RE: APPROVE PARTIAL RELEASE OF COLLATERAL - EATON LANDFILL, C/O AL MILLER
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 12, 1994, the Board entered into an
agreement concerning Conditions of Closure and Vacation of Certificate of
Designation for a Solid Waste Disposal Site and Facility for McMill, Inc. (Eaton
Landfill) , and
WHEREAS, in furtherance of said Resolution, the Board retained collateral
which was already being held by the Board for use in removal of tires at said
landfill, and
WHEREAS, pursuant to said agreement, Eaton Landfill, c/o Al Miller, has
presented an invoice from D-Caton Excavation, Inc. , in the amount of $4, 560.00
for covering tires with dirt at said landfill, and
WHEREAS, the Weld County Health Department has inspected the Eaton Landfill
and found the work to have been completed as stated, and
WHEREAS, the Board deems it advisable to release the remaining collateral
being held, in the amount of $850.30, for said project.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that pursuant to the Board's Resolution dated January 12, 1994,
all remaining collateral being held in the matter of removal of tires for the
Eaton Landfill, in the amount of $850.30, be, and hereby is, released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and
hereby is, directed to process payment of said collateral, payable to D-Caton
Excavation, Inc. and Al Miller.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 31st day of August, A.D. , 1994.

Subject: Eaton Landfill
On Friday, August 22, 1994, I met Al Miller at the Eaton Landfill in order to
conduct an inspection. The purpose of the inspection was to observe the
facility's compliance with the Resolution of January 12, 1994. On this date I
observed that the tires have been concentrated in the northwest corner of the
previously excavated gravel pit and that a six (6) foot wire mesh fence has been
installed on the south and east sides of the tires. In addition, approximately
20 feet of wire mesh was placed over the tires on the north and west sides of the
tire stockpile. It should be noted that Exhibit A of the Resolution appears to
indicate that wire mesh should be installed on all sides of the stockpile. It
was also observed that all soil stockpiles previously located on site have been
applied on the landfill. According to Mr. Miller the landfill footprint will be
seeded with native grasses in the spring of 1995.
The monitoring well analysis required in No. 4 of the Resolution has not yet been
submitted. According to Al Miller, a site investigation was conducted by the
Colorado Department of Public Health and Environment (contact: Martin O'Grady)
earlier this spring. I contacted Mr. O'Grady August 22, 1994. According to Mr.
O'Grady the three (3) monitoring wells were sampled for an extensive parameter
list, including but not limited to volatiles, semivolatiles, metals, etc. He
also stated that the monitoring data will be available in the next few months.
The attached pictures should adequately document the current tire locations, etc.

Tire dump at Eaton Landfill
Subject:
On Monday, August 22, 1994, I observed a tire dump at the closed Eaton Landfill
located on WCR 78 approximately 1/3 mile west of WCR 43. The pile of tires,
which are all quartered, is approximately 165 feet X 123 feet X 10 feet. There
is fencing around the eastern and southern borders. On the western and northern
borders, there is wire mesh covering the tires 15 feet in towards the center of
the pile.
Two sets of polaroid snapshots were taken, each containing the following
viewpoints:
1. SSE face of the pile
2. SSE face of the pile (closer)
3. WSW face of the pile
4. NNW face of the pile
5. ENE face of the pile (South 1/2)
6. ENE face of the pile (North 1/2)
7. SW corner of the pile
8. SE corner of the pile
