HomeMy WebLinkAbout911080.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING SHOW CAUSE HEARING - JAMES MCDONALD, C/O ADRENALIN ADVENTURES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on September 11, 1991, a Show Cause Hearing was conducted to consider revocation of Special Use Permit 1!537, issued to James McDonald, and WHEREAS, James McDonald is owner and operator of said facility, located on property described as part of the El W? SEa of Section 25, Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, Robert Ray, Attorney representing the applicant, and Mr. McDonald were present, and WHEREAS, the Board heard all of the testimony offered concerning this matter and, having been fully informed, did Find that the burden of proof has been met to show the existence of violations of Operation Standards Ill, 1117, and 1121, regarding the uses permitted by the Special Use Permit, and WHEREAS, pursuant to said Findings, the Board deems it advisable that if Mr. McDonald is not in compliance with said Operation Standards of Special Use Permit #537 by September 18, 1991, said Permit shall be revoked for the following reasons: 1. The present use of the property for bungee jumping from a hot air balloon is not a use allowed by the existing Special Use Permit. 2. The property owner and operator are not complying with all approved Operation Standards. 3. The present uses of the property exceed those allowed. The change in the uses of the property are considered to be a material deviation from the approved plans and an amendment has not been submitted or approved. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Board does hereby Find that James McDonald be, and hereby is, in violation of Special Use Permit 11537. Webster 911080 HEARING CERTIFICATION DOCKET N0. 91-44 & N0. 91-50 RE: SHOW CAUSE HEARING TO CONSIDER REVOCATION OF SPECIAL USE PERMIT 4537 - JAMES MCDONALD A public hearing was conducted on September 11, 1991, at 10:00 A.M. , with the following present: Commissioner Gordon E. Lacy, Chairman Commissioner George Kennedy, Pro-Tem Commissioner Constance L. Harbert Commissioner C. W. Kirby Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice, Docket 491-44, dated June 19, 1991, and a notice, Docket 1191-50, dated August 28, 1991, both being duly published August 29, 1991, in The New News, a public hearing was conducted to consider the revocation of Special Use Permit 11537 issued to James McDonald. Lee Morrison, Assistant County Attorney, made this a matter of record. Robert Ray, Attorney representing the applicant, requested the Board to consider continuing this matter. He explained the Town of Frederick may be annexing the property; and if not annexed, James McDonald would like to submit an application for an amended permit. Mr. Morrison explained the Board could continue, but they may want to hear the Planning staff's comments first. Keith Schuett, Planning Department representative, said the Permit holder is still in violation of several Operation Standards. Mr. Schuett said Operation Standards 112 and 419 have been brought into compliance. He entered a video tape of the site into the record, and commented on the junk vehicles on the property. Mr. Schuett requested the Board allow no more than a 30-day extension and proceed with the hearing today. Mr. Schuett read the staff's comments into the record and requested the Board to revoke said Permit and authorize the County Attorney to proceed with legal action. Mr. Schuett played various parts of the Board of Commissioner's hearing tape from May 29, 1985. Said tape concerned statements made by Mr. McDonald pertaining to the number of vehicles parked on the property. (Change to Tape 491-26 during this time. ) Mr. Schuett said the intent of the uses allowed was clear to Mr. McDonald at that hearing. Chairman Lacy stated the problem with the junk on the property has been on-going. Concerning the antique museum, Mr. Schuett pointed out that there is a difference between automobiles and aircraft. Mr. Schuett commented on the bungee jumping on the property. Commissioner Harbert said she did not see where hot air ballooning was in the existing permit either. Mr. Ray restated his request and reasons for a continuance. He submitted some pictures of the property, taken September 9, 1991, as Exhibit A. Mr. Ray commented on the museum and the surrounding property and answered questions of Mr. Schuett. Ray Killough, representing six surrounding property owners and himself, stated concerns about safety, parking, and noise. Charles Sabados, surrounding property owner, spoke in support of said facility, but agreed they need to come into compliance. Ed Herson, operator of skydiving, and Leslie Grisham spoke on behalf of the facility and answered questions of the Board. Geraldine Russell, Helen Jubenville, and Virginia Brozovick stated their concerns about the noise and safety of the facility. Doug Hase, operator of Adrenalin Adventures, said they have been trying to control the noise of the bungee jumpers as much as possible and answered