RESOLUTION RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 825 - GENE AND SANDRA ULM WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, in January of 1986 , the Department of Planning Services reviewed and approved Recorded Exemption No. 825 for Gene and Sandra Ulm concerning property described as part of the SWi , Section 18 , Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, Gene and Sandra Ulm are now requesting that Recorded Exemption No. 825 be amended so that Lot B will be reduced from 164 acres to 75 acres, and Lot A will be increased from 3 .5 acres to 7 . 5 acres , and WHEREAS, the Board of County Commissioners has studied said request for an amendment to Recorded Exemption No. 825 and deems it advisable to approve same. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the amendment to Recorded Exemption No. 825 for Gene and Sandra Ulm be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1 . The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2C. (4) o£ the Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2 . Prior to recording, the plat must show a 30-foot access easement. 3 . The parcel of land is described as part of the SW} of Section 18, T6N, R66W of the 6th P.M., Weld County, Colorado. The property is located north of Highway 392 and east of Weld County Road 25. The request is to amend a recorded exemption which was recorded in 1986. The original recorded exemption was submitted in conjunction with a subdivision exemption, which created a lot of approximately 4 acres. The original recorded exemption created two lots of 164 acres and 3.5 acres, more or less. Each of the three created lots has a set of residential improvements. This request is to amend the original recorded exemption so that Lot B will be reduced from 164 acres to 75 acres, and Lot A will be increased from 3.5 acres to 7.5 acres. The expansion of Lot A to 7.5 acres will mean that two sets of residential improvements will be on Lot A, and Lot B will have no residential improvements. The residences are all served by North Weld County Water District and septic systems. The applicant has proposed serving the larger parcel with North Weld County Water District and a septic system. The proposed larger lot is in agricultural production. The Department of Planning Services' staff has concerns whether the proposed amendment will be consistent with efficient and orderly development. When the original recorded exemption and subdivision exemption applications were approved, each created lot had residential improvements and no new building sites were created. The proposed amendment will allow a residential building permit on the proposed 75 acre lot, and a residential building permit on the 80 acre lot to the north which will no longer be a part of the recorded exemption. The potential for continued division in this quarter section warrants concern. Residential development in rural areas necessitates an increased demand for road maintenance, police and fire protection, school busing, snow removal, utilities, and other urban services. Our intentions are to add the existing improvements of Lot B to Lot A which shall increase the existing Lot A by approximately 4 acres . This will allow my family and I to remain on the farm and continue the farming operation. Our current financial situation dictates we sell off the farm ground and lease it back from the new owners . We would also ask that Lot B be amended to encompass the South half of the Southwest Quarter instead of the entire Southwest Quarter . My Father and Mother in-law, who have retired from the farming operation, currently live in the existing dwelling on Lot B. This amendment to the existing recorded exemption would allow me to continue farming in much the same manner as I have in the past. I also lease the Southeast Quarter of this Section from the adjoining land owner . This request of amending Lot B is consistent with Section 31 . 5 of the Weld County Zoning ordinance . The intended use for Lot B is irrigated farming operation. This is compatible with the uses to the North, South, East, and West which are all irrigated crop farms . The use is consistent with the agricultural zone which allows for among other things production of cash crops _ of f” I We live outside the Town of Windsor comprehensive plan area which is the closest municipality. The existing dwellings on Lot A are currently served by North Weld water district and as indicated in the attached letter, North Weld is capable of serving Lot B with water .
