WHEREAS, the Board of County Commissioners of Weld County, Colorado, ce) O

pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and

WHEREAS, the Board of County Commissioners has the power and authority m
under the Weld County Home Rule Charter and State statute, including Article 28
of Title 30, CRS, to adopt building codes for the unincorporated areas of the x o
County of Weld, and a ..
WHEREAS, the Board of County Commissioners of Weld County, Colorado, has n
previously adopted Ordinance No. 119, Weld County Building Code Ordinance, O
establishing a comprehensive revision of the building code requirements for
unincorporated areas of the County of Weld, and has adopted amendments in PI o
Ordinances No. 119-A through 119-I, and

WHEREAS, said Ordinance No. 119, as amended, is in need of revision and d
clarification with regard to procedures, terms, and requirements therein.

NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Weld '
County, Colorado, that certain existing sections of said Ordinance No. 119, as n o
amended, are repealed and re-enacted, with amendments, and the various sections 0 "
are added or revised to read as follows:
Amend Section 20. 1 to read:
20.1 Uniform Building Code. The publications of the International
Conference of Building Officials known as the Uniform Building Code,
1991 Edition, including the Uniform Building Code Appendix (except
for Chapter 1 Division I and II, Chapter 12 Division I, Chapter 23
Division IV, Chapters 29, 35, 51 and 53 of the appendix and Section
1110 of Chapter 11 of the appendix) and the Uniform Building Code
Standards, 1991 Edition. . . (balance of section unchanged) .
Delete Section 20.1. 1.
Amend Section 20. 1.2 by changing "third" to "fourth" in the text and renumber to
20.1. 1.
Amend Section 20. 1.3 by changing Section 1707 to 1708 in the text and renumber

The following business was transacted:
I hereby certify that pursuant to a notice dated November 25, 1991, and
duly published November 27, and December 5, 12, and 19, 1991, in The New
News, a public hearing was conducted to consider amendments to the Weld
County Building CodE. Ordinance. Lee Morrison, Assistant County Attorney,
made this a matter of record. Chuck Cunliffe, Planning Department
Director, read the favorable recommendation of the Planning Commission
into the record. Mr. Cunliffe said this deals mainly with the 1991
editions of various codes and minor changes such as clerical and deletions
to better facilitate the codes. Mr. Morrison read Ordinance No. 119-J
into the record. There was no public testimony concerning this matter.
Mr. Cunliffe said the title of Ordinance No. 119-J should include all
codes. Commissioner Lacy moved to approve Ordinance No. 119-J on first
reading, with the addition of all codes in the title of said ordinance as
recommended by staff. The motion was seconded by Commissioner Webster,
and it carried unan:.mously.

Amend Section 20.1 to read:

The Department of Planning Services' staff recommends that the proposed
amendments be approved. The amendments are summarized in the attached
memorandum. The Weld County Building Trades Advisory Committee reviewed the

The amendments are summarized below.
Section 20.1
Adopts the 1991 edition of the Uniform Building Code including certain sections
of the Uniform Building Code Appendix.
Section 20.1.1
This section was deleted because the 1991 Edition of the Uniform Building Code
Section 305(b) was changed to reflect the County's current requirements.
Section 20.1.2 and Section 20.1,3
These sections were changed to reflect changes in the 1991 Uniform Building Code.
New Section 20.1.3
This exception was added to the Uniform Building Code to allow a single step at
patio doors.
Sections 20.2, 20.4, 20.5, 20.6, and 20.12
These sections were amended to adopt the 1991 Editions of the Plumbing,
Mechanical, Abatement of Dangerous Building, Swimming Pool, and Housing uniform
codes.
Section 20.5.2
The definition of dangerous building was changed to include mobile home,
manufactured home, and factory built home.
Section 20.5.20
This section was amended to reference the 1991 edition of the code.

This section was amended by adding current and future occupants in order to allow
the department to pursue building code violations after the building is vacated.

The renumbering of these sections is to correct an editorial error.

Building Code Ordinance be approved.

