We farm approximately 2000 acres in the LaSalle, Peckam and west Kersey area. Our crops consist of pototoes, onions, corn, lettuce, beans, and wheat. As you can see, some of these crops are high dollar & high maintenance crops. There are 53 gas wells currently on this ground that I must farm around. The oil companies involved are Snyder, Basin, Elk, Gerrity, & Prima. I do not deny that oil companies have the right to drill and maintain operations. Most of the landowners in this area have leased out the ground to the oil companies, and thus gave them the right to drill. Unfortunately, this right has been abused in many cases. Most of the ground I farm is leased and not owned by myself, and I have 16 different land-owners that I farm for. I own 160 acres with 4 wells on it. I understand that it is not the oil companies fault if a land-owner chooses not to pay me any damages. If I suffer damages from the normal & well maintained drilling operations on leased land, that is between myself and the land owner. Let me share a couple of the problems that our operations have encountered and the companies involved. Time does not alow me to list all of the problems I have encountered. 1. All the above companies are guilty of digging too big of pits and doing a poor job of getting the mud out. Prima has done a great job on the last couple of wells drilled on our land. They have sized down there pits and have scooped all the mud out. Basin also sized down a pit this past winter but did not go into detail to get all the mud out. The smaller sized pits should have been used years ago. Gerrity recently bought two Martin wells that we farm around. I asked Gerrity to come in and dig up a pit that Martin closed in with a lot of mud still in it. We could not grow any crops on the pit area in the years since Martin had closed this pit. After six months of communications with Gerrity, this January they redug the pit and put it back to where we hope it will work better. I have heard many horror stories about Gerrity, but in this encounter they worked with me well. 2. Snyder has been one of the better companies to work with, but not without problems. My complaints with Snyder are for one, the drilling and opening of many pits in the winter. They need to do a better job of closing pits as soon as possible and as weather allows. The combination of smaller pits and partial closing immediately after drilling, with final reclamation in early spring after the frost is out, would help solve this problem. They also need to do a better job of weed control around there sites. 9 4 33( ; HG; ('A ; Page 2 3. This past January we rented ground that Elk has the lease on. The owner is a recently widowed lady that wanted me to help her deal with the three (3) oil companies that have the lease on the minerals. Elk initially refused to talk or meet with me on work to be done on exisiting wells. Colleen Nealy of Elk informed me that it was Elks policy to deal only with the land-owners and not the tenant_ Due to this, there has been some confusion between myself and the land-owner on work being done by Elk. I think Elk has taken advantage of the lack of knowledge of the land-owner in these matters as they pertain to the farming. Because of this, the communication was not there and Elk last week started moving in equipment within 100 yards of a moving sprinkler running dry. I must say that all the companies mentioned on the first page, with the exception of Elk, have been very good in keeping me informed. Though sometimes we have different views, the open line of communication has helped each side greatly. How can I work with someone that will not meet with me, such as Elk? I apoligize for the length of this letter but I thought it was important to share some of my views. The oil companies are sending out letters telling us how many changes they have made and what a good job they are doing. I do not deny that many of the companies have made substantial improvements_ The problem is that it has had to come to these measures to force the oil companies to do these things_ I do believe that without the efforts of Front Range Land and Mineral Owners Association and other concerned and hard working people, that many of these changes would have never been put onto effect. In any business, every year there are new and better ways of doing things. I have heard the excuse many times that this is the way we have always done it. If I farmed the way I did 10 years ago, I would be out of business. The oil companies need to constantly search out ways of doing a better and more efficient job that will least damage the environment and farm land. In conclusion, I understand the important role that the oil and gas industry plays in this area. They employ many people and the taxes that they pay are a boost to our local economy, but ag is also a very important part of the local economy. Each side is here and we must get along. I think the oil companies have made progress, but there is much more that can be done. I feel that if we let up now, things will go back to where we started. I encourage you to pass legislation that will encourage the oil companies to continue to strive for the best way of doing operations and effect ag and environment the least. In addition, Senate Bill 177, negotiated with county input, will further expand the regulation of the industry by the Oil and Gas Conservation Commission, including the hiring of nine new employees. And, under that bill, the county may arrange to be involved in the inspection of oil and gas facilities and monitoring for compliance with Commission rules. Therefore, the proposed regulation is inappropriate and unnecessary. As an individual that makes my living in the oil industry, I am also concerned about my job security and the impact these regulations could