RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR TRANSIT DEVELOPMENT PLAN WITH CITY
OF GREELEY AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement
for Transit Development Plan between the City of Greeley and the County of Weld,
with the terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Intergovernmental Agreement for Transit Development
Plan between the City of Greeley and the County of Weld be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 25th day of October, A.D. , 1993.

INTERGOVERNMENTAL AGREEMENT FOR TRANSIT DEVELOPMENT PLAN
THIS AGREEMENT made and entered into this 22nd day of
September , 1993, by and between the CITY OF GREELEY, by and
through its City Council, and the COUNTY OF WELD, by and through
its Board of Commissioners. The CITY OF GREELEY is hereinafter
referred to as "City" and the COUNTY OF WELD is hereinafter
referred to as "County" .
WITNESSETH:
WHEREAS, as a condition to receive funding from the Colorado
Department of Transportation (CDOT) for transit services, County is
required to prepare a Five-Year Transit Development Plan, and
WHEREAS, as a condition to receive funding from the Federal
Transit Administration (FTA) for transit services, City is required
to prepare a Five-Year Transit Development Plan, and
WHEREAS, County and City desire to work together to coordinate
transit services and provide services in a cost-effective manner,
and
WHEREAS, City is willing to act as a lead agency to contract
for consulting services to prepare a Five-Year Transit Development
Plan.
WHEREAS, Section 3-5 of the Greeley City Charter authorizes
the City Council to enter into contracts with other governmental
bodies for cooperative or joint activities.
WHEREAS, Section 29-1-201, et seq. , C.R.S. , authorizes
governments to cooperate and contract with one another to provide
any function, service or facilities lawfully authorized to each of
the cooperating or contracting units of government.
NOW THEREFORE, it is agreed as follows:
1. The County and City agree to jointly develop a Request for
Proposals for a Five-Year Transit Development Plan (Plan) , select
a consultant, and review progress to completion of the project.
2 . The County and City agree that staff will provide the
information, specific to County and City, needed by the consultant
to prepare the Plan.
3 . The County and City will provide representatives from
staff and the community to be on an ad hoc committee to review the
recommendations of the consultant.

4. City agrees to enter into a contract for consulting
services as the lead agency. City further agrees to provide
payment to the consultant for the full cost of the Plan. County
agrees to reimburse the City for the County's share of the cost of
the Plan.
5. The estimated cost of the Plan is $60, 000. The City's
share of the cost is $35, 000, and the County's share of the cost is
$25, 000.
6. County and City are each individually responsible to apply
for any planning grants specific to their transit service funding
sources. Any planning funds received belong to the entity to
which the funds were awarded.
7. County and City agree that staff will work together as
needed to prepare Annual Transit Development Plan Updates as
required by the funding agencies.
8. City agrees to maintain sufficient records to substantiate
costs.
9. At any time either party may terminate this agreement by
providing thirty (30) days advance written notice to the other
party. Upon termination by the County, County will pay City based
on the percentage of the project completed by the consultant.
10. This agreement constitutes the entire understanding and
agreement between the parties hereto and shall be binding on the
parties, their successors and assigns, with any amendment hereto to
be ineffective unless in writing and executed in like manner as the
original.
11. All notifications shall be sufficient if mailed to the
other party at the following addresses:

Intergovernmental Agreement for Transit Development Plan
Subject:
Enclosed for Board approval is an intergovernmental agreement with the
City of Greeley. This agreement would permit the Human Resources
Transportation Program and the City of Greeley Transit Program to conduct
a joint Five Year Transit Development Study (TDP) .
A TDP is required of every entity that applies for Federal Transportation
Administration funds. Weld County has received FTA Section 18 rural
transit monies for three years. To continue receiving these funds we must
conduct a TDP. To date the City and the County have conducted separate
studies. This is an attempt to streamline this process.
Under this agreement the City would act as the lead agency for contracting
for consulting services to prepare a Five-Year Transit Development Plan.
The County and the City agree to jointly develop a Request for Proposal to

The estimated cost of the plan is $60,000. The County's share is
estimated to be $25,000. The City and the County are individually
