RE: APPROVE AGREEMENT FOR COMPUTER SERVICES WITH TOWN OF
FIRESTONE AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for
Computer Services with the Town of Firestone, and
WHEREAS, said Agreement shall be effective through December
31 , 1990 , with the further terms and conditions being as stated in
the Agreement, and
WHEREAS, after study and review, the Board deems it advisable
to approve said Agreement, a copy of which is attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Agreement for
Computer Services with the Town of Firestone be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is , authorized to sign said Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 5th day of
November, A.D. , 1990.

AGREEMENT FOR COMPUTER "SERVICES
THIS AGREEMENT, made this - day of NoVem ber , 1990, by and
between the TOWN OF FIRESTONE, COLORADO, with its principal place of business
at 150 Buchanan, Firestone, Colorado 80520-0100, hereinafter referred to as
"Firestone," and the COUNTY OF WELD, STATE OF COLORADO, a county government with
its principal place of business being the Centennial Center, 915 Tenth Street,
Greeley, Colorado 80631, hereinafter referred to as "Weld County," is subject
to the following agreed statement of facts:
A. This Agreement shall be effective immediately and shall continue
through December 31, 1990, and to be renewed automatically on a year
to year basis, except as provided in paragraph 5 hereof.
B. Firestone has contracted for access to selected application systems
currently running on the Weld County mainframe computer.
C. For each application system the Firestone Police Department wishes
to access, a written memo will be sent to that Weld County
department's elected official or department head requesting
authorization for access and the type of access requested, e.g.
INQUIRY, ADD, UPDATE, or DELETE. The signed document(s) will be
forwarded to the Director of Information Services of Weld County.
D. Weld County agrees to make available the requested application
systems when and if documentation of authorization has been received.
NOW THEREFORE, in consideration of the forgoing recitals and provisions,
terms, and conditions set forth below, the parties agree as follows:
1. Acquisition of Data.
a. Weld County agrees to provide access to the authorized systems
through the use of its dialup access facilities on the
mainframe computer.
2. Charges and Fees.
a. Weld County shall provide Firestone Police Department with a
schedule of fees and charges for services and products which
shall be the standard rates charged to all users of the Weld
County Computer Center. Exhibit "A. " Rates shall have a
minimum revision of once annually, with this revision being
effective January 1st of the new year.
b. Weld County shall provide Firestone Police Department with an
estimate of initial startup costs and on-going maintenance
costs of use of Weld County resources.
c. Firestone agrees to pay on a monthly basis for all services
and data at the rates established by Weld County as provided
in paragraph "a. " above, upon receipt of an itemized bill
identifying such services, data, and rates.
d. Firestone agrees to pay for any staff resource time required
to modify the authorized system(s) in order to accommodate
their request for data from Weld County, but an estimate of
such cost shall be provided Firestone in advance of any such
expenditure of staff resource time.
e. Firestone agrees to pay, at the going rate, all telephone
company costs charged to Weld County that are related to the
dialup connection, upon receipt of a bill identifying such
costs. (See Exhibit "B", Section II for estimated costs. )
3. Method of Delivery.
a. Weld County agrees to provide access through a dialup
connection with the Firestone Police Department and to provide
the necessary access codes and passwords.
b. Firestone agrees that all hardware and software used by them
to access Weld County's systems will be compatible with Weld
County's computer environment. Weld County does not, however,
guarantee that future upgrades to the existing Weld County
computer system will remain compatible with Firestone Police
Department hardware or software.
c. Weld County will provide Firestone with one copy of the
necessary reference manuals for each of the authorized systems.
d. Firestone will provide the necessary telephone line(s) to
establish the requested dialup access with Weld County. In
addition, the line provided will be a direct line to their
personal computer that is used for the dialup access. The
telephone line(s) will not go through a switchboard or
operator.
e. Firestone agrees that services requested in this Agreement can
be discontinued without notice and without further cost to
Firestone if Weld County determines problems with the Weld
County computer network are related to hardware or software
used by the Firestone Police Department. Service would only
be reestablished at the point in time the problem hardware or
software is demonstrated to work without problems on the Weld
County computer network.
