HomeMy WebLinkAbout901267.tiff RESOLUTION RE: APPROVE AMENDMENT TO AGREEMENT WITH PREFERRED CORRECTIONAL MEDICAL TEAM, INC. , AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board has been presented with an Amendment to the Agreement with Preferred Correctional Medical Team, Inc. , and WHEREAS , the terms and conditions of said Amendment are as stated in the Amendment, a copy being attached hereto and incorporated herein by reference, and WHEREAS, after study and review, the Board deems it advisable to approve said Amendment. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Amendment to the Agreement with Preferred Correctional Medical Team, Inc. , be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is , authorized to sign said Amendment. Lacy 901267 AMENDMENT TO AGREEMENT FOR WELD COUNTY SHERIFF'S OFFICE JAIL MEDICAL UNIT SERVICE THIS AMENDMENT, dated for reference purposes only the 31st day of December, 1990, is made and entered into by and between the Board of County Commissioners of the County of Weld ( "County" ) and Preferred Correctional Medical Team, Inc. ( "Provider" ) . This Amendment is hereby attached to and made a part of that Agreement by and between County and Provider dated September 11, 1988. WITNESSETH: WHEREAS, County and Provider entered into a Medical Unit Service Agreement ( "Agreement" ) dated September 11, 1588; and WHEREAS, pursuant to Paragraph VI of the Agreement, it may be renewed by the County effective each January 1 ; and WHEREAS, pursuant to Paragraph IX of the Agreement, the parties shall renegotiate the payment provision of the Agreement on or before December 31st of each year for the following twelve ( 12) months; and WHEREAS, pursuant to Paragraph XVIII of the Agreement, alterations, variations, modifications or waivers shall be valid only when they have been reduced to writing and signed by the parties to the Agreement; and WHEREAS, the Sheriff of Weld County has indicated that he desires the Agreement renewed and has negotiated the following changes, adjust- ments, and modifications, subject to approval of County Commissioners. NOW, THEREFORE, for and in consideration of the covenants and conditions set forth herein and for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the County and Provider agree to the following. 1. The period of the Agreement is hereby renewed and shall run from January 1, 1991, to and including December 31, 1991. 2. The costs that are to be combined to describe and determine whether the limitation, (paragraph 3. of Amendment dated September 11, 1989) is reached; i. e. , hospitals, emergency rooms, clinics, and outside physicians services; are hereby amended to include, "all the costs of AZT and other medications for the treatment of AIDS" . 3. Provider will not be liable on behalf of County for the costs of medical services or treatments of individual (s) prior to their being booked into County's Jail. (Provider will not be liable for such costs even though the individuals are trans- ported and/or accompanied to the hospital, emergency room, etc. by Sheriff 's Deputies or other County employees. ) -1- 90126 7 4. Provider will provide medical services to pregnant Inmates but medical services provided to an infant following birth will not be the responsibility of Provider. 5. Provider will not be responsible for the provision of elective medical care to Inmates unless ordered by an appropriate court. For purposes of this Agreement, "elective medical care" means medical care which, if not provided, would not in the opinion of Provider 's Medical Director cause the Inmate' s health to deteriorate or cause definite harm to the Inmate's well being. 6. Provider may seek and obtain from any Inmate information concerning any health insurance the Inmate might have that may cover medical services rendered and County will cooperate fully with Provider in its efforts to secure this information. 7. This Agreement may be assigned by Provider or by William H. Boldon to the parent corporation, to a subsidiary corporation, or to a sister corporation of Provider; or to an affiliated corporation that is 100% owned by William H. County understands and agrees that adequate security services are necessary for the safety of Provider' s employees, agents, and subcontractors as well as for the security of County's employees and the Inmates. County will provide security, including on site transport services, sufficient to enable Provider and its employees, agents, and contractor to safely provide the medical services called for hereunder. County further agrees to make available to Provider's personnel self defense training. 9. The monthly payment amount of $24, 165. 00 is hereby adjusted to $26, 000. 00 for the period January 1, 1991, through December. 31, 1991. 10. The Agreement, as amended hereby, shall remain in full force and effect. The increase in medical costs over the 1990 year is 13% according to the recent material that has been published. Medical costs, according to the Consumer Price Index, have risen 20% since September of 1988. Preferred Correctional Medical Team is requesting a 7.6% increase over last year, which is significantly below the rate shown by the Consumer Price Index for medical health services. Shelton: As you have requested, we are herewith submitting our Amendment which includes, among other things, a compen- sation increase for 1991 of less than eight (8% ) percent. At the National Commission, on Correctional Health Care conference that we attended last September, I heard it stated in several of the seminars that the average cost for medical services per inmate was $2, 500. 00 in 1989. With our price increase, Weld County's cost per inmate will be approximately $1, 565. 00 in 1991. The Consumer Price Index for Health Services Medical Care Component has increased over twenty (20%) percent since September 11, 1988, the date of our original contract with Weld County, through 1990. We are pleased that through 1990 our compensation increase to you has been only five (5%) percent. We understand that your Facility will increase the number of U. A. Drug Screens to forty-five (45) in 1991. With this increase in volume, your fee per test will remain at $15. 00 for 1991.
