RE: APPROVE AMENDMENT TO COMBINED COOPERATIVE REIMBURSEMENT AGREEMENT WITH
COLORADO DEPARTMENT OF SOCIAL SERVICES AND AUTHORIZE CHAIRMAN TO SIGN -
$176,917.64
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Amendment to Combined
Cooperative Reimbursement Agreement, in the amount of $176,917.64, between the
Colorado Department of Social Services and the Weld County Department of Social
Services, with the terms and conditions being as stated in said amendment to
agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
amendment, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, ex-officio Board of Social Services, that the Amendment to the
Combined Cooperative Reimbursement Agreement, in the amount of $176, 917.64,
between the Colorado Department of Social Services and the Weld County Department
of Social Services be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said amendment. The above and foregoing Resolution was, on
motion duly made and seconded, adopted by the following vote on the 6th day of
January, A.D. , 1993.

AMENDMENT TO THE COMBINED COOPERATIVE
REIMBURSEMENT AGREEMENT BETWEEN THE
COLORADO DEPARTMENT OF SOCIAL SERVICES AND
THE BOARD OF WELD COUNTY COMMISSIONERS
This Amendment, made and entered into this 6th day of January, 1993,
between the County of Weld, State of Colorado, by and through the Weld County
Department of Social Services, hereinafter referred to as the "County," and
the State of Colorado, Department of Social Services, hereinafter referred to
as the "CSDSS."
WITNESSETH:
WHEREAS, the CSDSS and the County have entered into a multi-year
contract, and
WHEREAS, the parties desire to clarify its original Agreement, dated
September 23, 1991, and to modify contract for reimbursement funding for
calendar year 1992, and
WHEREAS, the required approval, clearance, and coordination has been
accomplished from and with appropriate agencies.
NOW THEREFORE, in consideration of the premises, the parties hereto
covenant and agree as follows:
1. This Amendment shall be effective January 6, 1993.
2. The original Agreement, dated September 23, 1991, does not have an
ending date and constitutes an on-going agreement between the parties.
3. The original agreement shall be assigned a contract number of
EFRP-91-1.
4. The CSDSS desires to have a yearly amendment to the Exhibits of the
original Agreement beginning January 1 through December 31 of each
year.
5. Exhibit I, Combined Cooperative Reimbursement Agreement, Scope of
Services, is renewed for a new calendar year of reimbursement funding
for the period of January 1, 1992 through December 31, 1992. Exhibit
I, dated June 9, 1992, is attached hereto and made a part hereof by
this reference.
6. Exhibit II, Combined Cooperative Reimbursement Agreement, Personnel is
renewed for a new calendar year of reimbursement funding for the period
of January 1, 1992 through December 31, 1992. Exhibit II, dated June
9, 1992, is attached hereto and made a part hereof by this reference.

7. Exhibit III, Combined Cooperative Reimbursement Agreement, Budget, is
renewed for a new calendar year reimbursement funding for the period of
January 1, 1992 through December 31, 1992. Exhibit III, dated June 9,
1992, is attached hereto and made a part hereof by this reference.
8. Except as modified herein, the terms and conditions of the original
agreement (EFRP-91-1) , and modification (EFRP-91-2) , together with all
attachments hereto, remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have duly executed the Amendment

COMBINED COOPERATIVE REIMBURSEMENT AGREEMENT
SCOPE OF SERVICES
I. Precertification Investigation
Workers must have title of investigator or similar title. Other titles
must be justified and approved as an exception.

(v(c. Referral of findings to eligibility worker for determination of
eligibility.
II. Post-Investigations

(via. Conduct in their entirety, investigations of suspected
intentional fraud affecting the Food Stamp/Aid to Families with
Dependent Children (AFDC) administered by the county.
(V)b. Taking of formal, written statements of witnesses and suspects
involved in a fraud case.
(c{c. Preparation of final report of investigation for presentation to
district attorney for prosecution and/or Administrative Hearing
Officer.
III. Administrative Fraud Hearing
(frra. Establish appropriate referral system for cases to be scheduled
for administrative fraud hearings at the state level.
(vJ b. Conduct administrative fraud hearings in accordance with State
Food Stamp Regulations Volume IVB and AFDC Program at the local
level.
IV. Prosecutions: District Attorney
(61-C.. Establish criteria for referral of Food Stamp/AFDC fraud cases
to district attorney.
(c- b. Prosecute the fraud cases under appropriate state statute, CRS
26-2-3-5, 1982, as amended, or other criminal/civil statute
(includes pre-trial, trial, and post-trial prosecutorial
functions) .

Dear Mr. Shanahan:
This is in regard to the pending sale of your clients' - Efrain and
Yolanda Lopez - property at 521 Ninth Street in Greeley. The actual value of
this property was assessed at $18,799.00, in 1990. This figure is
substantially reflected in the consideration recited in the Warranty Deed
transferring the property from Helen and Juan B. Moncada to Simon Subia and
Marie Aguirre, dated May 16, 1990, and recorded on June 12, 1990. It is
further of interest that the sale between the Lopez's and Subia/Aguirre was
apparently a cash deal, no Deed of Trust having been recorded with respect to
this transfer.
I am authorized by the Weld County Department of Social Services's
Director to state that, although the Department does not believe that the
Lopez's are entitled to any release of the Department's interest in this
matter, in the interest of avoiding a stalemate and providing some relief for
the Lopez's, the Department will consider quitclaiming its interest in the
property for consideration of $12,250.00. This figure is based upon
information provided from your office and represents the $8,000.00 original
purchase price plus half of the difference between the apparent current
selling price and the purchase price:
$16,500 - Selling Price
8,000 - Purchase Price
$ 8,500
$8,000 + $4,250 = $12,250

This purely represents a compromise on the part of the Department, and
would allow the Lopez's at least some relief from their current predicament.

SUBJECT: Amendment To The Combined Cooperative Reimbursement
Agreement Between The Colorado Department Of Social
Services And The Board Of Weld County Commissioners
For Calendar Year 1992
Enclosed for Board approval is an amendment to an agreement entered into by
the Board and the Colorado Department of Social Services. This agreement
provides for reimbursement funding of 75% for actual costs associated with
investigation, administrative disqualification hearings, prosecution, and
establishment and collection of claims for internal fraud involving the AFDC
and Food Stamp Programs.
This Amendment clarifies the funding year and modifies the original
reimbursement funding request for calendar year 1992.
The total reimbursement budget is $176,917.64 and provides funding for 3.75
staff.
