RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A VETERINARY CLINIC IN THE A (AGRICULTURAL) ZONE DISTRICT - TIM AND PAULA THOMPSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 26th day of August, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Tim and Paula Thompson, P.O. Box 450, Platteville, Colorado 80651, for a Site Specific Development Plan and Special Review Permit for a veterinary clinic in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SE;, Section 6, Township 3 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Paula Thompson, said applicant, was present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposed facility is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary and Agricultural Goals and Policies. This use is within the Urban Growth Boundary of the Town of Platteville. The Platteville Planning Commission has reviewed this application and indicated that it is consistent with its comprehensive plan. The Agricultural Goals and Policies of the Weld County Comprehensive Plan support agricultural activities and uses dependent upon agriculture in the A (Agricultural) Zone District. This use is an agricultural service establishment which is listed as a use by special review in the A (Agricultural) Zone District. c. The attached Development Standards and Conditions of Approval will ensure that the proposed use is compatible with future land uses and existing land uses which include a road maintenance facility, rural residences, and agricultural production. d. The applicant has demonstrated a diligent effort to conserve productive agricultural land. The proposed Special Review area is located on a portion of the farm where it is more difficult to irrigate and raise crops efficiently because of short rows. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a veterinary clinic in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the Special Review plat map, the applicant shall: a. Submit evidence to Weld County Environmental Protection Services and the Department of Planning Services that the facility is in compliance with the Colorado Guidelines for Feedlot Runoff Containment. b. Submit evidence that any required emissions permit has been obtained from the Air Pollution Control Division, Colorado Department of Health, for fugitive dust and odors. 920814 SPECIAL REVIEW PERMIT - THOMPSON PAGE 3 4. Prior to scheduling this request before the Board of County Commissioners: a. The applicant shall submit evidence to the Department of Planning Services that a plan for disposal of run-off pond effluent has been approved by Weld County Environmental Protection Services. b. The applicant shall provide evidence to the Department of Planning Services staff that an access permit has been obtained for the proposed use from the State of Colorado, Division of Highways. Webste 920814 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS TIM AND PAULA THOMPSON USR-975 1. The Site Specific Development Plan and Special Review Permit is for a veterinary clinic in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The property owner shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. The runoff pond effluent shall be disposed of by applying it to the balance of the property which is in agricultural production or by other methods approved by the Weld County Health Department. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. 6. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. Adequate toilet facilities shall be provided for the proposed facility and shall be installed and maintained in accordance with Weld County Individual Sewage Disposal Regulations. 9. The septic system shall be designed by a Colorado Registered Professional Engineer according to Weld County Individual Sewage Disposal Regulations. 10. Clinic traffic shall access the property from Highway 60 only. No access from Highway 85 is allowed. The property shall be maintained in a manner consistent with the approved access permit issued by the State of Colorado Division of Transportation. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 920814 DEVELOPMENT STANDARDS - THOMPSON PAGE 2 12. All signs on the property shall be maintained in compliance with Section 42.2 of the Weld County Zoning Ordinance. 13. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 14. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 15. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 16. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 17. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Lee Morrison, Assistant County Attorney, made this a matter of record. Brian Grubb, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Mr. Grubb said he would like to make additions to the Development Standards concerning the access permit and the disposal pond upon recommendation of the State Highway and Health Departments. Mr. Grubb read the recommended additions to Development Standards #3 and #10 into the record. Commissioner Lacy questioned whether the applicant agreed to the additions and whether there was a commitment from the Central Weld Water District. Paula Thompson, applicant, was present and stated she had no problems with the additions to the Development Standards. She confirmed the commitment from the water district and said they are going to have a system designed. There was no public testimony offered concerning this matter. Commissioner Lacy moved to approve the request of Tim and Paula Thompson for a Site Specific Development Plan and Special Review Permit for a veterinary clinic in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, to include the additions to Development Standards #3 and #10. The motion was seconded by Commissioner Webster, and it carried unanimously. Dr. Paula Thompson, applicant, explained their current facility, located in Platteville, is to small. She described their plans to build a mixed animal hospital barn with the actual working facility. There will be a small animal portion within the hospital for boarding and grooming. Jean Hoffman asked how many acres they own. Paula Thompson explained they own 140 acres, but only 11 acres will be used for this purpose. Bud Clemons asked if there were building on the property now. Paula Thompson said there is a farmhouse and a barn. The house is rented to one of the veterinary assistants. She explained they work on animals of a wide variety such as cattle, horses, sheep, pigs, ostriches, and domestic animals. Jean Hoffman asked about care in the night for animals that are boarded or in hospital. Dr. Thompson explained one of the assistants lives at the property, and in emergency or life threatening situations, someone from staff will stay on premises. