RE: APPROVE RESUBDIVISION FOR VACATION OF LOT 9, LUPTON MEADOWS SUBDIVISION
DIVISION #3 IN SECTION 19, TOWNSHIP 2 NORTH, RANGE 66 WEST OF THE 6TH
P.M. , WELD COUNTY, COLORADO - DONALD PARKER
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 9th
day of March, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for
the purpose of hearing the application of Donald Parker, 12877 Weld County Road
18, Fort Lupton, Colorado 80621, for a Resubdivision for vacation of Lot 9,
Lupton Meadows Subdivision Division #3 in Section 19, Township 2 North, Range 66
West of the 6th P.M. , Weld County, Colorado, on the following described real
estate, to-wit:
Lot 9, Lupton Meadows Subdivision Division #3

6th P.M. , Weld County, Colorado
WHEREAS, Mark Kinnear, applicant's son-in-law was present, and
WHEREAS, Section 8.4 of the Weld County Subdivision Ordinance provides
standards for review of said Resubdivision, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 8.4 of the Weld County Subdivision
Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 8.4 of the Weld County
Subdivision Ordinance, including specifically:
a. The vacation will not adversely influence the adopted rules,
regulations, and ordinances currently enforced upon and
affecting this subdivision.
b. The vacation will not adversely influence surrounding property
owners, and conforms with the Weld County Comprehensive Plan.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Donald Parker for a Resubdivision for
vacation of Lot 9, Lupton Meadows Subdivision Division #3 in Section 19, Township
2 North, Range 66 West of the 6th P.M. , Weld County, Colorado, on the hereinabove
described parcel of land be, and hereby is, granted subject to the following
conditions:
1. Prior to recording the plat, the applicant shall submit evidence
that an Individual Sewage Disposal System evaluation has been
completed by the Weld County Health Department on all existing
septic systems.
2. Purple Loosestrife shall not be planted on the property.
3. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 7.2.6 of the Weld County Subdivision
Ordinance. The plat shall be submitted within 60 days of approval
by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 9th day of March, A.D. , 1994.

The following business was transacted:
I hereby certify that pursuant to a notice dated February 9, 1994, and
duly published February 24, 1994, in the Windsor Beacon, a public hearing
was conducted to consider the request of Donald Parker for a Resubdivision
for vacation of Lot 9, Lupton Meadows Subdivision Division #3 in Section
19, Township 2 North, Range 66 West of the 6th P.M. , Weld County,
Colorado. Bruce Barker, County Attorney, made this a matter of record.
Monica Mika, Planning Department representative, entered the favorable
recommendation of the Planning staff into the record. Mark Kinnear, son-
in-law of the applicant, was present and stated he will buy ten acres from
his father-in-law through the recorded exemption process after the land is
taken out of Lupton Meadows Subdivision. After further comments from Mr.
Kinnear, Ms. Mika explained 80 acres are being removed from the
Subdivision so that the applicant may proceed with the recorded exemption.
No public testimony was offered concerning this matter. Commissioner
Harbert moved to approve the request of Donald Parker for a Resubdivision
for vacation of Lot 9, Lupton Meadows Subdivision Division #3 in Section
19, Township 2 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, based on the recommendation of the Planning staff, with the
Conditions of Approval as entered into the record. The motion was
seconded by Commissioner Baxter, and it carried unanimously.
This Certification was approved on the 14th day of March, 1994.

Pursuant to the laws of the State of Colorado and the Weld County Subdivision
Ordinance, a public hearing will be held in the Chambers of the Board of County
Commissioners of Weld County, Colorado, Weld County Centennial Center, 915 10th
Street, First Floor, Greeley, Colorado, at the time specified. All persons in
any manner interested in the proposed resubdivision are requested to attend and
may be heard.
Should the applicant or any interested party desire the presence of a court
reporter to make a record of the proceedings, in addition to the taped record
which will be kept during the hearing, the Clerk to the Board's Office shall be
advised in writing of such action at least five days prior to the hearing. The
cost of engaging a court reporter shall be borne by the requesting party.

