RE: SUBMITTING TO THE REGISTERED ELECTORS OF THE COUNTY OF WELD,
STATE OF COLORADO, A PETITION FOR AN INITIATED ORDINANCE
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , pursuant to Section 15-4 (2) of Article XV of the
Home Rule Charter it is required that this Board either submit the
issue to the electors or adopt the ordinance as submitted by an
initiative petition when presented with a petition proposing an
ordinance, signed by registered electors in a number equal to at
least 5% of the total number of votes cast at the last general
election, and
WHEREAS, a petition for the adoption of an ordinance was
submitted during the regular Board of County Commissioners meeting
of January 8 , 1990 , petitioning the following:
"Shall there be an ordinance: (1) Requiring
that all swine production facilities in the
County designed to hold more than 25, 000
animals at one time provide secondary
treatment and disinfection of all effluent,
and provide stabilization of all solid waste,
prior to discharging any such effluent or
solid waste onto the land; (2) Requiring that
such facilities only apply effluent and solid
waste to the land at a rate and in a manner
which does not pollute ground and surface
water; and (3) Authorizing that county
officials and residents can enforce the
ordinance?"
WHEREAS, Mary Ann Feuerstein, Clerk and Recorder for the
County of Weld, has reviewed said petition and found that the
petition is proper in form and contains sufficient signatures to
meet the requirements of Section 15-4 (1) of the Home Rule Charter
for Weld County, and

WHEREAS, the Board finds and determines that the issues
contained in the proposed ordinance are the subject of public
interest and debate and that it is in the best interest of the
citizens of Weld County to submit the issue to the electors , and
WHEREAS, no general election will occur within the next 120
days and that, therefore, a special election must be called to be
held within 60 days of this date, and
WHEREAS , publication shall be in accordance with Section
1-40-114 , C.R.S. , as amended, and shall occur not less than three
weeks nor more than five weeks prior to the election and include
notice of election and title and full text of the proposed
ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that :
1 . At the special election to be held on March 20 , 1990,
there shall be submitted to the registered electors of
the County of Weld, State of Colorado, for their
consideration of approval the citizen initiated
ordinance submitted by the group known as "Protect Our
Water" as set forth in the petition which portion is
attached hereto and incorporated by this reference as
Exhibit "A" .
2 . Each elector voting at said election and desirous of
voting for or against said ordinance shall cast his or
her vote as provided by law either "Yes" or "No" on the
proposition:
"Shall there be an ordinance: (1) Requiring that all
swine production facilities in the County designed to
hold more than 25 ,000 animals at one time provide
secondary treatment and disinfection of all effluent,
and provide stabilization of all solid waste, prior to
discharging any such effluent or solid waste onto the
land; (2) Requiring that such facilities only apply
effluent and solid waste to the land at a rate and in a
manner which does not pollute ground and surface water;
and (3) Authorizing that county officials and residents
can enforce the ordinance?"

3 . That notice of the election shall be made by publication
two times, of this Resolution, including attachments , on
February 15 , 1990 and February 22, 1990 in The New News.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 29th day of

THAN 25 ,000 ANIMALS AT ONE TIME PROVIDE SECONDARY
TREATMENT AND DISINFECTION OF ALL EFFLUENT, AND PROVIDE
STABILIZATION OF ALL SOLID WASTE, PRIOR TO DISCHARGING
ANY SUCH EFFLUENT OR SOLID WASTE ONTO THE LAND; (2 )
REQUIRING THAT SUCH FACILITIES ONLY APPLY EFFLUENT AND
SOLID WASTE TO THE LAND AT A RATE AND IN A MANNER WHICH
DOES NOT POLLUTE GROUND AND SURFACE WATER; AND (3 )
AUTHORIZING THAT COUNTY OFFICIALS AND RESIDENTS CAN

"WHEREAS, the quality of ground and surface water within Weld
County is important to the health and welfare of the inhabitants
of the County,
"WHEREAS, the discharge by large swine production facilities
of untreated liquid and solid wastes will adversely impact the
quality of ground and surface water, will promote the spread of
disease among people and wildlife , and will degrade the natural
environment within Weld County;
"WHEREAS, in order to protect the inhabitants of and preserve
to a reasonable degree the environment within Weld County, large
swine production facilities which discharge wastes onto the land
should be required to treat said wastes prior to discharge , to a
level at least as stringent as that required for the treatment of
domestic waste ,
"WHEREAS , swine production facilities capable of holding more
than 25 , 000 animals should be subject to this requirement,
"NOW THEREFORE, BE IT ORDAINED BY THE PEOPLE OF WELD COUNTY;
Section 1 -- Definitions
"Swine production facility" means any operation, business ,
building, area , or structure used for the purpose of maintaining,
feeding, stabling, or breeding swine , and includes any processes ,
operations , facilities , structures , and equipment for the
collection, detention, dilution, disposal , or discharge of effluent
or solid wastes in connection therewith. Two or more swine
production facilities under common ownership are a single swine
production facility if they adjoin each other, or if they use a
common area or system for the disposal of effluent or solid wastes .
"Concentrated swine production facility" means a swine
production facility which has the design capacity to hold more than
25 , 000 head of swine , of any weight, at any one time .

