HomeMy WebLinkAbout911462.tiff RESOLUTION RE: APPROVE INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF FORT LUPTON AND AUTHORIZE CHAIRMAN TO SIGN - BRIDGE 14.5/25A WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Intergovernmental Agreement between the County of Weld and the City of Fort Lupton, for the purpose of constructing Weld County Bridge 14.5/25A and Fort Lupton Bridge FTLI4TH-Fulton, with the terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Intergovernmental Agreement between the County of Weld and the City of Fort Lupton, for the purpose of constructing Weld County Bridge 14.5/25A and Fort Lupton Bridge FTLI4TH-Fulton be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said agreement. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 16th day of December, A.D. , 1991. Webster 911462 CL- • FT, )1“Pl0 ui INTERGOVERNMENTAL AGREEMENT FOR CONSTRUCTION OF WELD COUNTY BRIDGE 14.5/25A AND CITY OF FORT LUPTON BRIDGE FTLI4TH-FULTON THIS AGREEMENT, made and entered into this 4TH day of DECEMBER , 1991, by and between the COUNTY OF WELD, STATE OF COLORADO, hereinafter called "County" , and the CITY OF FORT LUPTON, Colorado, hereinafter called "City" . WHEREAS, the City received a grant from the Special Bridge Fund to replace Bridge FTLI4TH-FULTON in the amount of One Hundred Ten Thousand, Seven Hundred Fourteen Dollars ($110,714) ; and, WHEREAS, the County received a grant from the Special Bridge Fund to replace Bridge 14.5/25A, in the amount of One Million, Sixty-Seven Thousand, Two Hundred Dollars ($1,067,200) ; and, WHEREAS, the bridges are approximately one-quarter mile apart on the same road; and, WHEREAS, straightening the road between the two structures will improve visibility and safety for the traveling public; and, WHEREAS, the cost of engineering and construction can be reduced by combining the two projects. NOW, THEREFORE, in consideration of the mutual covenants and conditions hereinafter set forth, the County and the City mutually agree as follows: 1. The County shall be the lead agency and have jurisdiction over both bridges upon execution of this Agreement, allowing for full authority in contractual agreements during the prosecution of the project. 2. The County shall be responsible for the design, construction, and administration for both bridges. 3. The City shall authorize a person competent in road and bridge engineering and construction to represent the City. The County's representative will be the County Engineer. 4. The County will contract with a consulting engineer for the design of both bridges. Within the consultant's contract, the fee structure will be separated between the two bridges. The County will bill the City for the consulting engineering according to the consultant's contract. 5. The County will bill the City for right-of-way, utility adjustments, and permitting based on what is required within the City limits. 9114b2 Page 2 6. The County will bid all construction to private contractors. The work will be bid on the basis of unit prices and the City will be billed according to the unit prices for the work within the City limits. 7. The County will bill the City, at its direct cost, for engineering, construction management, and inspection. The costs shall be pro-rated based on the construction costs within each jurisdiction. 8. The City will reimburse the County in full within thirty (30) days of receipt of billings. 9. The City shall be responsible for all reimbursements and communications with the Colorado Municipal League regarding the Special Bridge Fund Grant. 10. The County will be responsible for all reimbursements and communications with Colorado Counties, Inc. regarding the Special Bridge Fund Grant. 11. The County and the City will inspect and maintain the new bridges that are within their jurisdiction subsequent to construction, and include them in any required bridge inventory. 12. If the City annexes Weld County Bridge 14.5/25A, the City assumes responsibility for maintenance, inspection, and inventory.
