APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that
the standards of Section 9-2 E. (1) (a) through (m) of the Weld County
Subdivision Regulations have been met. This Recorded Exemption is approved
with the following conditions in accordance with information submitted in
the application and the policies of the County.
An ISDS evaluation by the Weld County Health Department on all existing
septic systems will be necessary prior to issuing the required septic
permits on the existing systems.
The following note shall be placed on the recorded exemption plat prior to
recording:
The property shall be utilized in compliance with existing
Panhandle Eastern Pipeline Company 50 foot wide right-of-way
easements as recorded in Book 705 at Reception No. 1626741 and
Book 943 at Reception No. 1864586 and any other easement of
record.
Prior to recording a 75' right-of-way reservation shall be shown from the
centerline of Highway 52.
The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for
paying the recording fees.

APPLICATION REQUIREMENT NO. 4
Purposes for dividing the single parcel
into two separate lots .
The Owner of the single parcel for which division is
sought desires to convey the smaller parcel sought to be
created to her daughter and son-in-law in order that they may
continue to operate and expand an existing agricultural
equipment repair business on the smaller parcel . This
business has operated for approximately five years on the
smaller parcel pursuant to a Conditional Use Permit issued by
Weld County . While the Owner/Applicant did , for
approximately twenty years, conduct agricultural operations
on the smaller parcel, the same is quite unproductive as a
result of the poor soils on said parcel . Therefore, the
Owner/Applicant no longer desires to conduct farming
operations on that parcel and would like to assist her
daughter and son-in-law in the expansion of their business .
APPLICATION REQUIREMENT NO. 5
Consistency of Application With Policies of
Weld County Comprehensive Plan
The single parcel for which division is now sought
is presently zoned agricultural . However, pursuant to a
Conditional Use Permit, the smaller parcel which is to be
created by this recorded exemption has , for the past five
years , been used for the operation of an agricultural
equipment repair business . The Applicant understands that
the goal of agricultural zoning under the Weld County
Comprehensive Plan is to promote the continued use of
productive agricultural land for farming purposes . However,
the smaller parcel described in this recorded exemption
application is not suitable for agricultural purposes, having
extremely poor soil with a high gravel content . During the
approximately twenty years in which the present owners have
conducted agricultural operations on the entire parcel, such
operations have proven unproductive on the smaller parcel
which the owner now seeks to divide.
As set forth above, the smaller parcel has been used
as an agricultural equipment repair business for the past
five years under a Conditional Use Permit and has proven well
adapted to this sue. Access to this parcel, as shown in the
attached recorded exemption map is from Colorado State
Highway 52 . Traffic entering and exiting the existing repair
business located on the smaller parcel is light to moderate
and has not, in the last five years, caused any disturbance
in the flow of traffic on Colorado State Highway 52 .
The Applicant believes that the conduct of an
agricultural equipment repair business on the smaller parcel
would promote the development of commercial sues directly
dependent upon and of service to the surrounding agricultural
community . Further , the proposed use would encourage
commercial development to locate adjacent to the urban
boundary of the City of Fort Lupton, since the smaller parcel
which Applicant proposes to dedicate to commercial sues is
within the urban growth boundaries of that city. Further,
residential development along and adjacent to Colorado State
Highway 52 is unlikely and it is believed the area will
ultimately be devoted to commercial uses.

APPLICATION REQUIREMENT NO. 6
Consistency With Intent of the Zone District
in Which Property is Located
The entire parcel is presently zoned agricultural .
However, that portion of the parcel which would become the
smaller parcel under the requested recorded exemption has ,
for the past five years , been used for an agricultural
equipment repair business existing pursuant to a Conditional
Use Permit granted by Weld County . The larger parcel
resulting from the recorded exemption would remain
agricultural and therefore would retain its existing use and
would continue to be consistent with the zone district in
which the property lies .
Use of the smaller parcel for purposes of an
agricultural equipment repair business is consistent with the
intent of the zone district in that this business is
dependent upon the surrounding agricultural industry and also
provides a necessary service to the agricultural community in
the surrounding area . Further, this proposed use would
encourage commercial development to locate along Colorado
State Highway 52 adjacent to the urban boundary of the City
of Fort Lupton which applicant believes would ultimately be
dedicated to commercial use. The establishment of businesses
and enterprises related to and of service to the surrounding
agricultural industry along this corridor is advisable and
beneficial to the surrounding agricultural industry, and the
applicant believes that the continued utilization of the
smaller parcel for a commercial enterprise related to
agricultural production would influence the course of
development of this corridor toward agriculturally related
businesses .
APPLICATION REQUIREMENT NO. 7
Permitted Uses and Compatibility With Surrounding Uses
The permitted uses on the larger parcel resulting
from this recorded exemption will remain the same, that is
farming and ranching operation and the maintenance of farm
outbuildings and a residence on the large parcel by the
owner.
The uses permitted on the smaller parcel will
consist of an agricultural equipment repair business, which
business has been in existence on the smaller parcel pursuant
to a Conditional Use Permit for the past five years.
The agricultural equipment repair business presently
located upon the smaller parcel is a business which depends
for its existence upon the surrounding agricultural industry
and conversely, provides an essential service to the
surrounding farm community.