4. Representations.
a. Weld County represents that it will use its best efforts to
provide accurate data to Firestone Police Department pursuant
to the terms of this Agreement. Weld County does not, however,
guarantee the accuracy of the data provided.
b. Weld County represents that, except when the system is down
for normal maintenance, it will use its best efforts to provide
dialup access at all times. Weld County does not, however,
guarantee dialup access availability at all times.
c. Firestone represents that it will not, under any circumstances,
resell or republish for a fee the raw data provided by Weld
County to any third party. The data obtained from Weld County
shall be for the sole use of the Firestone Police Department.
d. Firestone represents that it will follow all federal and state
statutes, rules, and regulations for the dissemination and
disposal of confidential or limited access type information.
5. Miscellaneous.
a. This Agreement shall be binding and inure to the benefit of
Weld County and Firestone.
b. No alteration or variation of the terms of this Agreement shall
be valid unless made in writing and signed by the parties
hereto.
c. Firestone may not assign or transfer this Agreement, any
interest therein, or claim thereunder without the prior written
approval of Weld County.
d. Weld County or Firestone may terminate this Agreement at any
time by giving the other a ten-day written notice of
termination and may terminate this Agreement at any time
without notice upon a material breach of the terms of this
Agreement by the other party.
e. The relative liabilities of Firestone and Weld County for any
action brought as a result of an injury to a person or property
shall be determined in accordance with C.R.S. , Section 13-21-
111.5 (1987 Repl. Vol. ) . Firestone and Weld County shall
provide necessary workmen's compensation insurance at their
own cost for their own personnel.
f. No portion of this Contract shall be construed to confer a
benefit or the right of a cause of action lying in tort,
contract, or otherwise upon any person or entity not a party
to this Contract. Furthermore, no portion of this Contract
shall be deemed to constitute a waiver of any governmental or
personal immunities held by the parties or their officers,
agents, or employees.
g. All notices required to be given under the terms of this
Agreement shall be effective upon the dispatch of a copy of
the notice, first class mail, postage prepaid, certified or
registered mail, return receipt requested. Notice to Firestone
shall be given to the Mayor of the Town of Firestone, 150
Buchanan, P. O. Box 100, Firestone, Colorado 80520-0100. All
notices to Weld County shall be sent to Board of County
Commissioners of the County of Weld, P. O. Box 758, Greeley,
Colorado 80632, with a courtesy copy to the Director of
Information Services, P. O. Box 758, Greeley, Colorado 80632.

DESCRIPTION OF PROBLEM/COST ESTIMATE
I, SYSTEM OVERVIEW
A. Problem Definition
Being an entity within Weld County, the Firestone Police Department comes
into contact with the same people as the Sheriff's Office. In addition,
the Weld County Jail is the holding facility for people who are arrested
within Weld County, Each time someone is booked at the Weld County Jail,
the Sheriff's Office records detailed information to identify the
individual and record the specific arrest information: All this
information, which covers all of Weld County, is stored in Weld County's
mainframe computer.
Having access to the Sheriff's information, will provide additional
information on involvements that in the past, they may not have known
about. Accessing Weld County's criminal justice information will help
improve Firestone's investigation and information retrieval capabilities.
Having access to the County's Electronic Mail network, enhances the
Firestone Police Department's communication capabilities with the Weld
County Sheriff's Office, the District Attorney's Office and other
departments already on the Email network.
The Firestone Police Department currently has access to a personal
computer, modem, and communications software. They would like to know the
feasibility and estimated cost to have access to the Sheriff's criminal
justice information.
B. Objectives of the project
1. Facilitate the sharing of criminal justice information with other
law enforcement agencies.
2. Maintain the integrity of each agency's records through system
security.
3. Provide the user with system training as needed.
4. Give on-call technical assistance for the automated systems.
5. Provide maintenance support to correct program malfunctions, rerun
jobs, consult with the user, and make state, county, or city mandated
changes.
