BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
January 28, 1991

The Board of County Commissioners of Weld County, Colorado, met
in regular session in full conformity with the law and bylaws of
said Board at the regular place of meeting in the Weld County
Centennial Center, Greeley, Colorado, January 28, 1991, at the
hour of 9:00 A.M.
ROLL CALL: The meeting was called to order by the Chairman and on roll call
the following members were present, constituting a quorum of the
members thereof:
Commissioner Gordon E. Lacy, Chairman
Commissioner George Kennedy, Pro-Tem - Excused
Commissioner Constance L. Harbert - Excused
Commissioner C. W. Kirby
Commissioner W. H. Webster
Also present:
Weld County Attorney, Thomas O. David
Acting Clerk to the Board, Carol Harding
Finance and Administration Director, Don Warden
MINUTES: Commissioner Kirby moved to approve the minutes of the Board of
County Commissioners meeting of January 23, 1991, as printed.
Commissioner Webster seconded the motion, and it carried
unanimously.
CERTIFICATIONS
OF HEARINGS: Commissioner Kirby moved to approve the Certifications for the
hearings conducted on January 23, 1991, as follows: 1)
Community Development Block Grant Application, Centennial
Development Services; 2) Show Cause Hearing, Baumgartner; 3)
Special Review Permit, Asphalt Paving Company; 4) Special Review
Permit, Consolidated Freightways. Commissioner Webster seconded
the motion, and it carried unanimously.
ADDITIONS: There were no additions to today's agenda.
CONSENT AGENDA: Commissioner Kirby moved to approve the consent agenda as
printed. Commissioner Webster seconded the motion, and it
carried unanimously.
PRESENTATIONS: Chairman Lacy read the plaque presented to Greg Thompson for his
service on the Local Emergency Planning Committee.

COORDINATOR
REPORTS: Chairman Lacy reported on his presentation to the La Plata
County Charter Commission in Durango last week concerning Home
Rule.

WARRANTS: Don Warden presented the following warrants for approval by the
Board:
General fund $197, 172.97

Commissioner Webster moved to approve the warrants as presented
by Mr. Warden. Commissioner Kirby seconded the motion which
carried unanimously.
Let the record reflect that a recess was taken at this time to
allow the Board to convene as the Board of Social Services.
BUSINESS:
NEW: CONSIDER CONTRACTS FOR THE 1991 AIR QUALITY CONTROL PROGRAM
BETWEEN THE WELD COUNTY HEALTH DEPARTMENT AND THE COLORADO
DEPARTMENT OF HEALTH AND AUTHORIZE CHAIRMAN TO SIGN: Jeannie
Tacker, Weld County Health Department representative, explained
this grant in the amount of $21,880.00 for Air Quality Control.
The term of the Contract is from January 1, 1991 through
December 31, 1991. Commissioner Webster moved to approve said
Contracts. Commissioner Harbert seconded the motion which
carried unanimously.
CONSIDER CONTRACT BETWEEN THE PARENT/CHILD LEARNING CENTER AND
WELD COUNTY HEALTH DEPARTMENT AND AUTHORIZE CHAIRMAN TO SIGN:
Ms. Tacker explained that this contract is at the rate of
$25/hour for consultant services. It is for the period January
1, 1991 through December 31, 1991. Commissioner Harbert moved
to approve said Contract. Commissioner Kirby seconded the
motion, which carried unanimously.
CONSIDER CONTRACT FOR ACCESS TO BIRTH CERTIFICATE ISSUANCE
SYSTEM BETWEEN WELD COUNTY HEALTH DEPARTMENT AND THE COLORADO
DEPARTMENT OF HEALTH AND AUTHORIZE CHAIRMAN TO SIGN: Ms. Tacker
explained that this Contract is for the computer tie-in to the
State Birth Certificate System, previously discussed during the
1991 budget process. Commissioner Webster moved to approve said
Contract. Commissioner Harbert seconded the motion, which
carried unanimously.
CONSIDER LEASE AGREEMENT BETWEEN ASSOCIATED NATURAL GAS, INC.
AND WELD COUNTY - SW/4 OF SECTION 31, T1N, R67W AND AUTHORIZE
CHAIRMAN TO SIGN: Bruce Barker, Assistant County Attorney,
explained that this lease concerns a piece of property on the
northwest corner of the intersection at Weld County Road 2 and
13. Associated Natural Gas, Inc. needs to place a gate valve on
the property. The lease is for 10 years at $756. In addition,
Associated will maintain the entire 6.92 acre track.
Commissioner Kirby moved to approve said Lease Agreement.
Commissioner Harbert seconded the motion, which carried
unanimously.
CONSIDER REQUEST TO WAIVE PLOWING PERMIT REGULATIONS SPECIFIED
BY ORDINANCES 108-A AND 142 - GERALD STRAIGHT: This item was
incorrectly listed under new business, and should be moved to
communications.
CONSIDER FOUR OIL AND GAS DIVISION ORDERS TO ASSOCIATED TRADING
AND TRANSPORT, INC. , AND AUTHORIZE CHAIRMAN TO SIGN - S/2 SE/4
518, T2N, R66W; S/2 SE/4 518, T2N, R66W; NW/4 SW/4 518, T2N,
R66W; AND S/2 513, T2N, R67W: Tom David stated that his staff
has reviewed said Division Orders and finds them to be in order.
Commissioner Kirby moved to approve Division Orders.
Commissioner Webster seconded the motion, which carried
unanimously.
CONSIDER AGREEMENT FOR WATER BETWEEN WELD COUNTY AND DEAN AND
BETTY BIVENS AND AUTHORIZE CHAIRMAN TO SIGN: Mr. Barker
explained that this has to do with the Keota abandonment, and
our grader shed in Keota. By this Agreement we will provide
water for 25 years and Mr. Bivens will maintain the pump and the
well. Commissioner Kirby moved to approve said Agreement.
Commissioner Harbert seconded the motion, which carried
unanimously.

