HomeMy WebLinkAbout930142.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN OIL AND GAS SUPPORT FACILITY (BRINEWATER DISPOSAL) IN THE A (AGRICULTURAL) ZONE DISTRICT - CONQUEST OIL COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 10th day of February, 1993, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Conquest Oil Company, 3400 West 16th Street, Suite 6L, Greeley, Colorado 80631, for a Site Specific Development Plan and Special Review Permit for an oil and gas support facility (brinewater disposal) in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SE; SE;, Section 8, Township 4 North, Range 64 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Dale Butcher, Vice President of Conquest Oil Company, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan Agricultural Policies. The proposal will not remove prime agricultural land from production. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. The uses which would be permitted will be compatible with the existing surrounding land uses which include agricultural production, and other oil and gas facilities. The uses which would be permitted will be compatible with the future development of the surrounding area as permitted by the existing zoning. d. The applicant has demonstrated a diligent effort has been made to conserve productive agricultural land in the locational decision for the proposed use. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for an oil and gas support facility (brinewater disposal) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Special Review activity shall not occur on site until the following is provided: a. A detailed diagram of the injection well which has been approved and permitted by the Oil and Gas Conservation Commission shall be submitted to the Weld County Environmental Protection Services Division for review and documentation. b. Evidence that the requirements of the U.S. Army Corps of Engineers have been met pursuant to Section 404 of the Clean Water Act. 930142 SPECIAL REVIEW PERMIT - CONQUEST OIL COMPANY PAGE 3 4. Prior to any injection of waste into the well, a copy of the drilling log must be submitted to the Weld County Environmental Protection Services Division. 5. Prior to pressure testing at the facility, the Weld County Environmental Protection Services Division shall be informed of the specific dates in order to observe the process. 6. Prior to commencement of the Special Use activity, the facility and injection well shall be reviewed and approved by the Colorado Oil and Gas Commission. 7. Prior to recording the Special Review Permit plat, a road maintenance and improvements agreement shall be approved by the Board of County Commissioners. The agreement shall address the application of calcium chloride along Weld County Road 46, from the site's west boundary to the intersection of Weld County Roads 46 and 53, and shall designate a restricted haul route on Weld County Road 46 to Weld County Road 53. The agreement shall be reviewed and may be amended to require paving one year after approval by the Board of County Commissioners, if the Board deems the pavement is necessary. Kirkmey r 930142 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS CONQUEST OIL COMPANY USR #996 1. The Site Specific Development Plan and Special Review Permit is for an oil and gas support facility (brinewater disposal) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. A manager, knowledgeable in operating an injection well, shall be on site when the facility is receiving waste. 4. A safe and adequate sewage disposal system shall be available on the facility premises. A vault system shall be acceptable. 5. A safe and adequate fresh water supply shall be available on the facility premises. 6. A 3-foot by 4-foot sign shall be posted at the entrance gate listing wastes accepted, hours of operation, and 24-hour emergency telephone numbers. 7. The name of the facility at which the filters will be disposed, and copies of any required analysis, shall be provided to the Weld County Environmental Protection Services Division. 8. No disposal of waste other than Class II, as defined by the Environmental Protection Agency is permitted. Any change from the approved Class II use would require an amendment to this Special Review Permit. 9. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 10. Fugitive dust shall be controlled on the site. 11. The haul route shall be Weld County Road 46 east to Weld County Road 53. No hauling shall be allowed on Weld County Road 46 west of the site to Weld County Road 49. 12. The facility/operation shall comply with the approved road maintenance and improvements agreement. 930142 DEVELOPMENT STANDARDS - CONQUEST OIL COMPANY PAGE 2 13. A spillage retention berm shall be constructed around each tank battery. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. The surface area within the tank battery berm shall be constructed of at least a 24-inch compacted or in- situ earthen materials or other low permeability materials, so as not to exceed a seepage rate of 1 x 10-7 cm/sec. The operator shall have available suitable evidence that a completed lining meeting these requirements is in place. 14. All chemicals stored on site shall be stored in locked buildings, on an impervious surface, provided manufacturer recommendations for safe storage and handling are in accord. In any event, manufacturer recommendations will take precedence. 15. Any required air emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health. 16. The surfaces around the disposal area shall be constructed of an impervious material and graded to insure that all spilled waste is contained within the unloading pad. 17. The facility shall be entirely fenced and maintain locking gates during periods when the facility is closed. 18. Any analysis of waste shall be forwarded to the Weld County Health Department, Environmental Protection Division. The Division reserves the right to require additional, more extensive monitoring at a later date. 19. The sludge pit shall be lined. The pit shall be constructed of fiberglass or alternative materials, provided that they are at least as durable and impervious as fiberglass. 20. The drainage pits located at each disposal pad shall be constructed of materials as required for the sludge pit. 21. The facility shall maintain compliance with the proposed Treatment and Disposal Methods for the Waste Materials Associated of Oil and Gas Exploration and Production Regulations. 