HomeMy WebLinkAbout900670.tiff RESOLUTION RE: APPROVE AMENDMENTS TO HUDSON LAW ENFORCEMENT AGREEMENT AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board did, by Resolution dated December 13 , 1989 , approve a Law Enforcement Agreement with the Town of Hudson for 1990 , and WHEREAS, the Board has been presented with Amendments to said Law Enforcement Agreement, and WHEREAS, said Amendments are as stated in the copy attached hereto and incorporated herein by reference, and WHEREAS, after study and review, the Board deems it advisable to approve said Amendments . NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Amendments to the Hudson Law Enforcement Agreement for 1990 be, and hereby are, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is , authorized to sign said Amendments. Such service shall include the enforcement of Colorado State Statutes and Laws and the Model Traffic Code as adopted by the Town, provided a municipal court has been established by the Town. All citations written for municipal ordinance violations, and all violations of the Town's Model Traffic Code will command the violator to appear before the Municipal Court. All other statue violations will command the violator to appear before the Weld County Court. The Sheriff will not enforce any municipal code violations other than certain specific municipal codes of the Town of Hudson, specifically: Chapter 7, section 28 - Littering public or private property. Chapter 7, section 70-81 - Dealing with the control of animals and associated penalties. Chapter 8, in its entirety - Dealing with the Model Traffic Code, addendum vehicles and vehicle weight limits. Chapter 10 in its entirety - Dealing with general. offenses. Amend paragraph 10 to read 10. The Town agrees to pay the County up to $11,500:00 for the services to be rendered under this agreement at the rate of $24.00 per hour for directly committed patrol and for actual time required for on-call request, crime prevention programs and court. Animal control calls for service can be handled by the County, when a county animal control officer is on duty, at the rate of $18.00 per hour for actual time required for on-call requests. In the event specific off-duty police officers must appear in court to provide testimony. The Town shall reimburse the County at a rate of $48.00 per appearance per deputy for up to two hours. After two hours, the cost will be $24.00 per hour. Criminal investigations and administrative investigations such as liquor license applicant backgrounds will be conducted without charge as these costs have been included in the hourly rate. In the event specific off duty county animal control officers must appear to provide testimony, the Town, shall reimburse the County at the rate of $36.00 per appearance per officer for up to two hours. After two hours, the cost will be $18.00 per hour. Animal control calls, will be handled on a first come first serve basis, with consideration given to geographic county area of officer. Priority consideration will also be given to calls that involve public safety or injured animals. Animal calls not of a matter of public safety that come in when an animal control officer is not on-duty will be held until an animal control officer is on-duty which could be as long as over night. If the call is a matter of public safety and needs to be handled by a deputy the rate will be $24.00 per hour for actual time 900eia Amendments to Hudson Law Enforcement Agreement Page 2 required for the request until the deputy can resume normal duties. Calls for service involving animal ordinance violations should be handled by the Town's animal control officer unless that person is not available. It will be up to the Town to locate and enter into an agreement with a shelter facility for animals to be housed, and bear all costs involved in that agreement. Amend paragraph 18 to read 18. Any and all fines collected resulting from a municipal ordinances or the Town's Model Traffic Code violations shall be paid to the Town in accordance with currently held practices.