CONSIDER RESOLUTION RE: RELEASE OF PROPERTY DAMAGE CLAIMS TO
LEONARD K. LARKIN AND RUTH LARKIN AND AMERICAN FAMILY INSURANCE
COMPANY AND AUTHORIZE CHAIRMAN TO SIGN: Mr. Warden explained
that this is in regard to an ambulance damaged in a traffic
accident. This settlement has been presented to the Board for
repair to the vehicle. Commissioner Kirby moved to accept said
settlement and authorize Chairman to sign release. Commissioner
Webster seconded the motion, which carried unanimously.
CONSIDER RESOLUTION RE: TEMPORARY CLOSURE OF WELD COUNTY ROAD 42
BETWEEN WELD COUNTY ROAD 35 AND 37: Commissioner Kirby moved to
approve closure of Weld County Road 42. Commissioner Harbert
seconded the motion, which carried unanimously.
CONSIDER FINAL READING OF ORDINANCE N0. 163, IN THE MATTER OF
PROHIBITING LITTERING OF PUBLIC AND PRIVATE PROPERTY, AND
PROVIDING FINES AND PENALTIES FOR VIOLATIONS THEREOF:
Commissioner Webster moved to read by title only. Commissioner
Harbert seconded, and the motion carried unanimously. Mr. David
read the title of Ordinance No. 163. There were no public
comments. Commissioner Kirby moved to approve Ordinance No. 163
on final reading. Commissioner Harbert seconded, and the motion
carried unanimously.
PLANNING: CONSIDER RESOLUTION RE: VIOLATIONS OF THE ZONING ORDINANCE -
DEMING, HART, PERKINS, MOORE, MARTINEZ: Commissioner Kirby
moved to approve this Resolution authorizing the County Attorney
to proceed with legal action against Deming, Hart, Perkins,
Moore, Martinez for violations of the Weld County Zoning
Ordinance. Commissioner Harbert seconded the motion, and it
carried unanimously.
RESOLUTIONS AND
ORDINANCES: The Resolutions were presented and signed as listed on the
consent agenda. Ordinance No. 163 was approved on final
reading.
Let the minutes reflect that the above and foregoing actions
were attested to and respectfully submitted by the Acting Clerk
to the Board.
There being no further business, this meeting was adjourned at
9:30 A.M.

Weld County Road 105 between Weld County Roads 90 and 104
Graveled approximately 61.00 miles to date - 17% of 350 mile goal.
Hauled 11,250.00 tons of gravel.
MINING

One dozer is working at the Hall Pit.
One dozer is working at the Giesert Pit.
One dozer is working at the Pierce Pit.
One dozer is working at the Bashor Pit.
Two scrapers are working at the Hall Pit.
The cone rock crusher is working at the Giesert Pit.
The screen is working at the Pierce Pit.

the amount of $41,845.22. Commissioner Kirby moved to approve
the warrants as presented by Mr. Warden. Commissioner Harbert
seconded the motion which carried unanimously.
BUSINESS:
NEW: CONSIDER 1989 COMMUNITY DEVELOPMENT BLOCK GRANT REHABILITATION
PROJECT REPORT AND AUTHORIZE CHAIRMAN TO SIGN: Mr. Warden
explained that this is the standard report required each year
regarding the rehabilitation projects. Commissioner Kirby moved
to authorize Chairman to sign said report. Commissioner Harbert
seconded the motion, which carried unanimously.
Let the minutes reflect that the above and foregoing actions
were attested to and respectfully submitted by the Acting Clerk
to the Board.
