The applicant has complied with all the application requirements listed in Section 21.7 et seq. , of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 21.6 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Goals and Policies which are intended to accommodate commercial development within the urban growth boundaries of existing municipalities. The subject property is within the urban growth boundary of the City of Greeley. The City of Greeley Planning Commission has reviewed this application and found no conflict with this proposal. b. The uses allowed on the property will be compatible with the surrounding land uses. The majority of this parcel is already zoned C-3. The property has an existing commercial use on it. The parcel which has access to Cherry Avenue is being used for residential purposes, but only half of the lot is zoned R-1. This application will correct the zoning and give the entire lot R-1 Zoning. c. The property has adequate water and sewage facilities. Water is provided by the City of Greeley. An existing septic system provides sewage disposal. d. Access to the subject property is adequate in size to meet the requirements of the zone district. The State of Colorado, Division of Highways, has reviewed this proposal and recommended that when there is a change in use of the property, an access permit will be required. This issue is addressed in the attached Conditions of Approval. Performance standards listed in the Weld County Zoning Ordinance will insure compatibility with surrounding uses. e. The subject property is in the Weld County Airport Overlay District. This issue is also addressed in the attached Conditions of Approval. No other overlay districts affect the site. f. There are no known mineral deposits or soil conditions that would inhibit commercial or residential development on the subject property. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of the Weld County Board of County Commissioners, 915 10th Street, Greeley, Colorado 80631, requesting a Change of Zone from R-1 (Low Density Residential) to C-3 (Commercial) and C-3 (Commercial) to R-1 (Low Density Residential) on the above referenced parcel of land be, and hereby is, granted subject to the following conditions: 1. A site plan review is required for this site in accordance with Section 23 of the Weld County Zoning Ordinance. 2. This property is located in the Weld County Airport Overlay District. All uses on the property shall comply with District Regulations. 3. An access permit from the State of Colorado, Transportation Department, is required in the event that there is a change in the size, type, weight or frequency of vehicular traffic on the property. The State of Colorado, Division of Highways has reviewed this proposal and recommended that when there is a change in use of the property, an access permit will be required. The attached map demonstrates how the zoning boundary does not coincide with the boundaries of the properties involved. In 1981 when the county redistricting was implemented, a 200 foot strip along U.S. 34 was designated as C-3 without regard for the boundaries or the use of the parcels involved. The parcel with frontage along Cherry Avenue contains a residence. It is the opinion of the staff that R-1 is a more appropriate zone district for this parcel. The parcel does not front on a road with a sufficient classification to support the existing C-3 zoning and the uses on this parcel are more consistent with the properties to the south zoned R-1. There are three other parcels owned by Mr. Luther which are currently being used for the sale and display of farm implements. It is the opinion of Mr. Luther and the staff that the C-3 zoning district should follow the boundaries of these parcels. All parcels have adequate access and frontage along a minor arterial which is sufficient classification to justify the proposed zoning. The properties have existing City of Greeley water taps. There are two existing septic systems which provide sewage disposal on the three parcels. A soil survey is attached. There are no known soil conditions that would limit commercial development in the change of zone area. The property has existing access to Highway 34. An increase in traffic as a result of this zone change is not anticipated. A significant change in the use of the property would require a Site Plan Review by the Department of Planning Services staff. Any road improvements such as acceleration and deceleration lanes can be addressed at that time if necessary. According to maps and information available to the Department of Planning Services, there is no sand, gravel or other mineral resource which is feasible to recover. The change of zone area is not located in the floodplain or geologic hazard zone. The property is in the Airport Overlay District but is not in conflict with the requirements of the District.
