RE: APPROVAL OF RECORDED EXEMPTION NO. 1568 - BRENNER
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colcrado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1568, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1568 was submitted by
Leeane Brenner for property which is described as Lot B of RE #779 and is located
in part of the SE'y of Section 32, Township 5 North, Range 64 West of the 6th
P.M. , Weld County, Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A", said plat to be
recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 43 acres and 4 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. Any existing septic system, which is not currently permitted through
the Weld County Health Department, will require an Individual Sewage
Disposal System (ISDS) evaluation, prior to the issuance of the
required septic permit.
2. An ISDS shall be located at least 100 feet from any well.
3. The structure approved as an accessory to farm shall be converted to
a principal dwelling.
4. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11. 7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.

5. The applicant shall apply for and receive from the Central Weld
County Water District, an additional water tap for Lot B.
The above and foregoing Resolution was, on motion duly made and seconded,

Subject: Recorded Exemption #1568
This request for a recorded exemption is submitted by Leanne Brenner. The parcel
of land on which this request is made is described as Lot B of RE-779 , which is
part of the SE4 of Section 32, T5N, R64W, of the 6th P.M. , Weld County, Colorado.
The property is located northwest of the intersection of Weld County Road 50 and
Weld County Road 53. The request is to divide a 47 acre parcel, which is the
total contiguous land holdings of the applicant, into 4 and 43 acre parcels.
Water service to both residences is presently provided by Central Weld County
Water Conservancy District. Both proposed lots are presently served by septic
systems.
The Department of Planning Services' staff has concerns about this proposal based
on the level of development in the vicinity. The section where this proposal is
located has 24 parcels. Six recorded exemptions and one minor subdivision, which
was the precursor to the recorded exemption, have been granted. Further division
of this section does not conform to efficient and orderly development.
The proposed recorded exemption would split off an existing residence, and leave
one residence on the proposed larger lot. The proposal would not remove any
agriculturally productive land from production, given that there are already
improvements on the proposed lots .
Staff requests the Board decide if allowing another lot to be created in this
area will be consistent with efficient and orderly development, given the high
number of lots already located in this section.

2. Describe the location, size and present use of the area where each
proposed new,lo will be created-
The
property is located north or wCR 50 and west of WCR 53, Southwest of Kersey,
Colorado. The proposed Lot "A" is located in the Northwest corner of the property
and is an older frame structure which has been added onto in various stages
over the years and is vacant. The proposed Lot "B" parcel serves as the home to
my family and a horse facility.
3. Explain how the proposal is consistent with the Weld County Comprehensive
Plan and any adopted municipal plan, if applicable.
The current use and the proposed use of the subject property will not change
therefore will remain consistant with the policies of Weld County Comprehensive
Plan. Kersey has no master plan affecting the property.
4. Explain how the uses permitted will be compatible with existing uses
surrounding the proposed recorded exemption.
The surrounding land uses are single family residential and agricultural uses.
The current use of the property is two single family dwellins and agricultural .
The change will allow for fee simple ownership and the discontinuance of a
commercial use since I purchased the property. The change will be more compatible
with surrounding land uses.
5. Explain how the proposal is consistent with the intent of the zoning
district: it is located within.
The proposed change will not effect the use of the subject property except for
' fee simple ownership and again the discontinuance of a business. Therefore
the current zoning will not be changed and will remain consistant with the intent
of the agricultural zoned district.
6. Explain how the proposal is consistent with efficient and orderly
development.
No change of use to either of the properties is proposed and their use will
continue to be consistant with future development as projected by the
comprehensive plan.
7. Explain how adequate provision for the protection of the health, safety,
and welfare of the inhabitants of the neighborhood and the County will be
accomplished.
Since moving to the property I have been complimented by the neighbors for
the elimination of traffic and commotion in the area as well as overall
appearance. By disposing of the second dwelling, private ownership should
provide a more responsible and stable occupant of the property.

Dear Sirs:
In April of 1993,, I acquired the property legally described as Lot
"B" of Amended Re-•779. The property is a 47 acre parcel created
by a plat recorded July 17, 1986 and amended by a plat recorded
March 13, 1992 which moved a property line to increase the size of
Lot "A" and make each lot more functional . Situated on the
property are two residential structures several small sheds and a
barn. I understand the previous owners had operated this facility
as a commercial business as permitted by UER--663:85 : 1 . After
meeting the neighbors in the area it is my understanding that this
business had created various problems and disputes. I have no
intention of continuing or utilizing this facility in the manner
which it had previously been operated . I also have realized that
I have no use for the residential structure located in the
Northwest corner of the property as it would only serve as rental
property which has proved to be a burden on me. At this time
wish to sever from the property approximately 4 acres including
the residence in accordance with section 11 .4 of the Weld County
Subdivision Ordinance. It is my desire to sever, the 4 acre parcel
and dispose of :it to a fee simple owner who will better maintain
the property as a single family residential dwelling and I will
maintain the remaining property as the same . The 4 acre parcel is
excess property which wil. l better serve a private owner.

