HomeMy WebLinkAbout910056.tiff RESOLUTION RE: APPROVE COMMUNITY CORRECTIONS BOARD AGREEMENT AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement between the Community Corrections Board and Weld County regarding staffing and space requirements, with the further terms and conditions being as stated in said Agreement, and WHEREAS, after review, the Board deems it advisable to approve said Agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Community Corrections Agreement be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said Agreement. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 16th day of January, A.D. , 1991. Webs£e 1/46104671--Q 910056 1. 1t0 (1T ti,,r, ,.,a AGREEMENT THIS AGREEMENT, made and entered into this ja day of 19 4 / , by and between THE COUNTY OF WELD, ATE O COLORADO, by and through the Board of County Commissi ners of Weld County, 915 Tenth Street, Greeley, Colorado 80631 , hereinafter referred to as "County" , and THE WELD COUNTY COMMUNITY CORRECTIONS BOARD, with current offices located at The Villa at Greeley, 1750 Sixth Avenue, Greeley, Colorado 80631, hereinafter referred to as "Community Corrections Board. " WITNESSETH: WHEREAS, Community Corrections Board has the obligation of making certain parole decisions pursuant to Section 17-22.5-303 .5, C.R.S. , and WHEREAS, the Community Corrections Board is in need of employing a person to perform various office tasks in order to facilitate the Board' s accomplishment of these duties, and WHEREAS, the Community Corrections Board is also in need of office space for said employee, and WHEREAS, County currently has certain office space available for use by Community Corrections Board, and can provide necessary payroll services and other employment facilitation and advice to Community Corrections Board. NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, the parties hereto agree as follows: 1 . Term: This Agreement shall be in effect from January 1, 1991 , to and until December 31, 1991 . This Agreement may be renewed automatically on a yearly basis, unless sooner terminated by and through the termination provision set forth in paragraph 5. , below. 910056 2. County Agrees To: a. Provide office space for Community Corrections Board. b. Provide payroll services for Community Corrections Board' s employee (s) . c. Provide a copy of the Weld County Personnel Policy Handbook which contains those personnel policies set forth in Weld County Ordinance 118, as amended, to each employee employed by Community Corrections Board. The policies set forth in said Handbook shall govern the employment relationship between Community Corrections Board and its employee (s) , except that said employees shall be considered to be employed "at will" and the section entitled "Conduct, Disciplinary Action, and Grievance Procedures" and any portions of the Handbook referring to "Retirement" shall not apply to said employees. The use of Weld County' s Personnel Policy Handbook, Weld County Ordinance No. 118 , as amended, by Community Corrections Board to govern its employment relationship with its employee (s) shall not be construed as a contract of employment between Community Corrections Board and its employees, or between Weld County and Community Corrections Board employees. 3 . Community Corrections Board Agrees To: a. Reimburse County for all out-of-pocket expenses associated with the operation of Community Corrections Board office and which must be paid by Weld County. Such costs include, but are not limited to, telephone and copies. b. Pay to County the sum of $50.00 per month as rent for the office space. c. Community Corrections Board shall be billed monthly for said out-of-pocket expenses and rent, and shall pay said bills within five (5) days of receipt. c- 4. No Third Party Beneficiaries: Neither party to this Agreement intends to benefit any third persons by entering into this Agreement. Community Corrections Board employee (s) shall not be considered to be third party beneficiaries of this Agreement. 5 .
