RESOLUTION
RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION NO. 1523 - ANDOLSEK
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Recorded Exemption No. 1523 was submitted by
Edward and Esther Andolsek, for property which is located in part of the NE,' of
Section 3, Township 6 North, Range 65 West of the 6th P.M. , Weld County,
Colorado, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 71 acres and 1 acre, more or less, and
WHEREAS, after reviewing the Planning staff's concerns and hearing the
testimony presented, the Board determined that said request shall be denied for
the following reasons:
1. It is the opinion of the Board of County Commissioners that this
proposal evades the purpose of the Weld County Subdivision Ordinance
as defined in Section 1.3.
2. The Board feels this division would be inconsistent with efficient
and orderly development.
3. The Board feels this proposal is not consistent with the Weld County
Comprehensive Plan.
4. It is the opinion of the Board that any further division of these
lots may create additional accesses onto Weld County Road 74 and
will increase the density of the existing linear subdivision.
5. The Board feels this proposal increases the need for more urban-type
services in the area which are not readily available.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request for Recorded Exemption No. 1523, submitted by
Edward and Esther Andolsek be, and hereby is, denied.

CONDITIONS OF APPROVAL

1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall
be submitted within sixty (60) days from the date of approval by the Board
of County Commissioners. The applicant shall be responsible for paying
the recording fees.
2. Weld County Septic permits are required for the proposed home septic
system and shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
3. An I.S.D.S. Evaluation on all existing septic systems will be necessary
prior to issuing the required septic permits on the existing systems.
4. An Individual Sewage Disposal System permit must be finalized and approved
by an Environmental Protection Specialist within one (1) year of the
application date.

Re: Recorded Exemption #1523
This request for a recorded exemption is submitted by Edward and Esther Andolsek.
The parcel of land on which this subdivision request is being made is described
as part of the NE4 of Section 3, T6N, R65W of the 6th P.M. , Weld County,
Colorado. The property is located approximately three miles east of the Town of
Eaton. The request is to divide a 72 acre tract of land, which is the total
contiguous land holdings of the applicants, into a 71 acre parcel and a 1 acre
parcel, more or less. Access to the lot is provided from Weld County Road 74,
a paved county arterial. Water service to both lots is proposed to be provided
by North Weld County Water District. Sewer service has been proposed as septic
systems for both lots. There are presently no dwellings on either parcel.
It is the opinion of the Department of Planning Services' staff that sufficient
reasons have not been given by the applicant to warrant creating an additional
lot. The Department of Planning Services' staff is concerned about the level of
development and the potential for continued division occurring in this area.
Staff would like the Board to be aware of the development pattern that has
occurred.
Four recorded exemptions have been approved in this section since 1973. In
addition, there are four small lots just to the east of the proposed recorded
exemption which were created prior to 1972. There are fifteen parcels in this
section, six of which are in the N2 of the NE4, where this recorded exemption is
proposed. Any further division of these lots will create additional road
accesses and will increase the density of this undeclared subdivision.
Development in this area has reached a level where continued divisions evade the
intent and purpose of the Weld County Subdivision Regulations.
The agricultural policy section of the Comprehensive Plan does allow for the
property owner to subdivide for a family member employed on the farm, but the
applicant has clearly stated their intent to sell the farm. The farm sells, and
no longer is there a valid reason to subdivide for a family member.

Dear Bob:
The recorded exemption application for Edward F. and Esther D. Andolsek is complete
and in order and will be processed on or before August 16, 1993. If it is determined
that the application meets the approval criteria of Sections 11.4.4. 1 through
11.4.4.6 of the Weld County Subdivision Ordinance, you will be notified that the
recorded exemption is approved. If the staff determines that the application does
not meet the approval criteria, you will be notified and asked to appear before the
Board of County Commissioners at a public hearing. You will be informed of the
hearing date prior to the hearing. The Board of County Commissioners will then
consider the application and make a final decision on the recorded exemption.
It is the policy of Weld County to refer an application of this nature to any town
or municipality lying within three miles of the property in question or if the
property under consideration is located within the comprehensive planning area of a
town or municipality. Therefore, our office has forwarded a copy of the submitted
materials to the Town of Eaton Planning Commission for its review and comments.

Recorded Exemption Questionnaire
Item 1 . We are considering retiring at the end of the 1993
farm year . We own another farm across the road from
this parcel and have both farms for sale.
The reason we are requesting this exemption is that
our son is interested in an acre, so that in the
future he may build a home . This will be the only
opportunity we have to grant our son a small part of
the farm on which he has worked for many years ,
because economically and financially , he will be
unable to continue with the farming operation .
Item 2 . This parcel is located approx . 3-1 /2 mi . east of
Eaton . The total size of the parcel is approx . 72
acres . Our plan is to exempt one ( 1 ) acre which will
be located in the far northeast corner of the farm,
and will have access off of Weld Co . Rd. 74 which is
a county road right of way . The small parcel will be
used as a building site , and will not interfere with
the normal operation of the farm. The large parcel
will be used as agriculture irrigated farming as it
has been used in the past.
Item 3 . This proposal is consistent with the Weld County
Comprehensive Plan because this property has never
been divided after August 30, 1972 . There are 3
small parcels located adjacent to the east of this
land . However , they were developed approx. 30 years
ago. There will only be 1 acre of fair quality
farmland that will be used for a building site, and
this will not interfere with the remainder of the
farm. To our knowledge, there is no adopted
municipal plan in this area.
Item 4 . The uses permitted will be compatible with the
existing surrounding area, because the area consists
of small rural acreages and irrigated farmland.
Item 5 . The existing zoning district is agriculture, and will
remain the same . No zone change is anticipated .
Item 6 . This proposal is consistent with the efficient and
orderly development , because no lot has been created
since the recorded exemption process has been in
effect as of August 30 , 1972 .
Item 7 . There will not be anything different than it is now ,
that would create a health or safety problem for the
neighborhood . The property is within 5 minutes of
the Galeton and Eaton Fire Protection District. The
domestic water will be serviced by North Weld County
Water District (see letter enclosed )
