The Department of Planning Services has determined through the review that the standards
of Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been met.
This Recorded Exemption is approved with the following conditions in accordance with
information submitted in the application and the policies of the County.
The applicant shall submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared
in accordance with the requirements of Section 11.7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty (60) days from the date of approval
by the Department of Planning Services. The applicant shall be responsible for paying
the recording fees.

There are three residences located on the property. Two on Lot B and one on Lot
A of the Recorded Exemption. A dairy operation is located on proposed Lot B.
The property slopes from the south down to the north. The majority of the
property is in pasture. One access onto Highway 85 was observed.

Gentlemen:
Enclosed with this letter which is part of the application for
an Amended Recorded Exemption is the original and five copies of
the following: completed application form, copy of deed, letter
from Central Weld County Water District, map showing existing and
proposed property, one copy of the Certificate of Conveyances and
application fee in the amount of $825 . 00 .
This request is for the purpose of amending an existing
Recorded Exemption which was approved by the Board of County
Commissioners of Weld County, Colorado on August 10, 1983 as
Recorded Exemption No. 629 . The purpose of this request is to
decrease the size of Lot "A" by approximately two acres and
increase the size of Lot "B" by approximately two acres . At the
present time both Lots "A" and "B" are being used for agricultural
purposes and rural residential . Specifically the larger parcel is
mainly used for farming, grazing and a small dairy operation. The
smaller parcel is used for pasture purposes and a rural residence .
It has become necessary to amend the Recorded Exemption due to
the fact that it is necessary to follow the existing fence line
which is already in place based upon a prior survey. Additionally,
the fence has been placed for dividing pasture lands on a natural
division based upon contours .
This proposal is consistent with the Weld County Comprehensive
Plan, the permitted uses are compatible with existing uses and the
proposal is consistent with the intent of the zoning district as no
uses will change with this amendment, the existing uses are rural
residential and agricultural which are the same uses as surrounding
properties and this type of use is a use by right in the ag zone
district in Weld County. The Weld County Comprehensive Plan shows
this property as presently and in the future to be agricultural and
the property is not subject to any adopted municipal plan.

This amendment proposal is consistent with efficient and
orderly development as it does not require any new services or
facilities of any type, therefore there is no change in
development . As the only change is the change of a boundary line,
prior and existing provisions for the protection of health, safety
and welfare of the inhabitants and county are provided for.

RE: Water Service
Dear Mr. & Mrs. Binder:
This letter is in response to your request for the availability of additional water service for the
following described property:
E 1/3 S 1/2 Section 3, Township 1 North, Range 67 West of the 6th P.M.,
Weld County, Colorado
Water service is presently available to the above described property by tap number 1175 located
at Weld County Road 12 1/2 between 19 & 21. Additional water service can be made
available to this property provided all requirements of the District are satisfied.
Central Weld County Water District requires that contracts be consummated within one (1) year
from the date of this letter or this letter shall become null and void unless extended in writing
by the District.
