HomeMy WebLinkAbout940238.tiff RESOLUTION RE: APPROVE RESUBDIVISION FOR VACATION OF LOT 9, LUPTON MEADOWS SUBDIVISION DIVISION #3 IN SECTION 19, TOWNSHIP 2 NORTH, RANGE 66 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO - DONALD PARKER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 9th day of March, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Donald Parker, 12877 Weld County Road 18, Fort Lupton, Colorado 80621, for a Resubdivision for vacation of Lot 9, Lupton Meadows Subdivision Division #3 in Section 19, Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado, on the following described real estate, to-wit: Lot 9, Lupton Meadows Subdivision Division #3 W4SEq Section 19, Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Mark Kinnear, applicant's son-in-law was present, and WHEREAS, Section 8.4 of the Weld County Subdivision Ordinance provides standards for review of said Resubdivision, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 8.4 of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 8.4 of the Weld County Subdivision Ordinance, including specifically: a. The vacation will not adversely influence the adopted rules, regulations, and ordinances currently enforced upon and affecting this subdivision. b. The vacation will not adversely influence surrounding property owners, and conforms with the Weld County Comprehensive Plan. 940238 r'C ; PGA lttA_ RESUBDIVISION - PARKER PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Donald Parker for a Resubdivision for vacation of Lot 9, Lupton Meadows Subdivision Division #3 in Section 19, Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado, on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to recording the plat, the applicant shall submit evidence that an Individual Sewage Disposal System evaluation has been completed by the Weld County Health Department on all existing septic systems. 2. Purple Loosestrife shall not be planted on the property. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 7.2.6 of the Weld County Subdivision Ordinance. The plat shall be submitted within 60 days of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. Bruce Barker, County Attorney, made this a matter of record. Monica Mika, Planning Department representative, entered the favorable recommendation of the Planning staff into the record. Mark Kinnear, son- in-law of the applicant, was present and stated he will buy ten acres from his father-in-law through the recorded exemption process after the land is taken out of Lupton Meadows Subdivision. After further comments from Mr. Kinnear, Ms. Mika explained 80 acres are being removed from the Subdivision so that the applicant may proceed with the recorded exemption. No public testimony was offered concerning this matter. Commissioner Harbert moved to approve the request of Donald Parker for a Resubdivision for vacation of Lot 9, Lupton Meadows Subdivision Division #3 in Section 19, Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado, based on the recommendation of the Planning staff, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Baxter, and it carried unanimously. This Certification was approved on the 14th day of March, 1994. // / ? The property is currently a subdivision of Fort Lupton Meadows. A recorded exemption has already been filed. It can not be approved until the vacation request has been approved. The reason we are going through this process is because, my daughter wishes to improve the existing home that is located on the 10 acres. Without being able to deed the property in my daughter's name, she will be unable to obtain any form of financing. There are no plans of building any new homes, other than remodeling the existing home.