APPLICATION REQUIREMENT NO. 8
The Permitted Uses Will be Compatible With
Future Development of the Surrounding Area
As stated above, the use of the large parcel will
remain agricultural if this recorded exemption is granted.
Again, the smaller parcel would be used for an
agricultural equipment repair business which has existed on
the smaller parcel for the past five years . The larger
parcel is located immediately adjacent to Colorado State
Highway 52 and within the urban boundary of the City of Fort
Lupton, Colorado . The applicant believes that residential
development along and adjacent to Colorado State Highway 52
is unlikely and that this area will ultimately be devoted to
commercial uses within the urban boundary of the City of Fort
Lupton. The agricultural equipment repair business clearly
is compatible with commercial development of the Colorado
State Highway 52 corridor adjacent to the City of Fort
Lupton.
APPLICATION REQUIREMENT NO. 9
The Proposed Recorded Exemption Will Not Be
Inconsistent With Efficient and Orderly Development
As stated in Application Requirement No . 8 above,
early dedication of the smaller parcel adjacent to Colorado
Highway 52 will promote efficient and orderly development of
commercial uses along the highway and within the urban
boundary of the City of Fort Lupton. The lands immediately
adjacent to the highway are not particularly suited for
residential or other development due to the constraints
imposed by the high traffic volume on Colorado State Highway
52 . Further, the property immediately to the east of the
smaller parcel has been approved for gravel mining operation,
the ultimate use of which will probably be commercial or
industrial, and the early devotion of the smaller parcel to
commercial uses will , the applicant believes , influence
adjacent property toward orderly development of commercial
use.
APPLICATION REQUIREMENT NO. 10
Existing water and sewage disposal method.
The large parcel currently receives water from one
deep and one shallow well, and has done so for approximately
thirty years . Sanitary disposal services to the large parcel
are supplied by septic system which has been in existence for
approximately twenty years. Both wells as well as the septic
system are permitted.
For the last five years the small parcel has been
served water by means of a shallow well . The small parcel
receives sanitary disposal services by means of a septic tank
system.
APPLICATION REQUIREMENT NO. 11
Statement Regarding Flood Plain Geological
Hazard and Weld County Airport Overlay District
The Applicant hereby certifies that the property
under consideration for a recorded exemption as set forth in
the Application to which this statement is attached is not
located in a flood plain, is not located within the area of

The Fort Lupton Planning Commission has reviewed and made
recommendations to the following county referrals:
Charles and Barbara Patterson for a site plan review.
SW4, SE4 of Section 19, TIN, R66W of the 6th P.M.
RECOMMENDATION: Approve the site plan contingent on an
approved landscape screening plan around the storage yards,
proper maintenance of the storage yards visible from US 85,
and all well and septic permits approved by the Health
Department. Motion duly made and seconded passed unanimously.

Panhandle Eastern's pipeline, 16-10-075-21-4, located in or near
the property described as part of the Southwest Quarter of
Section 1, Township 1 North, Range 67 West , Weld County,
Colorado.
Panhandle does not foresee any conflicts with this request.
However, we would like to request that Ms. Pehr be made aware
that she and/or all contractors involved in any plans of
construction/excavation on this property, must contact us prior
to any such activities. At that time, we may discuss their plans
and interpret the following stipulations.
Panhandle Eastern maintains a 50-foot wide right-of-way on all
pipelines and will not allow any building within that easement
area. Utility lines, streets, sidewalks, and driveways may be
installed at approximate right angles to the pipeline herein
authorized, provided, however, that all utilities cross under our
pipeline with a minimum clearance equal to the diameter of the
larger utility or 18" , whichever is greater. No paved or
traveled portion of any street, sidewalk, driveway, road, alley,
or curbing will be placed substantially parallel to and within
fifteen ( 15' ) feet of the pipeline, provided adequate working
space is available on the other side of the pipeline.

please contact Utility Notification Center of Colorado (UNCC) at
534-6700 (Local & Metro Denver) . or 1-800-922-1987 (Outside the
Metro area) , with two (2) business days notice, and at no cost to
you, we will locate and mark our lines to eliminate accidents
that can occur from foreign forces.
We will be more than happy to work with everyone involved,
however, it must be noted that if for any reason our lines must
be moved, it will be at the expense of the developer or the
person or persons asking for this movement.

Dear Mr. Schuett:
We have reviewed the Pehr application for a Recorded Exemption, and
we have the following comments:
Projected traffic on S.H. 52 indicates the need for a 150 foot total
right of way, 75 feet each side of the highway centerline. Since the existing
width along this property is 60 feet south of the centerline, additional
width to meet the projected need should be protected by reservation or,
preferably, dedication, as permitted by County regulations.
Access to the properties must continue to be via the access easement
at the common property line separating the larger and smaller parcels with
no additional access to S.H. 52. Since there is no change of use of the
properties proposed, no Access Permit will be necessary. If a change of
use of either of the properties or major expansion of the business is proposed
at some future date, the possible need for an Access Permit must be assessed.

Dear Mr. Schuett:
We have reviewed the above referenced proposal to split a 105 acre parcel into lots of 103
and 1.83 acres. The proposed 1.83 acre lot would be used to accommodate an equipment repair
business. The applicant has obtained a permit for an exempt commercial well on this lot (Permit
Number 140143). Use of this well is limited to drinking and sanitary facilities as described in
C.R.S. 37-92-602(1)(c), for a building equipped to steam clean diesel engines , truck and farm
equipment. Water from this well may not be used for lawn or landscape irrigation or any other
purpose outside the building. The larger lot appears to be served by a domestic well Permit
Number 46806.
If the limitations on well use described above are acceptable to the applicant, then we have
no objection to the proposal and recommend approval. If you have any questions in this matter,
please contact me.
