HomeMy WebLinkAbout940837.tiff RESOLUTION RE: APPROVE QUESTION FOR QUALIFIED ELECTORS WHETHER OR NOT TO INCREASE 1995 REVENUE IN THE SUM OF $708,235.00 FROM THE 1995 PROPERTY TAX LIMITATION, PURSUANT TO ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the 1994 property tax base for Weld County, pursuant to Article X, Section 20 of the Colorado Constitution ("TABOR") , is $24,962,563.00, using a mill levy for 1994 of 22.457, and WHEREAS, pursuant to TABOR, the 1994 base is allowed to increase 109.54 percent for 1995, totalling $27,343,991.00, and WHEREAS, from said amount should be subtracted the dollars saved by the turn back of the Weld County Department of Social Services, equalling $970,328.00, and WHEREAS, to said amount should be added abatements of $103, 784.00 and the estimated S.B. 94-182 incentive payments of $919,681.00, for a total 1995 property tax limit of $27,397, 128.00 under the restrictions of TABOR, and WHEREAS, the assessed value for 1995 has been certified by the Weld County Assessor to be $1,244,261, 980.00, and WHEREAS, in order to comply with the TABOR 1995 property tax limit for Weld County, it will be necessary to reduce the mill levy for 1995 to 22.018, and WHEREAS, pursuant to Section 14-7 of the Weld County Home Rule Charter ("Charter") , Weld County is under a five percent (5%) annual growth limitation, and WHEREAS, using the 1994 tax base for the 5% Charter limitation of $24, 962,563.00, and multiplying this figure by 1.05%, the 1995 Charter growth sum is $26,210, 691.00, and WHEREAS, adding to the growth amount the sum of the abatements amount of $103, 784.00 and the S.B. 94-182 incentive payments/credits of $919,681.00, the total 1995 Charter tax limit is $27,234, 156.00, and WHEREAS, in order to comply with the Charter 5% growth limitation and with TABOR, it will be necessary to reduce the 1995 mill levy to 21.887, and WHEREAS, pursuant to TABOR and the Home Rule Charter, the Board of County Commissioners may submit to the qualified electors of Weld County the question of whether or not to retain the 1994 mill levy of 22.457 and thereby increase revenue above the 1995 TABOR and Charter 5% limitations by the sum of $708,235.00, and 940837 F7-11(:(45," ee : � ' , ,q 1 m; aR pl RE: BALLOT ISSUE PAGE 2 WHEREAS, the Board foresees the need to spend said sum in the area of criminal justice, including, but not limited to, increasing the size of the Weld County Jail, jail operational costs to house inmates, the increased prosecution of adults and juvenile delinquents by the Weld District Attorney, and additional public safety, and WHEREAS, the Board now deems it necessary to submit to the qualified electors of Weld County the question of whether or not to retain the 1994 mill levy of 22.457, thereby increasing revenue by $708,235.00 above the 1995 TABOR and Charter 5% limitations, for the purpose of spending said money in the area of criminal justice in Weld County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the question of whether or not to raise Weld County's revenue for 1995 by $708,235.00 over its calculated 1995 TABOR and Charter 5% tax limitation by retaining the 1994 mill levy of 22.457 shall be submitted to the qualified electors in Weld County at the November 8, 1994, general election. BE IT FURTHER RESOLVED by the Board that staff is directed to submit the question to the Weld County Clerk and Recorder in substantially the same form as that attached hereto as Exhibit "A."
