HomeMy WebLinkAbout931044.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1540 - LUNDVALL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1540, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1540 was submitted by Elmer E. Lundvall, for property which is located in part of the NEI of Section 19, Township 5 North, Range 66 West of the 6th Y.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 140 acres and 5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that the applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11. 7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. A Weld County septic permit is required for the proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. An ISDS evaluation on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. 3. The plat shall show a 50-foot right-of-way reservation to the west of the centerline of Weld County Road 27 (83rd Avenue) . Exemption 1540. Dear Commissioners : This request is for a recorded exemption for Elmer E. Lundvall. The parcel of land for which this request is being made is described as the NE4 of Section 19, T5N, R66W of the 6th P.M. , Weld County, Colorado. The property is also known as Lot B of Recorded Exemption 867 (July 1986) . The property is located on 83rd Avenue approximately 1/2 mile north of Weld County Road 54. This parcel is located within the Urban Growth Boundary of the City of Greeley. This request is to further divide the property into parcels of 140 acres, more or less and 5 acres, more or less . The applicant wishes to retain the larger portion for farm production and use the smaller portion as a residential site for a direct family member. Both lots will have access and frontage onto Weld County Road 27 (83rd Avenue) . The applicant has demonstrated that the proposal is consistent with the Agricultural zone district in that the proposed 5 acre parcel is that portion of the southeast corner, which is not irrigated by the sprinkler pivot; therefore valuable farmland will not be diminished. The proposal is consistent with the intent of the recorded exemption policies as stated in the Comprehensive Plan. This application enables the property owner to provide a residence for a direct farm family member. This proposal is consistent with efficient and orderly development. The City of Greeley Planning Department has reviewed this proposal and recommended approval. It is the opinion of the Department of Planning Services' staff that the granting of this request is in compliance with Sections 11. 5.1 through 11. 5.6 of the Weld County Subdivision Ordinance. Would like to divide the property so that a residential plot of land may be given to son for his personal residence . 2. The quarter section is located in the NE4 of Sec . 19-T5N-R66W of 6th PM, Weld County , CO (appr . 1 mile southwest of Greeley city limits) and contains appr . 145 ac . Use is currently agricultural . Proposed residence would be located on 83rd Ave . about 1/2 mile north of WCR 54 . 3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted municipal plan, if applicable. It is consistent in that a very small portion of the quarter ( that portion which is not covered by a pivot sprinkler system) will be used for residential and the large area will remain productive farmland . 4. Explain how the uses permitted will be compatible with existing uses surrounding the proposed recorded exemption. The existing area surrounding the property is agricultural with personal residences mixed in . 5. Explain how the proposal is consistent with the intent of the zoning district it is located within. Zoning is agricultural - no change. 6. Explain how the proposal is consistent with efficient and orderly development. No change in usage is contemplated and the proposed uses are fully compatible with existing surrounding land uses . It is quite compatible with future development in the area . 7. Explain how adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and the County will be accomplished.