have on the quality of life in Weld County. These regulations are clearly burdensome and will negatively impact the business of the company that I work for. I fear that this will result in lost jobs. This will also have an impact on the tax revenues for the county and will either hurt the school system or drive up taxes to offset the loss from the oil industry. If the gas and oil business is lost in Weld County or even if it is delayed, it would basically destroy our business, this hotel would no longer be profitable. We count on this corporate base as one third of our business. Each of the major hotels in Greeley have experienced a bankruptcy in the not too distant past, we are 311 doing well at this time, however we are facing three new hotels on our doorstep, adding 150 new guest rooms in this area. These new rooms will help during the busy summer seasons, but we will be competing over the same ten occupied rooms in the winter. If we lose our corporate foundation in any degree, we will lose any stability that we have now. The result will be employee layoffs, a decrease in taxee, .a reduction in real estate taxes, a reduction in spending and higher unemployment. The Governor's recent appointment of a commis- sioner with an agricultural background is a token gesture. Johnson will probably be very frustrated in his attempts to change or work with the commission. #4 "Supporting reasonable and responsible legislation which increases the authority," etc. Again, wrong idea--the Commission and Colorado State legislature, have consistently leaned toward the oil industry. Your actions at the county level is our only hope to allow Weld County proper- ty owners and agricultural producers to be represented, and have their property interests protected. #5, 6, & 7 Snyder Oil is attempting to turn around and improve on their poor reputation in the county. But they continue to talk and not act. Right now our Bigfoot Turf Farm has had to engage an attorney, at what will ultimately be considerable expense, to delay or stop a new Basin Oil well, pro- posed to be drilled right in the middle of one of our most productive bluegrass sod fields. Can you imagine the reaction of the City of Greeley if an oil com- pany attempted to drill in the middle of a Highland Hills or Boomerang golf course fairway--or the reaction of the Greeley Country Club to such an attempt? I will not attempt to comment by line or section,since I strongly oppose these regulations as written,both conceptually and substantively. It is my belief that you have given in to the strong lobbying efforts of Dennis Hoshiko and others in the Front Range Land and Mineral Owners Association. One of you commented to me,following a hearing much earlier in the year, that no regulations seemed necessary at the County level. Nothing has changed for the worse in the meantime...only for the better. The Colorado Oil and Gas Conservation Commission (the "Commission") has greatly strengthened its Rules and Regulations, and has strictly enforced,including the levying of large fines,its various rules. COGA members have adopted a Code of Conduct. I have no objection to the County amending its ordinances to address such issues as distances that a building must be located relative to an existing well. This is a planning and land use function, and I support reasonable rules with which builders can comply. Your proposed regulations, however, are so duplicative of those of the Commission that you are begging for litigation. The City of Greeley recently lost over$350,000 of taxpayer money which could have been spent on badly needed park equipment. As a Weld County taxpayer, I object to any ordinance or regulation which will form the basis for costly litigation. I believe your proposed regulations do just that. If passed, these regulations are so burdensome that the end result would be the end of drilling in Weld County. Yes,the sky will fall...with disastrous effects on a County which is addicted to oil and gas tax revenue in a State where agriculture has been given preferential treatment (to a grossly unfair degree) over residential, business and industry ad valorem taxation. The oil and gas industry in Weld County has been roasted,with numerous factually incorrect articles, by the Greeley Tribune for many years. The current state of oil and gas industry bashing in Weld County can be, in my opinion, tied directly to poor journalism, not massive acts of operator irresponsibility as the paper would have us believe. The FRLMOA position regarding surface damages is novel at best, since it stems from mining, not oil and gas law. Yet FRLMOA and other organizations claiming to support its position have done much, apparently, to influence you. At the present time, there are only four operators active in the Weld County area. None is a major oil company, since all of the majors pulled out long ago. The others have all ceased drilling, gone out of business, or been acquired by larger companies. The regulations you propose would add substantially to the cost of drilling a well, yet would provide not one ounce of protection for anyone in Weld County except the job security of the Department of Planning Services. This result is certainly not in the public interest. The manner in which these regulations were written is a source of great personal disappointment. The oil and gas industry had absolutely no input, and now any change, no matter how small, is a ee_ fit; HI-) CA - 940339 concession on the part of the County. I can't imagine that you would fail to involve the agricultural community in the promulgation of rules so burdensome that farming would become greatly impacted or even uneconomic. The political pressure would have been overwhelming. Yet you did this with the oil and gas industry, which employs hundreds of persons (voters) in Weld County, and the political atmosphere among oil and gas industry employees is now not a pretty one. There has been substantial damage done to potable water through the application of fertilizers, herbicides and insecticides by farmers. Yet there are no County regulations regulating farmers use of chemicals to protect drinking water. Why not? Why are farmers not charged when they damage roads with trucks and equipment or soak a road with a circular sprinkler? Companies are charged (part of it voluntarily, as you will recall) a rig moving fee, which many of us believe to be discriminatory and therefore illegal. This has not been tested in court, but may well be now. It is amazing how angry people can get when their very livelihood is threatened. Previous desires to cooperate with local governments can disappear, and that is exactly what is happening. My business has been steadily declining as the number of operators in this County diminish, and I no longer have any reason not to draw a line in the political sand. I will oppose these regulations with every resource at my disposal, and I will politically not forget the manner in which my county representatives drafted, basically in secret, a set of poorly thought out regulations which are sure to be tested in court. In my opinion, and in the opinion of more than one outside attorney,you are exceeding the authority of a county to regulate oil and gas drilling, and I believe it to be intentional. I cannot imagine that the Weld County Attorney's Office has advised you that these proposed regulations will absolutely withstand judicial challenge. The Commission is the ONLY body empowered by the State to issue oil and gas drilling permits. They did not grant such powers to the Weld County Department of Planning Services or to the Board of County Commissioners. If you are not trying to regulate outside the scope of your authority, why is there attempted regulation of almost every item covered by existing Commission rules and regulations? Please reconsider your position on this whole matter, and seek to regulate only in the area of setbacks by landowners desiring to construct near oil and gas facilities (if even that is really necessary). Spend your time and effort on ways to mitigate the effect of the decline in ad valorem taxes which is absolutely guaranteed to occur, sooner than perhaps anyone thinks, in Weld County. Be true leaders and take a positive position toward the industry which provides tax money without which this County cannot function. It is sad, if agriculture is so important to this County, that it enjoys ad valorem and other tax breaks and subsidies which make anything given to the oil and gas industry, on any level, look minuscule. The first reason is that the proposed regulatory scheme is, to a large degree, preempted by state law and regulations. The second and far more important reason is that a regulatory scheme at the state level has been developing in the last two years for the purpose of dealing with the very problems and issues that are sought to be addressed by the County's proposed regulations. The Colorado Oil and Gas Conservation Commission, in an almost continuous rulemaking process over the past two years, has promulgated the following regulations and policies: • The Wattenberg Special Area Rules which establish surface owner notice and consultation requirements, which establish new requirements for fencing, soil removal and reserve pit use and which establish new reclamation requirements. It is important to note that these regulations were designed in large part to deal with oil and gas operations specific to Weld County. • Exploration and production waste rules which set forth detailed requirements for the operation and closure of pits; for the handling, treatment and disposal of E&P wastes; and for the venting or flaring of natural gas. These particular rules were adopted after almost two years of meetings between representatives of Colorado counties and the industry. During the past year, the makeup of the Commission's senior staff has changed almost completely. A new Director assumed his duties earlier this year. At about the same time, a new Deputy Director and a new Chief Engineer also were appointed. Not only has the morale improved noticeably within the Commission's staff, but it has become very clear that the new Director, Rich Griebling, intends to be very proactive in overseeing oil and gas activities within the State, particularly in the Wattenbere Special Area. It is to be noted that the makeup of the Commission itself also has changed recently. In the last several months, two new Commissioners have been appointed, both of whom have pointedly and directly concerned themselves with surface owner issues when deliberating the issuance of orders granting applications before the Commission. Finally, we especially direct your attention to Senate Bill 177 which was specifically designed to increase and expand the authority of the Colorado Oil and Gas Conservation Commission to regulate and to address improper practices. This bill, which is expected to become law, was developed through the cooperative efforts of local governments, the agricultural industry, environmental groups and the oil and gas industry. Giving the Colorado Oil and Gas Conservation Commission, its new Director and his staff the time and opportunity to implement this legislation is perhaps, more than any other, the single most important reason for Weld County j to promulgate oil and gas regulations at this time. In summary, RMOGA strongly opposes the enactment of any oil and gas regulatory scheme by Weld County at this time for the reason that the State's regulatory scheme, to be strengthened by new legislation and implemented by a new and concerned Director and his staff, will work.
