be from on lot wells and the appliem t does have
an existing permitted well,permit No. 14116,pamitted for domestic use, which will sum the 30
acre lot, There is water available in the neartributary Lower Arapahoe aquifer underlying this
property where the producing sands are located between about 750 and 1,010 feet below the
ground surface. A preliminary analysis under Senate 11815 rules indicates that based on a 100 year
aquifer life,annual withdrawals of about 0.75 acre feet could be made. This would be suMelant
to provide use for ordinary household purposes inside one single family dwelling, the watering of
up to 4 domestic animals, and litigation of 8,000 square feet of home lawn or garden. We have
no objection to approval based on a well in the Lower Arapahoe aquifer serving the new 5 acre lot.

approval criteria of the Weld County Subdivision Ordinance, you will be notified
that the recorded exemption is approved. If the staff determines that the
application does not meet the approval criteria, you will be notified and asked to
appear before the Board of County Commissioners at a public hearing. You will be
informed of the hearing date prior to the hearing. The Board of County Commissioners

exemption.

AGREEMENT FOR ROAD MAINTENANCE
WHEREAS; there exits a certain road located in the NE 1/4 quarter ( NE 1/4 ) of Section 29, Township
1 North (1N) Range 66 West (66W) of the 6th P.M. Weld County, Colorado
Whereas; said road is approximately 20 feet wide and serves as armss for ingress and egress for the
following properties and owners;

• Whereas; each of said parties hereto have an interest in the use of the access road described above , and
all parties benefit from the existence and use of said armss road, and the parties desire to make an
agreement with regard to maintenance of the aforementioned access road,
NOW THEREFORE, the parties to this agreement hereby agree to the following;
DEFINITION: for the purpose of this agreement MAINTENANCE shall include, but is not limited to the
following: grading, gravelling, surfacing, repairing, plowing of snow, clearing of weeds or other debris,
or any other act which is necessary for said road to remain sate and driveable for all u eis.
That all parties shall share equally in the maintenance of said road either by actual performance of the
reguired maintenance duties, or by sharing a proportionate amount of the actual cost incurred in
performance of said maintenance. No costs shall be incurred on any party unless a majority of the parties
agree. Written notification of proposed expenses must be given to each party thirty days in advance prior
to such expenses bcingincurred.
This agreement shall be binding upon all parties hereto, their heirs, successors, and assigns.•
