RESOLUTION
RE: ACTION OF BOARD CONCERNING CHANGE OF ZONE FROM A (AGRICULTURAL) TO
E (ESTATE) - TOM AND MARGARET RUSSELL
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 11th day of May, 1994, at 10:00
a.m. for the purpose of hearing the application of Tom and Margaret Russell, 1710
Lashley Street, Longmont, Colorado 80501, requesting a Change of Zone from
A (Agricultural) to E (Estate) for a parcel of land located on the following
described real estate, to-wit:
Part of the E',- of Section 5, Township 1 North, Range 68
West of the 6th P.M. , Weld County, Colorado
WHEREAS, the applicant was not present or represented, and
WHEREAS, the Planning staff informed the Board that the applicants had
requested a continuance to allow all Board members to be present, and
WHEREAS, the Board of County Commissioners heard all the testimony and
statements of those present and reviewed the request of the applicant and, having
been fully informed, finds that this request for continuance shall be approved
and the matter shall be continued to May 18, 1994, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Tom and Margaret Russell requesting a
Change of Zone from A (Agricultural) to E (Estate) on the above referenced parcel
of land be, and hereby is, continued to May 18, 1994, at 10:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 11th day of May, A.D. , 1994.

A public hearing was conducted on May 11, 1994, at 10:00 a.m. , with the
following present:
Commissioner W. H. Webster, Chairman
Commissioner Dale K. Hall, Pro-Tem
Commissioner George E. Baxter
Commissioner Constance L. Harbert
Commissioner Barbara J. Kirkmeyer - EXCUSED
Also present:
Acting Clerk to the Board, Shelly Miller

Planning Department representative, Greg Thompson
The following business was transacted:
I hereby certify that pursuant to a notice dated April 20, 1994, and duly
published April 21, 1994, in the Windsor Beacon, a public hearing was
conducted to consider the request of Tom and Margaret Russell for a Change
of Zone from A (Agricultural) to E (Estate) . Bruce Barker, County
Attorney, made this a matter of record and indicated that the applicants
have requested a continuance since there were only three Board members
scheduled to be present at today's hearing. A notice was published,
posted, and mailed for a continuance hearing on May 18, 1994, at 10:00
a.m. ; however, Commissioner Kirkmeyer will not be present on May 18.
Therefore, the applicants have again requested a continuance to allow the
presence of all Board members. Another notice was also published, posted,
and mailed for the second continuance hearing on May 25, 1994, at 10:00
a.m. Greg Thompson, Planning Department representative, concurred with
Mr. Barker. The applicants were not present, and no public testimony was
offered concerning the continuance of this matter. Mr. Barker suggested
said matter be called on May 18, 1994, and then be continued to May 25,
1994, since an interim notice was published, posted, and mailed.
Commissioner Hall moved to continue the request of Tom and Margaret
Russell for a Change of Zone from A (Agricultural) to E (Estate) to May
18, 1994, at 10:00 a.m. , based on the applicants' request. The motion was
seconded by Commissioner Harbert, and it carried unanimously.
This Certification was approved on the 16th day of May, 1994.

Commissioners of Weld County, Colorado, Weld County Centennial Center, 915 10th
Street, First Floor, Greeley, Colorado, at the time specified. All persons in
any manner interested in the following proposed Change of Zone are requested to
attend and may be heard.
Should the applicant or any interested party desire the presence of a court
reporter to make a record of the proceedings, in addition to the taped record
which will be kept during the hearing, the Clerk to the Board shall be advised
in writing of such action at least five days prior to the hearing. The cost of
