HomeMy WebLinkAbout931673.tiff HEARING CERTIFICATION DOCKET NO. 92-66 RE: HEARING TO CONSIDER CREATING LOCAL IMPROVEMENT DISTRICT - WELD COUNTY ROAD 38 A public hearing was conducted on January 6, 1993 at 10:00 A.M. , with the following present: Commissioner Constance L. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Director of Engineering Department, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated November 18, 1992, and duly published December 3, 1992, in the Windsor Beacon, a public hearing was conducted to consider the creation of a local improvement district along Weld County Road 38. Lee Morrison, Assistant County Attorney, made this a matter of record. Mr. Morrison said the Board should consider accepting the draft resolution creating said local improvement district. Drew Scheltinga, Director of Engineering Department, said Weld County Road 38 will be paved between Weld County Road 7 and Interstate 25. He said there are 26 lots in Highland Estates and two separate parcels on either side of the road, which are owned by Mr. and Mrs. Gilman Olson. Mr. Scheltinga said the lanes will consist of 3" of asphalt, 6" of aggregate basecourse, with 12' lanes and 4' aggregate shoulders. Since there will be traffic outside of the subdivision, the district will only pay for the paving cost, which is estimated at $55,000. Preparation cost is estimated at $56,000, and administrative costs should be approximately $10,000; thus, a total being $121,000. Mr. Scheltinga reiterated that the cost of district will not exceed $55,000, with assessments being $1,964.29 per parcel. He said the financing will be at 8% simple interest for 10 years. Mr. Scheltinga said the County is paying for all preparation and administration costs, and since the petition has capped the cost of the district at $55,000, the County will also pay for any costs over that amount. In response to a question from Commissioner Webster, Mr. Scheltinga said there were 17 of 28 parcels, or 61%, that petitioned for the district. Mr. Morrison noted that the original notice which was mailed and published stated 10% simple interest, and a corrected notice to state 8% had been remailed. Mr. Olson expressed his financial concerns because he will be assessed for two parcels. Mr. Scheltinga gave the background of past local improvement districts, and he stated that only since 1990 have adjacent parcels been included when paving near a subdivision. Mr. Morrison noted there was a farmer near Northmoor Acres that voluntarily contributed to that district. Mr. Scheltinga noted also that there were several owners without access assessed on Weld County Road 8 Local Improvement District. In response to a question from Commissioner Harbert, Mr. Olson said the district probably will increase the property value; however, they have no intention of any further development. Mr. Olson questioned whether the road could only be paved from Road 7 one-half mile to the end of the subdivision to cut costs. Commissioner Harbert reiterated that the $6,000 could be paid over 10 years. In response to questions of Commissioners Baxter and Kirkmeyer, Mr. Morrison said`tte Olson home is east of Interstate 25, and they would be eligible for access if developed. Mr. Olson stated they do not want it developed. Mr. Morrison explained the general concept is the benefit to the number of legal residences to be developed. He noted the petition provides for this assessment. It was clarified for Commissioner Hall that only Road 38 would be paved, and the Olson property is zoned as Agricultural. Al Roberts, property owner, said he previously submitted 3 additional petitions; therefore, the total should be 20 not 17. Mr. Roberts said he is in favor of the district as petitioned, and he noted that Mr. Olson has access by Frontier Road onto Road 38. Commissioner Hall moved to accept the draft resolution creating said district. The motion was seconded by Commissioner Webster, and it carried unanimously.
