RE: APPROVE AGREEMENT FOR ROAD MAINTENANCE AND SNOW REMOVAL WITH TOWN OF EATON
AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for Road
Maintenance and Snow Removal between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, on behalf of the
Weld County Public Works Department, and the Town of Eaton, with terms and
conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement for Road Maintenance and Snow Removal
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Weld County Public Works
Department, and the Town of Eaton be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 15th day of June, A.D. , 1994.

AGREEMENT FOR ROAD MAINTENANCE AND SNOW REMOVAL
BETWEEN WELD COUNTY AND TOWN OF EATON
�U�L THIS AGREEMENT is made and entered into this 75/l1 day of
. 1994, by and between the TOWN OF EATON, COLORADO, hereinafter
referred to as "Eaton, " with its principle office located at 223
First Street, Eaton, Colorado 80615, and COUNTY OF WELD, STATE OF
COLORADO, by and through the Board of County Commissioners of the
County of Weld, State of Colorado, hereinafter referred to as
"County, " with its principle office located at 915 Tenth Street,
Greeley, Colorado 80631 .
WHEREAS, the current town boundary for Eaton is in the middle
of portions of Weld County Road 74 and Weld County Road 39, and
WHEREAS, as a result, one half of said portions of WCR' s 74
and 39 are located in the Town of Eaton and the other half of said
portions are located in the County, as shown on the map which is
attached and is referred to herein as "Exhibit A, " and
WHEREAS, WCR 74 as it extends into the Town of Eaton is also
known as "Collins Street, " and
WHEREAS, that portion of WCR 74 (Collins Street) extending
east from the Union Pacific Railroad tracks and that portion of WCR
39 as it extends south from its intersection with WCR 74 are in
need of repavement, and
WHEREAS, County plans to repave said portions of WCR 74
(Collins Street) and WCR 39 upon payment by Eaton for parts of the
costs of said repaving, and
WHEREAS, Eaton has agreed to pay those portions of said
repaving costs as set forth herein, and
WHEREAS, the parties hereto further desire to memorialize
their agreement to maintain and remove snow from those roadways in
and around Eaton as set forth herein and which are either jointly
owned or owned in alternating segments by Eaton and/or County as
further described herein.
NOW, THEREFORE, consideration of the mutual promises and
covenants contained herein, the parties hereto agree as follows :
1 . REPAVEMENT: WCR' s 74 (Collins Street) and 39 shall be
repaved as follows :
A. WCR 74 (Collins Street) : East from the Union
Pacific Railroad track to the intersection of WCR' s
74 and 39 .

B. WCR 39 : South from its intersection with WCR 74
for approximately 2,640 feet.
County shall perform the work of said repaving and shall be
reimbursed by Eaton for portions of the cost of said repaving as
set forth in Section 2 below.
2 . COST OF REPAVING: Eaton and County agree to pay for the
repaving on WCR' s 74 (Collins Street) and 39 as follows :
A. Eaton agrees :
1 . To pay for the entire cost of the repaving of
WCR 74 (Collins Street) beginning at the Union
Pacific Railroad track and extending east for
approximately 1,257 feet, this amount being
$10, 825 .
2 . To pay for one half the cost of the repaving
of WCR 74 (Collins Street) beginning at a
point 1,257 east of the railroad tracks and
extending to the intersection of WCR' s 74 and
39 , being 1,660 feet and at a cost of $7, 148 .
3 . To pay for a portion of the cost of the
repaving of WCR 39 beginning at its inter-
section with WCR 74 and extending south for
2,640 feet, being a cost of $17 , 036 .
B. County agrees :
1 . To pay for one half the cost of the repaving
of WCR 74 (Collins Street) beginning at a
point 1,257 feet east of the railroad tracks
and extending to the intersection of WCR' s 39
and 74 , being 1, 660 feet and at a cost of
approximately $7, 148 .
2 . To pay for a portion of the cost of the
repaving of WCR 39 beginning at its inter-
section with WCR 74 and extending south for
2 , 640 feet, being at a cost of $15, 979 .
3 . MAINTENANCE AND SNOW REMOVAL: The parties agree to the
following for routine maintenance and snow removal :
A. Eaton agrees to maintain and remove snow from the
entire width of the following roads :

1 . WCR 37 (Cheyenne Avenue) beginning at its
intersection with WCR 76 and extending south
for approximately 829 feet.
2 . WCR 74 (Collins Street) beginning 1,257 feet
east of the Union Pacific Railroad tracks and
continuing east to its intersection with WCR
39 and WCR 74 (Collins Street) between U.S .
Highway 85 and WCR 37 .
B. County agrees to maintain and remove snow from the
following roads :
1 . WCR 74 (Collins Street) extending west from
WCR 37 .
2 . WCR 39 as it extends south from its inter-
section with WCR 74 .
4 . TERM: The repaving work detailed in Section 1 above,
shall take place during the summer and/or fall of 1994 .
Eaton agrees to pay County the sum of $35, 009 within ten
days after the completion of the repaving work. The road
maintenance and snow removal portions of this Agreement
shall run from year to year unless terminated by either
Eaton or County, providing the party seeking to terminate
this Agreement gives the other party ten days written
notice.
