HomeMy WebLinkAbout910115.tiff AR2238130 RESOLUTION RE: VACATE RIGHT-OF-WAY LOCATED IN SECTION 12, TOWNSHIP 5 NORTH, RANGE 65 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , in 1935 , Weld County received by Deed certain properties as rights-of-way and roads from various landowners, a copy of which is attached hereto and is referred to herein as Exhibit "A, " and WHEREAS, at the time of said conveyance, other property located in Section 12, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, was conveyed to Weld County for use inthe project known as "Scout Island" , and WHEREAS, the additional property owned by Weld County and used in the Scout Island project was conveyed to William F. and Toni M. Wickersham on October 1 , 1990 , by two Deeds, copies of which are attached hereto as Exhibits "B" and "C" , and WHEREAS, the rights-of-way and roads described in Exhibit "A" are not necessary for the Weld County transportation system, and WHEREAS, pursuant to Section 43-2-303, C.R.S. , the Board of County Commissioners of Weld County, Colorado, has the authority to vacate all right, title, or interest of the County in and to any roadway which is not within the limits of any city or town, and WHEREAS, the Board now deems it in the best interest of the citizens of Weld County, Colorado, to vacate those rights-of-way which are described in the attached Exhibit "A" , and WHEREAS, the Board finds that by vacating said rights-of-way and roadways, the County will not leave any land adjoining said rights-of-way or roadways without an established public road or private access easement connecting said land with another public road.