questions. Dave Smith, surrounding property owner, commented on the noise and answered questions of the Board. Mr. Hase answered 911080 911081 mac. - PL. Page 2 RE: HEARING CERTIFICATION - MCDONALD further questions of the Board. Ms. Russell and Ms. Jubenville made further comments concerning parking on the roads and safety. Mr. McDonald answered questions of the Board and said he would eventually like to have eighty percent of the hangar become museum. Commissioner Harbert stated concerns about junk vehicles, being good neighbors, parking, noise, and trespassing. Commissioner Kirby stated concerns about the screening of the area and the gates being opened in case of an emergency. Mr. McDonald answered questions of the Board and staff regarding their concerns. Commissioner Webster said besides the violations of the Standards, he had concerns about the citizens of the area. Mr. Schuett said the added uses, which had not been reviewed by staff, have made the main impacts on the surrounding property owners. Let the record reflect a recess was taken at this time until 1:30 p.m. Mr. McDonald made further comments on the parking, the bungee jumping, and the museum. After further discussion, Commissioner Kennedy moved to Find Mr. McDonald in violation of Development Standard 1117, which was included in ZCH 1174 as read into the record by Mr. Schuett. Chairman Lacy seconded the motion. Commissioner Harbert said she agrees that the facility is in violation, but would prefer to grant a 30-day extension to allow them to apply for an amended permit. Mr. Morrison explained that the motion was only for Findings, and not to revoke the Permit. The motion carried unanimously. Commissioner Webster moved to Find that Mr. McDonald is in violation of the Development Standards in ZCH 1176, as read into the record by Mr. Schuett. The motion was seconded by Commissioner Kirby. Mr. Schuett clarified that Development Standards 112 and 1119 are in compliance. Commissioner Kirby commented on the problems with the access and parking. The motion carried unanimously. Commissioner Kennedy moved to allow Mr. McDonald 30 days to bring the facility into compliance, in all aspects except bungee jumping. Chairman Lacy questioned whether the bungee jumping was to be included in the amended permit or stopped. After further discussion, Commissioner Harbert seconded the motion. Mr. Morrison clarified that bungee jumping was included in ZCH 1174 or Docket 1191-50. Commissioner Webster commented on the improvements that have been made concerning the weeds and the trash; however, he stated concerns about security and the neighbors. Chairman Lacy said he would vote against the motion and stated his reasons and concerns. Commissioner Harbert questioned whether 30 days was enough time for Mr. McDonald to submit an application for an amended permit. Mr. Morrison said it would take approximately 90 days before it was approved. Commissioner Harbert said she would also vote against the motion because she did not want to make Mr. McDonald get rid of all of his vehicles, but would like him to clean up the area, comply with ZCH 1176, and/or file an application for an amended permit. The motion failed on a vote of one to four, with Commissioner Kennedy voting aye. In response to a question from Commissioner Kirby, Mr. Schuett said he understood the preliminary work for an amended permit was done, and it could be submitted within 30 days to the Planning Commission. It would then be heard by the Board of County Commissioners within 30 to 45 days; therefore, approximately 90 days would be sufficient, unless the FAA becomes involved. Commissioner Kirby said he feels Mr. McDonald needs time to make a decision on annexing, complying, and/or submitting an application. Commissioner Kirby moved to continue said matter for 45 days to allow Mr. McDonald time to comply. Mr. Morrison stated that if not in compliance, revocation would then be permitted. Commissioner Webster seconded the motion, which carried unanimously. There was further discussion between staff and the Board concerning ZCH 1174, pertaining to the bungee jumping. Commissioner Kennedy moved to cease the bungee jumping activities. He said the language is out of control for this activity and a permit needs to be obtained so it is controlled. 