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. The Chairman asked the applicant if they were in agreement with the Department of Planning Services' recommendation. NEED FOR USE Currently we are operating out of a building in Platteville that is inadequate for our current business , much less our expansion from 3 veterinary doctors to 4 doctors in July of 1992 . The new structure will allow us to offer more services to our clients in a quicker and more efficient manner . NUMBER OF EMPLOYEES, SHIFTS AND HOURS OF OPERATIONS We currently have a full time staff of 4 veterinarians, one veterinary technician and one office manager . We currently have a part time staff of a transcriptionist, bookkeeper and a kennel assistant . We do not see this number increasing in the immediate future , but we may need more support staff in the future as business picks up. TYPE , SIZE , WEIGHT AND FREQUENCY OF VEHICULAR TRAFFIC Vehicular traffic will consist of pickups , horse/stock trailers and passenger cars . The number entering the hospital in any one day would be approximately 30-40 vehicles initially, increasing to 75 once we are in full operation. SEWAGE FACILITIES The hospital , runs and barn will be set up on a septic tank system. We have contacted the Health Department for information on this subject . It was suggested to wait for approval by the County for use of the proposed site before applying for a permit . FIRE PROTECTION MEASURES At this location we would be covered by the Platteville Fire District . In addition, fire extinguishers will be placed in strategic locations throughout the premises and these will be checked annually. All personnel will learn the protocol of what to do in case of fire through staff meetings . TYPE AND SIZE OF WASTE, STOCKPILE OR STORAGE AREAS There will be one or two large dumpsters behind the hospital . A freezer will be in the garage that only stores dead, bagged animals . A cement pad will be outside , behind the hospital , where dead livestock will be covered while awaiting pick up by the rendering works. A compost pile for breakdown of organic matter to fertilize the landscaping at the hospital will be several hundred feet away from the hospital . Medical waste is currently autoclaved then bagged in red Biohazard bags for removal by B & C refuse . B & C has a medical waste disposal plan on file from us . STORM WATER RETENTION FACILITIES 9{':0314 The building of this hospital will not impact storm runoff adversely. A berm/ditch will be placed around the large animal working facilities as well as the compost pile to prevent contaminated rain water from leaving the immediate area. TIME SCHEDULE AND METHOD OF REMOVAL AND DISPOSAL OF DEBRIS, JUNK AND OTHER WASTES Currently B & C Refuse out of Platteville empties a large dumpster weekly for us at this location. At least one more dumpster will be added once the hospital is built. We have already filed with them our plan for handling Hazardous Medical Waste . Dead livestock is removed on a daily basis by Platte River Byproducts . Smaller dead animals are placed in a freezer and removed on a weekly basis by Denver Animal Disposal for cremation. Used bedding will be removed from the barn daily by a small loader and taken to the compost pile . Should the bedding contain infectious waste , it will be double bagged and removed by the trash company. PROPOSED LANDSCAPING AND EROSION CONTROL We plan to plant several trees, as yet species are undetermined. We will likely have a water garden with goldfish (appropriately fenced) . Shrubs , grass and elevated flower boxes complete the landscaping picture . Surrounding acreage will be turned into irrigated pasture (that which is now in corn within the Special Use Permit Area) . This pasture, seeded with a mixture of grasses , will prevent erosion and unsightly weeds . RECLAMATION PROCEDURES This does not apply. TIME TABLE FOR CONSTRUCTION AND START UP We shall begin construction as soon as we have been approved by this review process . Our contractor is standing by to start in September . The architects are currently working on the blueprints. Once construction begins , we plan to be completed within 3-6 months, weather permitting. We plan to move our operation to the new site by the Spring of 1993 . This is a small , professional corporation whose primary clients are livestock producers . PROVISIONS FOR THE PROTECTION THE NEIGHBORHOOD HEALTH, SAFETY AND WELFARE OF The users of the facility, for the most part , will be members of the immediate community who are involved in ranching, farming or other agricultural endeavors . We will also serve those town dwellers that only have small animals . When coming to our hospital, we believe the access will be the safest possible at this location for approaches from all directions . The parking lot will be paved, reducing dust in the summer . In winter , snow will be promptly removed and all walk ways will be free of snow and deiced. This facility will be fully accessible to the physically impaired including an accessible public restroom. One of the owners/Veterinarians is wheelchair bound. Insect control will be taken care of as needed. In the case of an emergency, the facility is served by the Platteville Fire Protection District . COMPATIBILITY WITH EXISTING SURROUNDING LAND USES The surrounding area is used for various agriculturally related enterprises . The highway department also owns a maintenance shed across the highway from us whose primary purpose is the safety of travellers . Our veterinary practice serves the agricultural community. FUTURE COMPATIBILITY WITH SURROUNDING AREA It is not anticipated that the use of the area will change in the near or far future .