November 19 , 1991
A regular meeting of the Weld County Planning Commission was held November 19 ,
1991, in the County Commissioners' Hearing Room (Room #101) , Weld County
Centennial Building, 915 Tenth Street, Greeley, Colorado. The meeting was called
to order by the Chairman, Bud Clemons, at 1: 30 p.m.

held on November 5, 1991, was approved as read.
Bud Clemons, Chairman, announced the 1992 Planning Commission schedule would be
discussed at the next scheduled meeting.
Consider proposed amendments to Section 20, 30, and 72 of the Weld County
Building Code Ordinance.
Chuck Cunliffe asked that the proposed amendments be approved. He explained the
amendments are summarized in the packets submitted to the Planning Commission
members . The Weld County Building Trades Advisory Committee reviewed the
proposed amendments and recommend approval.
Jean Hoffman asked if the Building Trades Advisory Board consisted of appointed
members. Chuck Cunliffe explained the Board consists of 13 members comprised
primarily of people from various building trades, and 4 of the members represent
the two home builders associations in Weld County.
The Chairman asked if there was anyone in the audience who wished to speak for
or against this application. No one wished to speak.

Don Feldhaus moved the proposed amendments to Section 20, 30, and 72 of the Weld
County Building Code Ordinance be forwarded to the Board of County Commissioners
with the Planning Commissions' recommendation for approval. Judy Yamaguchi
seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission
for their decision. Richard Kimmel - yes; Jean Hoffman - yes; Tom Rulon - yes;
Judy Yamaguchi - yes; Don Feldhaus - yes; Bud Clemons - yes.
Consider endorsement of the Town of Erie's Comprehensive Plan.
Chuck Cunliffe stated the Department of Planning Services recommends that the
Planning Commission recommend endorsement of the Town of Erie's Comprehensive
Plan to the Board of County Commissioners. Erie's adopted goals and policies or
the recommendation of Erie' s land-use decision making body will be considered as
recommendations by Weld County in reviewing development proposals within the
unincorporated areas of Erie's Comprehensive Plan area.
Don Feldhaus asked if this is just an update of the existing plan or is this
their first shot at a Comprehensive Plan. Chuck Cunliffe explained this is an
update of the County' s endorsement of the plan done in 1986 or 1987. Don
Feldhaus asked if there had been any significant changes. Chuck Cunliffe said
no, the document that the Planning Commission is considering today has
significantly less material than the previous plan. They have actually deleted
alot of sections to try and attempt to clarify and make things clearer. This
body and the Board of County Commissioners would use this plan as an advisory
document.

Richard Kimmel moved the Town of Erie' s Comprehensive Plan, with the updated map

NOTICE OF PUBLIC HEARING
Docket No. 91-62
The Board of County Commissioners of Weld County, Colorado, will conduct a public
hearing at 10:00 A.M. , on Wednesday, January 8, 1991, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, Weld County Centennial
Center, 916 10th Street, First Floor, Greeley, Colorado, for the purpose of
considering amendments to the Weld County Building Code Ordinance as summarized
below:
Section 20. 1
Adopts the 1991 Edition of the Uniform Building Code including certain sections
of the Uniform Building Code Appendix.
Section 20. 1.1
This section was deleted because the 1991 Edition of the Uniform Building Code
Section 305(b) was changed to reflect the County's current requirements.
Section 20.1.2 and Section 20. 1.3
These sections were changed to reflect changes in the 1991 Uniform Building Code.
New Section 20. 1.3
This exception was added to the Uniform Building Code to allow a single step at
patio doors.
Sections 20.2, 20.4, 20.5, 20.6, and 20.12
These sections were amended to adopt the 1991 Editions of the Plumbing,
Mechanical, Abatement of Dangerous Building, Swimming Pool, and Housing Uniform
Codes.
Section 20.5.2
The definition of dangerous building was changed to include mobile home,
manufactured home, and factory built home.
Section 20.5.20
This section was amended to reference the 1991 Edition of the code.
Section 20. 13.1
This section was amended by adding current and future occupants in order to allow
the department to pursue building code violations after the building is vacated.
Section 30.3.7
This amendment deletes the requirement for the Department to retain plans for
commercial structures for more than 90 days.
Sections 72.3.4 and 72.3.4.1
The renumbering of these sections is to correct an editorial error.

Tuesday, November 19, 1991, in the County Commissioners' Hearing Room, First
Floor, Weld County Centennial Center 915 Tenth Street, Greeley, Colorado, for the
