P' -¢y�o z A ,2- t ^z 55z - w ao.a....�w. 2F�LLUpy Z 91403(C)o RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1600 - STEWART WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1600, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1600 was submitted by Robert Stewart, 36559 Weld County Road 29, Eaton, Colorado 80615, for property which is located in part of the Ni of Section 30, Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 4 acres and 113 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1600, submitted by Robert Stewart, be, and hereby is, approved conditional upon the following: 1. The applicant shall obtain approval for any culvert which is necessary to access onto Weld County Road 78 from the Weld County Public Works Department to serve Lot A. 2. A Weld County septic permit is required for the proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 3. ISDS permits shall be finalized and approved by an Environmental Protection Specialist within one (1) year of the application date. 4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. Stewart. The parcel of land under consideration is described as part of the N2 of Section 30, T7N, R66W of the 6th P.M. , Weld County, Colorado and is the total contiguous land holdings of the applicant. The property is located approximately 2 miles northeast of Severance, southwest of the intersection of Weld County Roads 78 and 27. No dwellings currently exist on the property. The parcel of ground under consideration is Lot B of RE-1100, approved by the Board in 1988. RE-1100 was requested in conjunction with SE-346, which divided a 139 acre parcel into 3 parcels of 117 acres, 12 acres, and 12 acres, more or less. This subdivision was granted in order to resolve the status of 2 illegal parcels created in 1976 (Lot A of RE-1100) and 1980 (SE-346) . Lot A of RE-1100 is located southwest of the subject site and contains a residence. The applicant is requesting to further subdivide the property into 2 parcels of 113 and 4 acres , more or less. As stated in the application, the small lot would be sold as a potential rural residential lot and the large parcel would continue to be farmed and also provide a homesite for the applicant. The proposed 113 acre lot presently accesses Weld County Road 78 at a point suitable to serve the location of the applicant' s new residence. The applicant proposes to construct a second access on Weld County Road 78 to service the 4 acre lot. The eastern boundary of the property is a 30 foot private easement which aligns with Weld County Road 27 and also provides access to the property. 940360 RECOMMENDATION, RE-1600 Robert L. Stewart Page 2 North Weld County Water District is able to provide water service to two residences at this location, if the Recorded Exemption is approved. A septic system is proposed to be constructed on each parcel. The majority of the property is in hay production. A center pivot sprinkler has been installed, leaving nonirrigated areas along the perimeter of the existing parcel (see plot plan) . The applicant is requesting that a 4-acre corner be divided from the balance of the farm. The Department of Planning Services' staff has concerns in supporting the creation of this parcel on the basis that its ground is nonirrigated. Such an argument leaves the door open for future recorded exemption requests to occur along the southwest property boundary which is also nonirrigated. The agricultural zone district was established to maintain and enhance agricultural production. It is the opinion of the staff that two more residences at this location may increase the conflict between rural and urban land uses. Staff requests that the Board consider whether this application meets the criteria for review as set forth in Sections 11.5.1 through 11. 5.6 of the Weld County Subdivision Ordinance.
