RESOLUTION
RE: GRANT REQUEST FROM TUTTLE APPLEGATE, INC. FOR PREADVERTISEMENT OF SPECIAL
REVIEW PERMIT APPLICATION - BESTWAY PAVING
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from Tuttle Applegate, Inc. for
preadvertisement of an application for a Special Review Permit for a dry-pit
gravel mine in the A (Agricultural) Zone District, for Bestway Paving Company,
and
WHEREAS, said property is described as part of SW! of the SW' Section 36,
Township 6 North, Range 66West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, after study and review the Board deems it advisable to grant said
request, with the hearing date to be set as March 24, 1993 at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request from Tuttle Applegate, Inc. for
preadvertisement of an application for a Special Review Permit for a dry-pit
gravel mine in the A (Agricultural) Zone District for Bestway Paving Company be,
and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said
request be, and hereby is, set as March 24, 1993 at 10:00 a.m.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 22nd day of February, A.D. , 1993.

Dear Shelly:
This is a request to pre-advertise a USR for a sand and gravel site
for Bestway Paving, Westmoor Site. The property is located east of
35th Avenue Between C Street and F Street. The legal description
is a portion of the SW 1/4 of the SW 1/4 of Section 36 , Township 6
North, Range 66 West of the 6th P.M. , Weld County, Colorado;
containing 9 . 9 acres.
Bestway Paving is willing to pay the cost of publishing the
required notice for the USR.
The Weld County Planning Commission meeting date for this project
is March 16 , 1993 . We are requesting a hearing date as soon as
possible to enable Bestway Paving to begin their operation early
this spring. Per our telephone conversation, you suggested March
24 , 1993 to allow the Commissioners time to review information.

Pursuant to the zoning laws of the State of Colorado and the Weld County Zoning
Ordinance, a public hearing will be held in the Chambers of the Board of County
Commissioners of Weld County, Colorado, Weld County Centennial Center, 915 10th
Street, First Floor, Greeley, Colorado, at the time specified. All persons in
any manner interested in the Site Specific Development Plan and Special Review
Permit are requested to attend and may be heard.
Should the applicant or any interested party desire the presence of a court
reporter to make a record of the proceedings, in addition to the taped record
which will be kept during the hearing, the Clerk to the Board's Office shall be
advised in writing of such action at least five days prior to the hearing. The
cost of engaging a court reporter shall be borne by the requesting party.
