RE: APPROVE VARIOUS AMENDMENT ONE NOTICES
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with various notices required by the
passage of Amendment One, with the requirements and conditions being as stated
in said notices, and
WHEREAS, after review, the Board deems it advisable to approve said
notices, copies of which are attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the various notices required by the passage of Amendment
One be, and hereby are, approved.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 16th day of November, A.D. , 1992.

RE: 90 Day Notice Under Amendment 1
Dear Governor Romer, President Strickland and Speaker Berry:
With the passage of Amendment 1 on November 3, 1992, Weld County has had
to assess the amendment's fiscal impact on Weld County. As a result of
the amendment's impact on the 1993 budget and future budgets Weld County,
in accordance with Section (9) State Mandates of Amendment 1, must end its
local subsidy for certain sate mandated programs.
It is Weld County's position that the following operations are state
mandated programs being subsidized by the county for administration:

District Attorney's Nineteenth Judicial District
District Courts and County Courts Nineteenth Judicial District
Extension Services
Useful Public Service
Health Department
Public Trustee
The purpose of this letter is to provide the 90-day notice required under
Section 9 of Amendment 1 and to advise you of Weld County's decision to
end its subsidy to the Social Services programs effective April 1, 1993,
which is 90 days following the December 31, 1992 effective date of
Amendment 1. The three equal installments would be as follows based upon
the base year of 1992:
April 1, 1993 - March 31, 1994 $1,087, 794
April 1, 1994 - March 31, 1995 1,087,794 additional
April 1, 1995 - March 31, 1996 1,087, 794 additional
Weld County's fiscal year impacts will be as follows for Weld County
property tax reduction purposes:
April 1, 1993 - December 31, 1993 $ 815,845
January 1, 1994 - December 31, 1994 1,087, 794
January 1, 1995 - December 31, 1995 1,087, 794
January 1, 1996 - March 31, 1996 271,949
In addition to the 1993 turnback amount of $815,845 above, it is
anticipated that new Social Services mandated costs for 1993 after January
1, 1993 will total $264,374. Therefore, the total calendar year 1993
impact to the State of Colorado will be $1,080,219.
Over the next year Weld County will assess the need of whether or not to
end the county subsidy to the other state mandated programs listed above.
Current long-term fiscal planning indicates the end of other state
mandated subsidies may be necessary during fiscal years 1996 - 1998 at an
annual amount of approximately $680,000 for each year. New mandates in
the area of the Courts and District Attorney will not be funded beginning
January 1, 1993.

subject: Amendment 1
As many of you are aware, Amendment 1 was approved by the Colorado voters
on November 3, 1992. The amendment places a number of tax and spending
limitations on state and local governments in Colorado. Specifically, it
limits government spending and property tax to an annual increase of
inflation plus new construction growth, and limits the mill levy to
current rates. To exceed these amounts, a vote of the people is required.
The immediate impact calls for a $1,091, 185 reduction in the proposed 1993
Weld County budget.
The amendment also provides for the option of counties to end subsidies to
state mandated programs. The programs fitting this category are:
Social Services
District Attorney
Courts
Extension Services
Health Department
Public Trustee
Under the amendment these programs can be turned back to the state
financially. Legislative decisions will have to be made as to whether or
not the state will assume the administration directly over time or simply
fund them entirely with county administration.
For 1993-1995 the only program being "turned back" to the state is the
Social Services program. The Board made this decision because the county
has little control over the funding, which is dictated to us by the state
and federal governments. In addition, Social Services' costs have been
increasing 10-15% per year recently. With a spending and tax limit equal
to inflation (3-4%) plus growth (less than 1%) it makes financial sense to
turn these programs back to avoid adverse impacts on other county
operations.
With the turnback of Social Services, Weld County can avoid the $1,091, 185
reduction, assuming the state complies with the amendment to take the
Social Services mandated costs back over the next three years. Until we
are assured of the State takeback of Social Services, the Board has
reduced costs and frozen expenditures totalling $1,091, 185 until April 1,
1993. Part of those frozen amounts include the proposed 2.5% salary
increase for 1993. The freeze will remain in effect until it is clear the
state will take over the costs of Social Services. The required notice to
the State has been sent.

To avoid any net take home pay reduction for employees in 1993, the Board
has agreed to absorb the dependent health insurance increase until
salaries are unfrozen in 1993.
The Board is happy to report that no positions of current employees will
have to be eliminated under this budget plan. Thus, no layoffs are
planned.
Amendment 1 will cause changes in the way government does business in
Colorado over time. We are confident that, with the cooperation of the
elected officials, management, and the employees, Weld County can cope
with the changes and continue to provide the very best service possible to
our citizens with the resources we have available.

payment agreement, Weld County will no longer be required or financially
able to provide payment. Therefore, defacto the agreement is null and
void.
