RE: APPROVE AGREEMENT WITH BOB NOFFSINGER FOR USE OF CERTAIN
PROPERTY AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board has been presented with an Agreement with
Bob Noffsinger for the Sheriff ' s Department to use an abandoned
building located at 30886 Weld County Road 47 , Greeley, Colorado,
for training, and
WHEREAS, the initial term of said Agreement is from February
6, 1990 , through February 6 , 1991 , with the further terms and
conditions being as stated in the Agreement, a copy of which is
attached hereto and incorporated herein by reference, and
WHEREAS, after study and review, the Board deems it advisable
to approve said Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Agreement with
Bob Noffsinger for use of the abovementioned property by the
Sheriff' s Department be , and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and
hereby is, authorized to sign said Agreement.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 12th day of
February, A.D. , 1990 .

AGREEMENT

THIS AGREEMENT, made and entered into this day of
, 1990, by and between THE COUNTY OF WELD, by and
through /the Weld County Board of County Commissioners, hereinafter
referred to as "County" , and BOB NOFFSINGER, by and through his
property manager, Larry Wagner, 30740 Weld County Road 47 ,
Greeley, Colorado, hereinafter referred to as "Owner" .
WHEREAS , County desires to use an abandoned building for use
by Weld County Sheriff' s Deputies, Reserve Officers, and Posse
Members for survival and "paint gun" training, and
WHEREAS, Owner is the current owner of an abandoned building
located at 30886 Weld County Road 47 , Greeley, Colorado, and
WHEREAS, both parties agree that said building is well suited
for such training, and
WHEREAS, this Agreement is authorized by Section 30-11-107 ,
C.R.S. , as amended, and by Section 3-8 of the Weld County Home
Rule Charter.
NOW, THEREFORE, in consideration of the mutual promises and
covenants contained herein, the parties hereto agree as follows :
1 . That County shall use the building located at 30886 Weld
County Road 47 , Greeley, Colorado, for survival and "paint gun"
training of Weld County Sheriff ' s Deputies, Reserve Officers, and
Posse Members. County shall use the property for an unlimited
number of times during the term of this Agreement; however, County
shall notify Owner of the dates of use at least twenty-four (24)
hours prior to said dates.
2 . The term of this Agreement shall be for one (1) year
from the date of signing of this Agreement. This Agreement may be
terminated by either party at any time providing that the party
seeking to terminate the Agreement provides the other party with
ten (10) days written notice. This Agreement shall automatically
renew for another one (1) year period at the end of each term
until written notice is given by either part to the other to
terminate or change this Agreement.
3 . The County' s use of said building shall be without cost
to said County.
4 . County shall at all times maintain adequate workman' s
compensation, pursuant to Colorado law, covering all persons
participating in said survival and "paint gun" training.

5. The County shall, at the end of each training session,
leave said building in substantially the same condition it is in
at present, with the exception of damage reasonably incurred in
the course of said survival and "paint gun" training. Said
reasonable damage may include, but is not limited to, the
following: breakage of windows, holes in walls, holes in doors,
and paint splashed on walls , doors, and floors. County shall
refrain from using explosives or fire in the course of such
training.
IN WITNESS WHEREOF, County and Owner have caused this
Agreement to be signed, notarized, and attested to, all on the day
and year first above written.