Dear Ms. Brenner:
This letter is in response to your request for the availability of additional water service for the
following described property:
Lot B Recorded Exemption No. 0963-32-4-RE779 being part of SW'.6 SE'/a Section 32,
Township 5 North, Range 64 West of the 6th P.M., Weld County, Colorado, per map
recorded March 13, 1992 Book 1328 Reception No. 2280805, together with easement for
roadway and utility purposes being 20' wide shown on Recorded Exemption map and
recorded under Reception No. 1602398, Weld County, Colorado.
Water service is presently available to the above described property by tap number 154 located
at Weld County Road 50 between 51 & 5346. Additional water service can be made available
to this property provided all requirements of the District are satisfied.
Central Weld County Water District requires that contracts be consummated within one (1) year
from the date of this letter or this letter shall become null and void unless extended in writing
by the District.

Dear Ms. Brenner:
Your recorded exemption application is complete and in order and will be processed
on or before December 19, 1993. If it is determined that the application meets the
approval criteria of the Weld County Subdivision Ordinance, you will be notified
that the recorded exemption is approved. If the staff determines that the
application does nct meet the approval criteria, you will be notified and asked to
appear before the Board of County Commissioners at a public hearing. You will be
informed of the hearing date prior to the hearing. The Board of County Commissioners
will then consider your application and make a final decision on the recorded
exemption.
It is the policy of Weld County to refer an application of this nature to any town
or municipality lying within three miles of the property in question or if the
property under consideration is located within the comprehensive planning area of a
town or municipality. Therefore, our office has forwarded a copy of the submitted
materials to the Town of Kersey Planning Commission for its review and comments. It
is recommended that you and/or a representative be in attendance at. the Kersey
Planning Commission meeting to answer any questions the Commission members may have

To Whom It May Concern;
Mr. Hadley Barrett has been in possession of the property
commonly known as the "Horse Around Stables" for 6 to 8 months.
He and his family have made great strides in getting the property
into good condition, by cleaning up, tearing down unneeded
structures and generally just doing good basic maintenance.
It has come to our attention, that Mr. Barrett is wanting to
divide the current property into two parcels. One parcel to be
with the current permanent residence and the second to be the
balance of the acreage to go with the semi-permanent (modular )
home.
The "Horse Around Stables" had a "Use By Special Review Permit"
to operate as a business. Mr. Barrett does not wish to operate
the stables as a business. Therefore, we would be in favor of
the granting of a new variance allowing the property split if the
current "Use By Special Review Permit" were canceled so that
a business could not operate and would not be a point of property
sale.
We have lived in our residence, neighboring the above mentioned
property since August 1977, and have seen all the many
transformations and uses of the property for business. We have
put up with the added traffic and inconvenience of having a high
traffic business next door and would like very much to see the
property returned to that of a single family residence, in this
case, two properties one family each.

We feel the purchase of Horse Around Stables by Hadley Barrett and Lee
Brenner has been a benefit to the area. They have worked hard this past
year to repair and replace some pens and corrals close to their barn,
kept the pasture mowed and cleaned the area around both houses.
They are neat, clean and personable people and their children are well
behaved and helpful. We feel they are an asset to the area and look
forward to a long and happy relationship as neighbors.

To Whom It May Concern:
I have been asked by Lee Brenner to comment regarding her request to amend
her Recorded Exemption and welcome the opportunity to do so. I understand that by
amending her Recorded Exemption she would then be able to sell approximately 4 acres
and 1 of the two houses on her property.
Since moving to this area, Lee and her family have considerably improved the
appearance of their acreage. The property had been run down and the previous owners
had some rather strange decorating ideas that have now been removed. I appreciate
the Brenner's concern over the way their property looks; it improves the value of all
properties in the area.
Their property has had 2 seperate and distinct dwellings on it for several years.
While the previous family lived in one, another family lived in the other. Therefore,
having 2 families in that area again would really not negatively effect my family or
property.
If Lee is not able to amend her Recorded Exemption, I assume her only alternative
would be to rent the house out. I would much rather have an owner occupant than
a renter as a neighbor. My experience has been that an owner tends to care for their
property much better than a renter does.
In summary, I would ask that you favorably consider Ms. Brenner's request to
amend her Recorded Exemption which will allow her to sell one of the houses on her
property.