Colorado.
Dear Commissioners:
This request for a resubdivision to vacate Lot 9 of Lupton Meadows Subdivision
Division 3, of Section 19, T2N, R66W of the 6th P.M. , Weld County, Colorado, is
submitted by Donald Parker. The parcel of land under consideration is
approximately 80 acres. The parcel has access onto Weld County Road 18, which
is a paved local road. The property is located within the Urban Growth Boundary
area of the City of Fort Lupton.
The submitted materials are in compliance with the application requirements of
Section 8.4 of the Weld County Subdivision Ordinance. Additionally, the parcel
of land which will result from the vacation is equal to the minimum lot size as
established by the Weld County Zoning Ordinance.
The Department of Planning Services' staff recommends approval of this request.
Approval of this request will not adversely influence the adopted rules,
regulations, and ordinances currently enforced upon and affecting this
subdivision. The vacation of this lot will not adversely influence surrounding
property owners, and conforms with the Weld County Comprehensive Plan. This
agricultural subdivision was platted June 9, 1909. Lot sizes at the time of
platting varied between 93 and 21 acres. Other portions of Lupton Meadow
Subdivision, especially within Division 1, have been successfully vacated,
therefore, staff believes this request should be granted.

Dear Mr. Parker:
Your application and related materials for the request described above are complete and
in order at the present time. The Clerk to the Board of County Commissioners will be
scheduling a meeting to consider this proposal. This meeting will take place in the Weld
County Centennial Center, 915 Tenth Street, Greeley, Colorado.
It is the policy of Weld County to refer an application of this nature to any town or
municipality lying within three miles of the property in question or if the property
under consideration is located within the comprehensive planning area of a town or
municipality. Therefore, our office has forwarded a copy of the submitted materials to
the Ft. Lupton Planning Commission for its review and comments. Please call Don
Stephens, at 356-9225 for information regarding the date, time, and place of this meeting
and the review process. It is recommended that you and/or a representative be in
attendance at the meeting 'described above in order to answer any questions that might
arise with respect to your application.
It is the responsibility of an applicant to see that a sign is posted on the property
under consideration at least 10 days preceding the hearing date. The sign shall be
posted adjacent to and visible from a publicly maintained road right-of-way, the
applicant shall post one sign in the most prominent place on the property and post a
second sign at the point at which the driveway (access drive) intersects a publicly
maintained road right-of-way. Your sign posting certificate must be returned to the
Department of Planning Services' office on or before the date of the hearing.
The Department of Planning Services' staff will make a recommendation concerning this
application to the Board of County Commissioners. It is the responsibility of the
applicant to communicate with the Department of Planning Services office a few days
before the date of the hearing to obtain that recommendation.

To Whom it May Concern:
Reason for the Vacation Request, I wish to sell 10 acres to my
daughter. The property is currently a subdivision of Fort Lupton
Meadows.
A recorded exemption has already been filed. It can not be approved
until the vacation request has been approved.
The reason we are going through this process is because, my daughter
wishes to improve the existing home that is located on the 10 acres.
Without being able to deed the property in my daughter's name, she
will be unable to obtain any form of financing.
There are no plans of building any new homes, other than remodeling
the existing home.
The location of the 10 acres would be on the Southern end of the
recorded plat.

To Whom it May Concern:
Reason for the Vacation Request, I wish to sell 10 acres to my
daughter. The property is currently a subdivision of Fort Lupton
Meadows.
A recorded exemption has already been filed. It can not be approved
until the vacation request has been approved.
The reason we are going through this process is because, my daughter
wishes to improve the existing home that is located on the 10 acres.
Without being able to deed the property in my daughter's name, she
will be unable to obtain any form of financing.
There are no plans of building any new homes, other than remodeling
the existing home.
The location of the 10 acres would be on the Southern end of the
recorded plat.

The area in question is adjacent to the South Platte River, which is a waterfowl resting area and a
location for wintering Bald Eagles. The residences and out buildings that exist do not seem to pose
any problem. The statement by the landowner that no additional development will be done, and that
all work done occur on the existing structures, I see no concerns with the request. I would however
like to request that if any other developments take place outside the 10 acres, that an additional
opportunity for comment be provided.
I would like to suggest some concerns in terms of the proximity to the river. There is an introduced
plant that is detrimental to wetland and riparian areas, and is called Purple Loosestrife. It has been
identified by the Division of Wildlife as a detriment to these habitats, but some landscapers and
nurseries still sell it as an ornamental plant. Please make the applicant aware of this concern, and if
they have any other questions, I will be happy to address them.

I would like to suggest some concerns in terms of the proximity to the river. There is an introduced
plant that is detrimental to wetland and riparian areas, and is called Purple Loosestrife. It has been
identified by the Division of Wildlife as a detriment to these habitats, but some landscapers and
nurseries still sell it as an ornamental plant. Please make the applicant aware of this concern, and if
they have any other questions, I will be happy to address them.
