RE: ACTION OF BOARD CONCERNING SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED
SPECIAL REVIEW PERMIT FOR A SOIL STORAGE AREA FOR AN EXISTING SOLID WASTE
DISPOSAL SITE FACILITY (SANITARY LANDFILL) IN THE A (AGRICULTURAL) ZONE
DISTRICT - LAIDLAW WASTE SYSTEMS (COLORADO) , INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the
27th day of October, 1993, at the hour of 10:00 a.m. in the Chambers of the Board
for the purpose of hearing the application of Laidlaw Waste Systems (Colorado) ,
Inc. , P.O. Box 320, Erie, Colorado 80516, for a Site Specific Development Plan
and Amended Special Review Permit for a soil storage area for an existing solid
waste disposal site facility (sanitary landfill) in the A (Agricultural) Zone
District on the following described real estate, to-wit:
Part of Section 29, Township 1 North, Range
68 West of the 6th P.M. , Weld County,
Colorado
WHEREAS, at said hearing on October 27, 1993, the Board deemed it advisable
to continue said matter to November 10, 1993, at 10:00 a.m. , and
WHEREAS, at said hearing on November 10, 1993, said applicant was
represented by Fred Otis, Attorney, and
WHEREAS, the Board of County Commissioners, after hearing all of the
testimony and statements of those present, deemed it advisable to again continue
said matter to November 22, 1993, at 9:30 a.m. , to allow the applicant further
time to negotiate the purchase of said property.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application for a Site Specific Development Plan and
Amended Special Review Permit for a soil storage area for an existing solid waste
disposal site facility (sanitary landfill) in the A (Agricultural) Zone District
on the hereinabove described parcel of land be, and hereby is, continued to
November 22, 1993, at 9:30 a.m.

The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 10th day of November, A.D. , 1993.

HEARING CERTIFICATION

RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT FOR
A SOIL STORAGE AREA FOR AN EXISTING SOLID WASTE DISPOSAL SITE
FACILITY (SANITARY LANDFILL) IN THE A (AGRICULTURAL) ZONE DISTRICT -
LAIDLAW WASTE SYSTEMS (COLORADO) , INC.
A public hearing was conducted on November 10, 1993, at 10:00 A.M. , with
the following present:
Commissioner Constance L. Harbert, Chairman
Commissioner W. H. Webster, Pro-Tem
Commissioner George E. Baxter
Commissioner Dale K. Hall
Commissioner Barbara J. Kirkmeyer
Also present:
Acting Clerk to the Board, Shelly Miller
County Attorney, Bruce Barker
Planning Department representative, Gloria Dunn
The following business was transacted:
I hereby certify that pursuant to a notice dated September 22, 1993, and
duly published October 14, 1993, in the Windsor Beacon, a public hearing
was conducted on October 27, 1993, to consider the request of Laidlaw
Waste Systems (Colorado) , Inc. , for a Site Specific Development Plan and
Amended Special Review Permit for a soil storage area for an existing
solid waste disposal site facility (sanitary landfill) in the A
(Agricultural) Zone District. At said hearing on October 27, 1993, said
matter was continued to November 10, 1993, at which time Bruce Barker,
County Attorney, made this a matter of record. (Changed to Tape #93-39. )
Gloria Dunn, Planning Department representative, stated the applicant has
requested a second continuance to November 24, 1993. Fred Otis, Attorney
representing the applicant, confirmed his client's request for a
continuance to November 24, 1993. He explained the contract negotiation
problems with the property owner have not yet been resolved. Mr. Otis
indicated the principal has been agreed upon, but there is nothing in
writing. In response to a question from Commissioner Webster, Mr. Otis
said the contract should be finalized within a couple of days; however,
they would like to have two weeks as a matter of assurance. Commissioner
Kirkmeyer stated she would not be present on November 24. After
discussion, Commissioner Kirkmeyer moved to continue the request of
Laidlaw Waste Systems (Colorado) , Inc. , for a Site Specific Development
Plan and Amended Special Review Permit for a soil storage area for an
existing solid waste disposal site facility (sanitary landfill) in the A
(Agricultural) Zone District to November 22, 1993, at 9:30 a.m. The
motion was seconded by Commissioner Hall. No public testimony was offered
concerning this matter, and the motion carried unanimously.
This Certification was approved on the 15th day of November, 1993.
