The monitoring schedule was as follows: Date Time Environmental Specialist December 30, 1989 9:30-11:30 a.m. Linda Johnson January 4, 1990 5:45- 7:00 p.m. Lynn Robbio January 6, 1990 11:30-12:30 p.m. Judy Schmidt Monitoring was performed at three different locations around the range during each test period. The monitoring locations were as follows: A) WCR 13 directly west of the range. B) Roth subdivision at southern most end of Brian Avenue. C) Directly south of range across WCR 74. Buckeye Trap Shooting Range Sound Survey January 15, 1989 Page Two • Since the subdivision is zoned agricultural, these above mentioned levels do not constitute prima facie evidence of a nuisance condition according to CRS 25- 12-103(1) . However, "every activity. . .shall be conducted in a manner so that any noise produced is not objectionable due to intermittence, beat frequency, or shrillness." According to standards established by the United States Department of Housing and Urban Development, the sound levels of the Roth subdivision would fail into the "discretionary" category being "normally unacceptable" if the average sound levels were assumed to be equal to the average sound levels specific to the gunshots. Note, however though, that the ambient sound levels for the neighborhood fall in the 45 to 55 .dBA range. A full statistical analysis of the sound levels at the Roth subdivision would yield a much higher rating of "normally acceptable" to "acceptable. " Calculations performed on the data, which are specific to the gunshot levels only, indicate that the sound levels produced by the shooting range are "normally unacceptable" according to standards developed by the United States Department of Housing and Urban Development. This would be the rating if the shot levels were continuous. However, it is standard procedure to include background sound levels as well as the gunshot levels in the statistical analysis. This department does not have the necessary resources for such an in depth analysis for this type of field situation. I am reasonably certain from past experience in other cases that this type of complete statistical analysis would place the overall sound level ratings in the "normally acceptable" or "acceptable" category. In summary, the sound levels detected at the range do not constitute prima facie evidence of a public nuisance. Any potential for compliance action lies in the determination of whether the gunshots are objectionable due to intermittence or beat frequency. Establishing that the sound is objectionable would be difficult and legal action based on this criteria would be weak. County road 74 was left without proper attention and the result was packed ice with one lane of traffic that nearly tore the bottoms of cars out and several accidents . I have seen ice left on a road like that make it crumble . Now if no one grades a major artery for Fort Collins Kodak traffic then I do not feel they will grade snow for a subdivision. The result in 10 years can be roads that are worse than graveled roads plus you have paid on a costly special assement and really nothing to show for but pot holes . That same money spent on paving will make people some nice home improvements that will make a home more valuable . A pot hole crumbled road will make your home worth less value if it is your house with the crumbled road in front of it. The park is a question of liability. If some child from the area fell through the ice (God forbid) and drowned who would be liable? Of course no county parks are funded from taxes because there are simply not that many. But this particular park was granted to the county because that was what the county wanted at that time . So if the county owns it then let the county takethe necessary health precautions and live with their decision i instead of trying to make it look like people next to the park wanted wild life and out voted the developer. My opinion is some wanted an extension to their properties to graze a horse and run 4 wheel motorcycles making this situation better than ownership with no taxes and no expenses and free to those next to the park. I have never seen a deed to the park for Roth Subdivision Homeowners Association so who has the deed to the park? My dad has been in this area 83 years and I was born in the house that blew up in section 31. I drove a tractor through that pond area when it was bone dry. It was not always a swamp with cat tails . The level on county road 76 was raised in the swamp area from dirt that was given to the county from dirt piles dug out of Lake Lee Lateral. That is why the road is soggy when it gets wet. This was done in Mr. Horsts time . On map 0705-31-1 water is pumped to the Hoff farm from the north side of the swamp. I do not see how anyone can claim it is a natural burdento downstrea: owners . If the pipe that connects the swamp were lower it would benefit all. Maybe the town of Thornton would like to lower it. The enclosed map shows the direction of row crop to illustrate a natural ravine that channels shotgun blasts up to Roth sub. There are no fences around 3 sides of the Ehrlich farm. If someone comes in from the North or west as many times pappen as there is no fence to keep anyone out and no danger signs posted it cannbe very dangerous as you could accidently get tooclose to the shotgun blasts . See the lanes leading toward the trapshoot on the map. People ride horses as well close to the trapshoot. Now why can' t people go to the trap shoot 8 miles east of Ault and quit shooting in a populated area such as Roth Sub? Ray Ehrlich as well as hig dad Fred were not the nicest of neighbors . On another map of sec 31 with a larger view of the NE1 Ray would drive on my Fads property uhtil my dad fenced him out. The larger map shows this . Ray told my dad as I listened that he wanted a small trap shoot for his dying son from cancer. He presented it in this way as he knew if he softened my dad he would sign for the trap shoot to feel sorry for him. Chris Elder told me the county waived trees required around the trap shoot parimeter. He said it was on recorded tape but I have never seen it in county records . If this is true then the homeowners need to get together and get a class action suit going. I can pa 17 for small claims court and collect $2000 but would have to wave the r�st . At this time I am undecided. 2 of 2 Fred Ehrlich would throw the survey pins away twice when this subdivision was developed and sue Lake Lee Lateral all the time. I feel Bill Kirby is too good of friends to Bob Ehrlich to be fair in our problems in sec 31. There are a few more letters on file at the planners so I know I am not the only one that is complaining. People want a commercial use for $400 month rent to get a free ride from the value of my property and lower my property value. Public Service had to correct power surges for other neighbors in the area because of the welding being done. Monte Hartman of lot 2 burned up 3 TVs because of power surges from welding. I was contacted by IRS one time about Ed White owner of this property once They must have believed a need to investigate his habits. He carried a hand gun and would brag on how he operated in cash. Ed felt pretty proud on how he could bully a 13.5 pound 76 year old man when he built 3Che warehous He thought he would beat me up for complaining to the county and attacked me He then bragged how he beat me up but people asked him why he called the sherrif if he beat me up. My dad should have sued but the county kept reassuring us they would take care of the problem. 10 years later we are still waiting. These are reasons I mistrust Bill Kirby and the county. They just give your rights away to unethical people. I have called Ted Yelik of Thornton farms in Ault but he will not be avaiable until March 1st. So far a resident has gotten better results from him than the county. We lost a good commisioner when Harry Ashley quit. I feel any oposition to my dad getting the park back was mostly out of jealousy.
