HomeMy WebLinkAbout940243.tiff RESOLUTION RE: APPROVAL OF AMENDED RECORDED EXEMPTION #1373 - LARSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Amended Recorded Exemption #1373, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Amended Recorded Exemption #1373 was submitted by Ivar and Donna Larson, 925 North County Line Road, Route 1, Berthoud, Colorado 80513, for property which is described as Lot B of RE #1373, located in the El of Section 14, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to amend a 190-acre parcel of land by reducing its size to approximately 86.92 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Amended Recorded Exemption #1373 submitted by Ivar and Donna Larson be, and hereby is, approved conditional upon the following: 1. A Weld County Septic Permit is required for the proposed home septic system. The system shall be installed according to the Weld County Individual Sewage Disposal System regulations. 2. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. Dear Commissioners: This request for a recorded exemption is submitted by Ivar and Donna Larson. The parcel of land is described as Lot B of RE-1373, located in the E2 of Section 14, T4N, R68W. This property is located south of Weld County Road 78 approximately 3/4 miles east of I-25 and approximately 2-1/2 miles southwest of the municipal limits of Johnstown. This parcel is located within Johnstown's Urban Growth Boundary Area, and is the contiguous land ownership of the applicant. The Department of Planning Services recommends that the Board of County Commissioners deny this request to amend a 190 acre parcel of land by reducing its size to 86.92 acres, more or less. This property has already been the subject of three previous recorded exemptions (RE-341; RE-1OO6; and RE-1373) . This parcel of ground is currently the proposed site for two minor subdivision applications. Approval of this recorded exemption lays the foundation for the creation of twelve buildable sites on this parcel. This parcel is located both within the Agricultural zone district and within an Urban Growth Boundary area, as such, is considered under both criteria contained in the Comprehensive Plan. Agricultural Zone Proposing to split this 190 acre parcel into 12 buildable sites does not enhance or encourage the agricultural industry of the County. In fact, this application will allow more people to reside in this area, thus creating the possibility for more conflict with surrounding farms and existing agricultural uses. The Department of Planning Services has received several letters from surrounding neighbors in opposition to the Minor Subdivision requests even though notification to surrounding property owners on the Amended Recorded Exemption is not required. 940243 • • RECOMMENDATION, Amended RE-1373 Ivar and Donna Larson Page 2 The Comprehensive Plan does allow low density residential development to occur on non-prime agricultural land as recognized by the Soil Conservation Service. Based on the Soil Conservation Service this ground is classified as prime agricultural land, and is highly suitable for agricultural production. There are four soil types located on this site three of which are identified as prime farmland if irrigated with adequate water. Two of these soils, Nunn Clay Loam 1-3% slope, and Weld Loam 3-5% slope are considered to have high potential for dry crop land as well. These soils have been further classified as farmlands of statewide importance (U.S. Department of Agriculture Soil Conservation Service; September 7, 1993) . It is not the policy of the Comprehensive Plan to allow these farmlands to be converted into urban uses. Urban Growth Boundary Even the Urban Development section of the Comprehensive Plan addresses the preservation of prime agricultural land by considering its beneficial relationship to the entire County and region. Despite being geographically located in an Urban Growth area this 190 acre parcel is both functionally and logistically an agricultural parcel. The Urban Growth boundaries are in place to promote harmonious and mutually beneficial use of land. The Comprehensive Plan recognizes agricultural production within an Urban Growth Boundary Area to have a mutually beneficial use for the County as a whole. According to the criteria for compatible uses in the Comprehensive Plan and in order for an application to be approved, the proposed use within the Urban Growth Boundary needs to be compatible with other urban-type uses. With the absence of any urban type uses adjacent to this site all of the criterion for recommending a proposal in an urban growth area have not been satisfied; therefore the basis for recommending this application as an urban use has not been satisfied. The Department of Planning Services has shown that this request is not compatible with the Agricultural zone district it is located in, nor does this request meet the established criterion for an Urban Growth Boundary Area use. The Department of Planning Services recommends that the Board of County Commissioners determine if this applicant also adheres to the three recorded exemption policies as stated in the Comprehensive Plan. We would like to voice our objection to this proposal . We feel that this proposed subdivision, and subsequent potential subdivisions, would affect us in the following ways : 1 . We moved to an agricultural area for an agrarian life- style with the intention of raising livestock . The quietness and absence of urban noise and pollution was a major factor in our purchasing this particular parcel of land as the surrounding land was being used for agricultural purposes . Our quality of life would be impacted . 2 . We raise beef cattle and have horses . There is a potential for curious or mischievous children to bother our stock, and since we have a bull and stallion , a potential of harm to those children . We would have a constant worry for our livestock and potential trespassers . 3 . Increased population will create increased traffic on Road 46 creating greater dust problems than already exist . The increased dust would create aesthetic as well as health problems . 4 . Our view to the west is a lovely mountainous vista which could be blocked by a future housing development . 5 . One subdivision could lead to further subdivisions and possible zoning changes which could become a pervasive element in the existing agrarian environment . 6 . Recently there was an article in the Greeley Tribune which stated that "Weld County" was becoming concerned about the increasing number of residential subdivisions on non- developed land which require costly infrastructure projects such as sewer systems . In a time of severe budget 940243 . - • • constraints we believe that development and expansion should be adjacent to existing developments where the existing infrastructure can be tapped into , thus limiting the need for tax increases .
