APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that the
standards of Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance
have been met. This Recorded Exemption is approved with the following conditions in
accordance with information submitted in the application and the policies of the
County.
A Weld County septic permit is required for the proposed home and its septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
The Individual Sewage Disposal System permit shall be finalized and approved by an
Environmental Protection Specialist within one (1) year of the application date.
Prior to recording the plat, the applicant or owner shall show a legal, recorded
access is available to the 9 acre lot.
The applicant shall submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the
date of approval by the Department of Planning Services. The applicant shall be
responsible for paying the recording fees.

Livestock Company
Weld County is requiring Booth Land and Livestock Company provide
a consent for crossing the Great Western Railway Company right-of-
way as a condition of approval of the Recorded Exemption. The
attorney for the applicant has provided, by letter of July 16,
1993, evidence that the Right of Way Grant creating the right-of-
way for the railroad reserved the right to cross the railroad. In
particular, it included the right to construct wagon roads or other
crossings .
Based upon the language and argument of counsel for the applicant,
it is my opinion that no further consent is required from the Great
Western Railway Company in order that the users of the land on
either side of the railroad right-of-way be allowed to cross the
right-of-way.

Dear Lee :
As a condition of approval of the above Recorded Exemption, Weld
County is requiring Booth Land and Livestock to provide a consent
for crossing the Great Western Railway Company right of way. As
you were advised, the railroad will not consent without
substantial initial payment and annual fees .
We submit that the Great Western Railway Company' s consent is not
required. The railway is required to permit the line to be
crossed by virtue of a Right of Way Grant recorded May 8 , 1905 , in
Book 228 at Page 92 , a copy of which is attached. The right of
way was conditioned on several requirements, each of which
evidenced the grantors ' concern with crossing the line. The
Railway Company was required to supply, construct and maintain in
proper repair all culverts or steel syphons necessary to convey
irrigation and flood waters under and across the railway, runways
for stock, and "all wagon roads or other crossings" . The railway
was also required to give due consideration and regard in the
construction and operation of the railway to the lessees on lands
adjacent to the railway line.
Although the right of way condition refers to "wagon roads or
other crossings" , such language has been interpreted to include
motor vehicles . In Wagoner v. Jack' s Creek Coal Corp. , - 199 Va.
741, 101 SE2d 627 ( 1958 ) , the court held that a right of way
designated for a "wagon haul road" did not restrict use to the

type of vehicle or mode of travel existing at the time the
easement was created . It concluded that trucks were the "modern
substitute" for wagon hauling, and it found the use of such
vehicles was permissible.
Similarly, in Giles v. Luker, 215 Minn . 256 , 9 NW2d 716 (1943 ) ,
the Defendant had been granted a right of way "for traveling by
foot or wagon over the wagon road . . . " . The court held that
the word wagon was used in the generic sense and was broad enough
to cover vehicular transportation not known at the time of the
grant, but used to replace wagons . See also McDonnell v. Sheets ,
234 Ia. 1148, 15 NW2d 252 ( 1944 ) (easement granting access with
"team and wagon" , held not to restrict type of vehicle) .
The language in the right of way grant clearly evidences the
grantor ' s concern with crossing the railroad line. Under the
cases cited above, such crossing is permissible, both by wagons
and by other vehicles not existing at the time the easement was
created, but which have become commonplace since that time.
Providing and maintaining such vehicle crossings was an original
condition of the right of way granted to the Great Western Railway
Company. Great Western continues to have this obligation by
virtue of its continuing use of the right of way.
Moreover, the railway was granted a right of way only . In such
case, the grantor and its successors reserve all rights to use of
the land not inconsistent with privilege granted . A crossing at
this place will not interfere with the railroad use. Accordingly,
we request that Weld County dispense with the requirement of
permission to cross the Great Western right of way and approve the
above Amended Recorded Exemption.

Dear Planners:
Enclosed you will find a completed application for an amendment to recorded exemption
number 1061-36-4-RE457 recorded September 30, 1980.
The subject property is Lot B of the said recorded exemption being 49.462 acres located in
the southeast quarter of Section 36, Township 4 North, Range 68 West.
I propose to amend the size of Lot B by reducing it to approximately 42 acres. By doing
so it will leave me with a site of approximately 7 acres which would be considered a legal
building site because of the natural division and boundary line created by the railroad tracks.
The exact size will be determined by a survey plat map prepared by a registered land
surveyor.
I feel my request meets the standards and requirements set forth by Weld County
Subdivision Regulations and complies with the Weld County Comprehensive Plan.
If a house were to be built on the property the water would be served by the Little
Thompson Water District with their line in Weld County Road 38. The electric would be
serviced by United Power or Public Service. They both meet at the east/west half section
line for their service area. A septic system approved by Weld County Health Department
would be utilized if we build.
The proposal amendment is compatible with other properties in the area and will remain
in the agriculture zone and use.

land for which this application has been submitted is north of Weld County Road
38, west of Weld County Road 13.

Dear Jake and Gary:
I did some research regarding the parcel of property that you want
to sell adjacent to the Little Gem Reservoir. My findings are
very interesting.•
-
First, I am enclosing a copy of the right of way grant to the
railroad. I find that it is a right of way only and not a deed to
the fee . The right of way is also not exclusive . Additionally,
the right of way grant provides that the railroad must provide for
"all wagon roads or other crossings and runways for stock wherever
deemed necessary by the party of the first part" . This grant was
from the State of Colorado at the time that it owned the property
and- this language is not without ambiguity, but it may provide a
basis :.for again contacting the railway company and demanding a
crossing,.;without cost to you.
Additionally, ' I am enclosing a copy of a Deed granting to Lowerys-
a right of way to the Little Gem Reservoir . I think this right of
way is along the north side of the existing tracks ; however, I
will have to verify this . It might be that this right of way
still exists ; however, if the title to the property over which the
right of way exists and the owner of the right of way become the
same, then the title is merged and the right of way vanishes . I
would appreciate your calling me and advising me of the chain of
title and transactions regarding the farm now owned by Dennis
Sewald.

For your information I am also enclosing a. copy of.-,an easement and
right of way to Great Western Sugar Company for a beet dump. I
don ' t know exactly where this beet dump is , but the right of way
clearly provides that it shall terminate upon non-use for beet
dump purposes .
One or more of these documents may provide a -basis for BLLC to
claim an absolute right for ingress and egress to the isolated
parcel . After you have had an opportunity to review this letter
and the enclosed documents , please give me a call and perhaps we
can determine the best approach to take.

This letter is in response to your request that the Little
Thompson Water District commit to provide domestic water service to
property described as follows:
A parcel of land situate in the SE 1/4 of
Section 36, Township 4N, Range 68 West of the
6th Principal meridian in Weld County,
Colorado.
The request is for one (1) standard 5/8" X 3/4" residential
water tap.
We currently have a 6" diameter water line located along the
north side of Weld County Road 38 in the above described area with
additional capacity available. Therefore, we will commit to provide
service to this lot via one standard residential water tap with the
following conditions:
1. If the property does not have frontage along WCR 38,
a line extension may be necessary to provide service. The
developer would be responsible for the installation of
such a line extension.
2 . All other improvements to District facilities required
to provide service will be the financial responsibility
of the developer in accordance with District Rules and
Regulations. All improvements must conform to District
Specifications.
