AND TINA J. BOGOTT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 10th day of March, 1993, at 10:00 a.m. for the purpose of hearing the application of Weld County Board of County Commissioners/Gary L. and Tina J. Bogott, 915 10th Street, Greeley, Colorado 80631, requesting a Change of Zone from R-1 (Low Density Residential) to A (Agricultural) for a parcel of land located on the following described real estate, to-wit: Part of the NW* of Section 31, Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS, the applicant, Tina Bogott, was present, and WHEREAS, Section 21.6.2 of the Weld County Zoning Ordinance provides standards for review of such a Change of Zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The applicant has complied with all the application requirements listed in Section 21.7 et seq. , of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 21.6 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan Urban Growth Boundary Goals and Policies. The City of Longmont staff has reviewed this proposal and expressed no objections to the request. b. The uses which would be allowed on the property by granting the Change of Zone request will be compatible with the surrounding land uses which include rural residences, agricultural production, Union Reservoir and the Longmont Nature Area. Weld County Road 1, which provides access to the property, is of adequate size to meet the requirements of the proposed zone district. e. The portion of the property immediately adjacent to Union Reservoir is in the 100-year floodplain. No other overlay districts affect the site. A note on the Change of Zone plat will address compliance with overlay district requirements. f. No known commercial mineral deposits are located on the site. g. The moderate or severe soil limitations on the site can be overcome with engineered designs and the limitations will be addressed prior to development of the property. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Weld County Board of County Commissioners/Gary L. and Tina J. Bogott for a Change of Zone from R-1 (Low Density Residential) to A (Agricultural) on the above referenced parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to recording, the following notes shall be placed on the Change of Zone plat: a. A Flood Hazard Development Permit will be required for any new construction or the substantial improvement of existing structures in the Floodway or Floodprone Districts located on the property. b. Prior to any construction or any other activity which would affect the wetlands at this site, the wetlands must be delineated and mapped. The property shall be maintained in compliance with the requirements of the Department of the Army, Corps of Engineers. c. Moderate and severe soil limitations exist at this site for septic tank absorption fields, shallow excavations, and dwellings with and without basements. Engineered designs may be required. Bogott for a Change of Zone from R-1 (Low Density Residential) to A (Agricultural) . Bruce Barker, Assistant County Attorney, made this a matter of record. Lanell Adler, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Tina Bogott, applicant, stated they purchased 87 acres, of which the northern 20 acres is zoned R-1. Ms. Bogott explained the zoning is faulty, and agricultural zoning would be better for their purpose. In response to a question from Commissioner Kirkmeyer, Ms. Bogott said they raise cattle. Ms. Bogott confirmed they own most of the property south and west of the lake. Ms. Adler explained the Board initiated this change, and the Bogott's have paid no fees under the direction of the Board. Commissioner Baxter questioned why it was zoned R-1 from the beginning. Ms. Bogott said in 1963 the zoning was estate and then changed to R-1. Ms. Adler said the County was petitioned by the owners, in the 1960's, to change all estate zoning to R-1. There was no public testimony offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of Weld County Board of County Commissioners/Gary L. and Tina J. Bogott for a Change of Zone from R-1 (Low Density Residential) to A (Agricultural) , based on the recommendations of the Planning staff and the Planning Commission, with the Condition of Approval as entered into the record. The motion was seconded by Commissioner Baxter, and it carried unanimously. Lanell Adler explained the Bogott' s want to divide the land but the R-1 zoning will not allow this. The zoning in this area is faulty and needs to be corrected. The Chairperson asked if the applicant agreed with the Department of Planning Services' recommendation. Tina Bogott said yes. The Chairperson asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. The proposed rezoning will correct faulty zoning. This property was zoned from A (Agricultural ) to E (Estate) in 1963. In 1981, when the County was redistricted, all of the Estate zoned properties were changed to R-1 (Low Density Residential ) . The 1963 zone change took the north 700 feet of a parcel , zoned it to Estate, and left the remainder of the property zoned Agricultural . The entire property has historically been used for agricultural purposes. The uses allowed by the proposed rezoning will be compatible with the surrounding land uses which include rural residences, Union Reservoir, agricultural production, and the Longmont nature area. The property is currently served by the Longs Peak Water District. However, the District has no additional capacity and taps are not available. The property owners would use a domestic well on the property if an additional water source was needed. Septic systems provide sewage disposal . A soil survey and study of the site proposed for the change of zone is attached. The soils survey and study indicates the presence of soils with moderate or severe limitations for the construction of dwellings and for septic tank absorption fields. If new dwellings or septic systems were proposed, special attention would be required in the construction of the structures or systems. Septic systems and foundations would require design by a Registered Professional Engineer. Road facilities providing access to the property are adequate to meet the requirements of the proposed zone district. Access to the property is from Weld County Road 1, a paved County arterial . According to information available to Weld County, there do not appear to be mineral resources under the subject property.