911080 911081 Page 3 RE: HEARING CERTIFICATION - MCDONALD Let the record reflect that Bruce Barker, Assistant County Attorney, is now the attorney of record. After discussion with Mr. Barker, it was decided the request to allow bungee jumping could be filed with the amendment to the existing Permit. Let the record reflect that Mr. Morrison is now the attorney of record. After discussion with Mr. Morrison, Commissioner Kennedy amended the motion to allow seven days, until September 18, 1991, for the bungee jumping to cease or the Permit shall be revoked. Commissioner Kirby seconded the motion. In response to Commissioner Webster, Mr. Schuett stated that if the Permit is revoked, Mr. McDonald will have to wait 45 to 90 days for a new permit to be approved. The motion carried unanimously. A quorum was present. The summary of the last regular meeting of the Weld County Planning Commission held on April 19, 1985, were approved as distributed following a correction on Page 7, Paragraph 5, Line 14--Changing the word precident to precedent. CASE NUMBER: S-245:85:2 APPLICANT: Twombly Ranch REQUEST: Final Planned Unit Development Plan LEGAL DESCRIPTION: Section 7, TIN, R64W of the 6th P.M. , Weld County, Colorado. LOCATION: Approximately 2 miles east of Hudson; south of State Highway 52 & east of Weld County Road 49. APPEARANCE: James Erker represented the applicants. This is a full section of land which will be divided into thirteen lots. This will be a ranchette type subdivision. There is subirrigated pasture with each lot. The Utility Board requested a fifteen foot perimeter utility easement and this has been put on the plat. The easement will be in the name of the Homeowner's Association. The blue shaded area, Lots one through eight, are in a flood plain area. !�.K 030 Summary of the Weld County Planning Commission Meeting May 7, 1985 Page 2 Lee Morrison reported the Planning Commission will have to look at this as it is presented along with the applicant's ability to conform with the performance standards. Rod Allison read Section 35.3 of the Weld County Zoning Ordinance relating to Performance Standards. Jerry McRae, P.E. , McRae and Short, Inc. , reported on the studies he had done on this Planned Unit Development and recommendations for building sites that will be within the flood plain. The Chairman called for discussion from the audience. Neil Peters, Attorney, Amoco, reported it is there understanding oil and gas production will be allowed within this subdivision. Tape 201 - Side 2 Rod Allison reported that oil and gas production was a use by right in the subject Planned Unit Development area. The Chairman asked Mr. Erker if he had reviewed the recommendations and conditions as outlined by the Department of Planning Services staff. He stated he had, and has no objections to anything outlined. The Chairman asked that reading of the recommendations and conditions, as outlined by the Department of Planning Services staff, be dispensed with and that they be filed with the summary as a permanent record of these proceedings. Rod Allison agreed as long as everyone was aware that this request is for a final Planned Unit Development Plan for residential (R-1) and agricultural uses. This was not spelled out clearly on the request. MOTION: Jack Holman moved Case Number S-245:85:2 for the Twombly Ranch be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval based upon the testimony heard by the Planning Commission and the recommendations and conditions as outlined by the Department of Planning Services staff. Gloria Dunn explained that the applicant is wanting to change the number of planes permanently based there from twelve to twenty-five; the structures on the property are now clearly defined; increase the accesses to the west to five, to allow the five property owners to the west private access from their property; change the hours of operation from sunup to sunset; and to repair aircraft commercially. APPEARANCE: James M. McDonald, applicant and property owner, reported the airport has been in existence for many years, but he obtained a Special Use Permit to operate the airport in 1968. The runway is quite short and therefore, limits the size of planes that can use it. Rod Allison reported the staff has received only one objection to this proposal. The use of the airport has been expanded and this is an attempt to bring what is actually going on there into conformance with the standards as outlined by the staff. They yell and scream starting at sun up. They normally jump Thursday thru Sunday but I have seen and heard them several times Monday thru Wednesday. On weekends they continue well into the morning to where if you want any peace you can't even go outside. The owners of the property have been told of this and nothing has been done. The Sheriff's Department has been called and they will not respond saying they can do nothing about the noise. The town of Frederick refuses to maintain their part of the road that the bungee jumpers tear up and Weld County and the Governor's office will do nothing to force Frederick into doing so. So we end up tearing up our vehicles because we have to use the road 7 days a week where they use it once. There is also a dust problem on the road which they contribute to greatly, not to mention the speed at which they travel. There is no control on what goes on out there much less any safety regulations. The feature on the Parachute School that 9 Wants to Know is a good example of this. A pilot without a licence flying aerobatics in an aircraft that is not certified is a big question to the safety of the people living there. It is not a question if he is going to crash, it's who's house is he going to crash into? This place has no respect for the privacy or the safety of the people living around it.