"Person" means an individual , corporation, partnership,
association, or agency.
"Effluent" means any and all wastewater resulting from the
operation of a swine production facility.

"Solid waste" includes any and all solid waste resulting from
the operation of a swine production facility, including, but not
limited to, swine feces and sludge from the processing of effluent.
"Agronomic rate of application" means the rate of application
of effluent and solid waste to the land at which rate the amounts
of nitrogen, phosphorus , potassium, and other available plant
nutrients in the effluent or waste is taken up and utilized by
vegetation and/or crops grown on the land. The discharge of
effluent or solid waste onto the land at the agronomic rate of
application shall not result in any increase in the concentration
of nitrogen , phosphorus , potassium or other chemical or nutrient
in the groundwater underlying, or down-gradient from, any
application site .
"Secondary waste treatment process " means any contained
treatment process , including, but not limited to, aerated lagoons ,
activated sludge ponds , or trickling filters, which results in
effluent that contains no greater than the following concentrations
of the following parameters :

digestion, anaerobic digestion, or composting, which meets the
following requirements :
A. Volatile solids reduction is 38% or greater; or
B . Volatile solids content is less than 65% .

Section 2 -- Requirements for Land Waste Treatment
A . Effluent Treatment
No person shall operate a concentrated swine production
facility so as to discharge any effluent onto the land for purposes
of treatment, disposal , or otherwise, unless :
( 1 ) The effluent , prior to land application; has been
processed through a secondary waste treatment system;
( 2 ) The rate at which the effluent is applied to the land
does not exceed the agronomic rate of application;
( 3 ) The effluent has been disinfected so that the 7-day
median number of coliform organisms contained in it does not exceed
23/100ml ; and
( 4 ) A buffer zone of 500 feet is maintained between the
boundaries of each and every effluent application site and all
surface waters , including, but not limited to, streams , ponds ,
reservoirs , and water conveyance ditches , and any wells used for
potable water .
B. Solid Waste Treatment
No person shall operate a concentrated swine production
facility so as to discharge any solid waste onto the land for
purposes of treatment, disposal , or otherwise, unless :
( 1 ) The solid waste ,prior to land application, has been
processed through a solid waste stabilization process;
( 2 ) The rate at which the solid waste is applied to the land
does not exceed the agronomic rate of application; and
( 3 ) A buffer zone of 200 feet is maintained between the
boundaries of each and every solid waste application site and all
surface waters , including, but not limited to, streams , ponds ,
reservoirs , and water conveyance ditches, and any wells used for
potable water .
Section 3 -- Ordinance Not to Supercede Other Laws
The requirements imposed by this Ordinance shall be in
addition to, but shall not abrogate, supercede, or amend any other
requirements applicable to land waste treatment by swine production
facilities imposed by federal or state law.

Section 4 -- Enforcement - Private Cause of Action
Weld County, through its Board of Commissioners , Board of
Health, Public Health Officer, Environmental Protection Services ,
or other departments so authorized, or any person who is a resident
of Weld County, may bring an action for equitable relief, including
a preliminary or permanent injunction, against any swine production
facility that is in violation of the requirements of this
Ordinance .
Section 5 -- Effective Date
This Ordinance shall take effect immediately upon its
enactment .

NOTICE OF SPECIAL ELECTION
In accordance with the Resolution by the Board of County Commissioners
of Weld County, Colorado, and pursuant to Section 15-4(2) of Article XV of
the Home Rule Charter of Weld County, Colorado, a special election is hereby
called and shall be held on Tuesday, March 20, 1990.
At such special election:
(a) Voters shall cast ballots for or against the adoption of an
Ordinance: (1) Requiring that all swine production facilities in
the County designed to hold more than 25,000 animals at one time
provide secondary treatment and disinfection of all effluent, and
provide stabilization of all solid waste, prior to discharging any
such effluent or solid waste onto the land; (2) Requiring that
such facilities only apply effluent and solid waste to the land at
a rate and in a manner which does not pollute ground and surface
water; and (3) Authorizing that County officials and residents can
enforce the Ordinance.
(b) The full text of the amendments shall be as follows:
