RE: APPROVE EXTENSION OF TERM OF MEMORANDUM OF UNDERSTANDING - SIMPSON FARMS
COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated June 13, 1979, the Board did grant approval
for a livestock confinement operation under Special Use Permit No. 387 to Gary
Simpson, on property being more fully described as:
We of Section 26, Township 8 North, Range 65 West of
the 6th P.M. , Weld County, Colorado
WHEREAS, by Resolution dated October 9, 1991, the Board did grant approval
of a Memorandum of Understanding between Simpson Farms Company and the Board of
County Commissioners, commencing October 9, 1991, and ending December 31, 1992,
and
WHEREAS, the Board has been presented with a request for a one-year
extension of the term of said memorandum of understanding, until December 31,
1993, and
WHEREAS, the Board deems it advisable to approve said request, a copy of
which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request for a one-year extension of the term of the
Memorandum of Understanding between Simpson Farms Company and the Board of County
Commissioners be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the term of said memorandum of
understanding be, and hereby is, extended to December 31, 1993.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 14th day of December, A.D. , 1992.

RE Memorandum of understanding issued 10/9/91
We would like to request a one year extension of the memorandum
concerning the alligators located on SUP # 387 which expires Dec 31 1992
The alligators are doing fine and we have learned a great deal in the
last year. They are about five feet in lenght now and that is about
what we had anticipated However we would like one more winter to make
sure our calculations are correct, as last winter was very mild. This
will be a multimillion dollar project and we want to be as correct
in our assumptions as possible.
We will be happy to attend another hearing or attempt to answer
any questions you might have.

Mr. Simpson has requested a one year extension until December 31, 1993, on the
Memorandum of Understanding. Mr. Simpson is proposing no other changes to the
Memorandum of Understanding.
The Weld County Health Department has expressed some concerns in its memo dated
October, 26, 1992 , about the facility and has recommended that the concerns be
addressed when the extension is considered by the Board.
The Planning Department recommends that the extension be granted provided that
Mr. Simpson address the Health Department' s concerns to the satisfaction of the
Board.

Sublime Simpson Alligator vvvv Rearing Facility
On Friday, October 23, 1992, I met with Gary Simpson to inspect their facility
in response to a request for an extension to their temporary USR. Since last
year was such a mild winter, they are requesting an extension to see how the
alligators will do through one more winter. They started with 20 gators and are
down to 19 at this time.
My inspection was primarily to determine if the recommendations made by our
division in September of 1991 had been met. I did not see any dead animals on
the site and they have installed a freezer in the lab where the animal feed is
stored. According to Mr. Simpson, any dead animals are ground when they come in
and promptly frozen.
My major concern at the site is with the containment pond. Mr. Simpson informed
me that no formal percolation or soil studies had been done at the site with the
exception of an inspection by Wes Potter at the time of pond construction. It
would be my recommendation that soil analysis be done at the site to insure the
protection of groundwater. In addition, there is some mild soil erosion on the
interior berm of the pond. I recommended to Mr. Simpson that he maintain the
berms to prevent compromising the liner.
One other concern is the method of disposal of effluent into the pond. They
currently have a PVC pipe discharging into the pond at about the 4 foot level.
The pond is six feet deep. They do this because of the manner in which they
separate the solids. They place screens under the discharge pipe and allow the
effluent to run over them and then collect the solids for food analysis studies.
This practice, however, has led to significant erosion on that portion of the
berm. It has cut the berm back and I question the integrity of the liner in that
location. I informed Mr. Simpson that I had a concern with this and alternate
methods of collecting the solids and discharging into the pond needed to be
examined.
It is my recommendation that these concerns be addressed and reviewed during the
permit extension process.
