RE: SET HEARING DATE TO CONSIDER APPEAL OF HEALTH BOARD DECISION
- CITY OF GLENDALE AND JOHN UNDERHILL
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on May 7, 1990 , the Board received a letter of
appeal from Douglas G. McKinnon, Attorney representing the City of
Glendale, concerning the denial by the Weld County Board of Health
of two permits for the application of domestic sludge on property
owned by John Underhill, and
WHEREAS, pursuant to Weld County Ordinance 89-S and the
Administrative Manual, a hearing date must be scheduled and the
appeal heard within 15 days of the receipt of an appeal , and
WHEREAS , the Board deems it advisable to set the hearing to
consider said appeal on Wednesday, May 16 , 1990 , at 10 :00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing to
consider the appeal from the City of Glendale and John Underhill
concerning the decision by the Weld county board of Health be, and
hereby is, set for Wednesday, May 16 , 1990 , at 10 : 00 a.m.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 9th day of May,
A.D. , 1990 .

Health on April 24 , 1990 . Pursuant to the Administrative Manual,

Dear Commissioners :
As City Attorney for the City of Glendale, Colorado, I
have been instructed to pursue an appeal of the Weld County
Board of Health ' s denial of the City of Glendale ' s permits
#DS900003 and #DS900048 at the hearing on April 24 , 1990 .
This notice of appeal is filed within the 60 day period
prescribed by your policies and procedures , therefore, we will
await notice from the clerk as to when the hearing with the
commissioners will be held .