C. System Narrative
Firestone's personal computer, modem, and communications software would
be configured to provide dial-up access to the authorized systems on the
Weld County computer network.
Once authorization has been given to the Firestone Police Department, they
would have the capability to inquire on the Sheriff's TEN-FOUR and Property
Location and Identification systems; and the County's Emergency Dispatch,
and Motor Vehicle systems. In addition, besides just inquiry access, ADD
and UPDATE capabilities can be requested for the TEN-FOUR and Property
Location Identification systems. Having add/update capability allows the
Firestone Police Department to share its own information with the other
law enforcement agencies in the network.
Having access to the mainframe computer also provides access to the
County's Electronic Mail Network, which provides the capability to create,
send, or retrieve messages or whole documents to anyone else in the
network, including the Sheriff's Office and the District Attorney's Office.
All the systems accessible to the Firestone Police Department have security
built into them that allow only authorized activity within a system.
D. System Interfaces
If the ADD/UPDATE capabilities are chosen, the Firestone Police Department
will share file space with the Weld County Sheriff's Office.
F.. Statement of Feasibility
The development of this project is feasible.
F, Special Considerations
This estimate is provided under the agreement that the Firestone Police
Department will use the Weld County systems as is. If special enhancements
or new reports are requested by the Firestone Police Department, the cost
for the actual amount of resources used would be in addition to what is
stated in this estimate.
The installation of an additional telephone line or telephone wiring
requirements within the Firestone Police building are the responsibility
of the Firestone Police Department and are not included in this estimate.
Any line that is installed or an existing line that is used must be direct
to the personal computer. The line cannot go through a switchboard or
operator and it should have an RJ11 type connector on it for the modem to
plug into.
The Weld County computer network and application systems operating within
it have been designed for the IBM environment. If network or systems
problems are found to be related to non-IBM equipment or software, Weld
County Information Services Department reserves the right to disconnect
the problem equipment or software until the problem is corrected.
Additionally, Weld County Information Services cannot guarantee that future
upgrades by IBM will remain compatible with non-IBM equipment or software.
II. ESTIMATED COSTS FOR FULL ACCESS
This section will show the estimated costs for "Full" access to Weld
County's systems. "Full" access will allow the Firestone Police department
to ADD, UPDATE, and DELETE records on the Sheriff's TEN-FOUR system, the
Property Location ID system, and the County's Electronic Mail network.
The Emergency Dispatch system and the Weld County Motor Vehicle system
will only provide access in inquiry mode.
There are two groups of costs associated with providing access to the
Firestone Police Department.
1. Development costs are one-time costs necessary to prepare your staff
and equipment for the dial-up access. In this case, development
costs will be associated with personnel time for training your staff.
2. Maintenance costs, which are billed monthly, consist of costs for
time in accessing the mainframe computer and costs related to keeping
the system functioning. Maintenance costs may include personnel time
to correct system errors, modifications required by the Firestone
Police Department, computer time, equipment rental and maintenance,
telephone line charges, and data storage costs.
All costs, whether they are Development or Maintenance costs, are billed
only for the amount of resources used.

Dear Chief Modrell:
In response to your request, for providing your department access to the Weld
County mainframe computer, the attached contract and estimate of cost were
prepared. The costs cover the usage of Weld County software and hardware to
access Weld County files currently online and the personnel time used to provide
these services to your department. The costs provided are only an estimate, and
charges will be for actual services, billed at the uniform rates for all users
of the Weld County Information Services Department. Rates quoted are the 1990
rates.
We appreciate the opportunity to provide the use of these systems to the
Firestone Police Department. We are confident these systems will be of
assistance in providing services to your citizens.
Weld County Information Services staff will be happy to make themselves available
to discuss the contract or to provide further information on the enclosed
estimates.
Police Chief Modrell, to have Weld County Information Services proceed with the
project, please sign the enclosed contract and return it to me.