22. This facility shall comply with the laws, standards, rules and regulations of the Air Quality Control Commission, the Water Quality Control Commission, the Hazardous Materials and Solid Waste Division, the Colorado Oil and Gas Commission, and any other applicable agency. 23. The facility shall accept waste from dawn to 10:00 p.m. only. 24. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 930142 DEVELOPMENT STANDARDS - CONQUEST OIL COMPANY PAGE 3 25. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 26. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 27. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 28. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 29. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 930142 HEARING CERTIFICATION DOCKET NO. 93-06 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN OIL AND GAS SUPPORT FACILITY (BRINEWATER DISPOSAL) IN THE A (AGRICULTURAL) ZONE DISTRICT - CONQUEST OIL COMPANY A public hearing was conducted on February 10, 1993 at 10:00 A.M. , with the following present: Commissioner Constance L. Harbert, Chairman Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Bruce Barker Planning Department representative, Lanell Adler Health Department representative, John Pickle Engineering representative, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice dated January 11, 1993, and duly published January 14, 1993, in the Windsor Beacon, a public hearing was conducted to consider the request of Conquest Oil Company for a Site Specific Development Plan and Special Review Permit for an oil and gas support facility (brinewater disposal) in the A (Agricultural) Zone District. Bruce Barker, Assistant County Attorney, made this a matter of record. Lanell Adler, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Dale Butcher, Vice President of Conquest Oil Company, represented the applicant and stated they operate 35 wells in Weld County. He said the property on which the brinewater facility is to be located is under purchase contract. Mr. Butcher said the new well will be drilled to 9,200' , with 2 buildings and 10 holding tanks on the site. He said the noise will only be one-half of the maximum allowable, and 20 to 30 loads of water will be trucked to the facility per day. Mr. Butcher explained that all tank batteries will be bermed, and the entire facility will be bermed. There will be a maximum of 400 barrels of oil on site. He said they will begin drilling immediately, and construction will begin as soon as building permits are received. Mr. Butcher said, in reference to Condition of Approval #7 which concerns a road maintenance and improvement agreement, that they would prefer to buy the road base and have the County lay and grade it. They would then apply magnesium chloride approximately three times per year. In reference to Development Standard #4 which requires a vault system for sewage disposal, Mr. Butcher said they would prefer portable toilets with a maintenance contract. Mr. Butcher also stated that Development Standard #23, concerning acceptance of waste during daylight hours only, would be too restrictive. He explained that the winter is their busiest time, and their competitors have no such restriction. Drew Scheltinga, County Engineer, said his original recommendation was to pave Weld County Road 46 east of Weld County Road 53, with hauling restricted from the west. He said the traffic counts on Road 53 were from 135 to 153 per day, with approximately 10% being trucks. The facility would add 20 to 30 trucks per day, which a gravel road will not support. Mr. Scheltinga noted that calcium chloride has its limits, and he does not feel it will support this level of traffic 365 days per year. He said with this extent of trucks, long term support is needed, and the cost of calcium may exceed the cost of paving. Mr. Scheltinga also noted that Road 53 is a major artery near Kersey. In response to questions of the Board, Mr. Scheltinga explained that the paving would probably require 3" of asphalt and 6" to 8" of basecourse; and Weld County would do the maintenance, with approximately 1,000' to be paved along the front of the site. In response to questions from Commissioner Harbert, Ms. Adler said the haul route could be restricted in the agreement to allow trucks to only go east, and the trucks coming from the west would have to use either Highway 34 or Road 44, which are both paved. John Pickle, Health Department representative, said the sewage disposal 930142 PLO SCO C. G.• PAL. RE: HEARING CERTIFICATION - CONQUEST OIL COMPANY PAGE 2 ordinance allows only septic and vault systems, with portable toilets being excluded except for temporary sites. After further discussion, Mr. Pickle said he is not aware of any dust complaints on the road; and in response to a question from Commissioner Hall, he said septic tank are usually pumped out and filled in after the site is abandoned. David Bates, surrounding property owner, asked what happens to the brine water 9,200' below the surface and how it is kept track of in the future. Cole Busha, owner of Cole's Water Service, Inc. , said he will be hauling water to the site, and he gave a brief background of similar facilities. He said there is such a high level of activity that the wait is two to three hours. Mr. Busha said this facility will reduce the traffic and congestion at other sites. He noted that limiting the hours of operation of Conquest will put them at a disadvantage because drilling takes place 24 hours a day. Mr. Busha answered questions of the Board and noted that other facilities operate either 24 hours per day or from 6:00 a.m. to 10:00 p.m. Ms. Swanson said the Planning Commission restricted the hours of operation to daylight hours; however, the staff has no problem with extending the hours. Mr. Butcher said the vault system is not a tremendous concern, and he asked Mr. Pickle to address the question concerning seismic activity. He said the traffic being restricted from the west on Road 46 is acceptable, and he noted the trucks will not be going over 15 miles per hour on the 700' foot stretch before they turn into the facility. Mr. Butcher said the trucks are not 18-wheelers, which will limit the dust, and most of the trucks will not be over 54, 000 pounds. He said they would like to try the magnesium chloride, which they think will be ten times less cost than paving. Commissioner Kirkmeyer noted that she read the trucks would weigh 85,000 pounds when full of water. Mr. Butcher said that would be approximately 10% of the trucks that would weigh that much, and the other 90% would weigh 54,000 pounds. Commissioner Webster questioned whether the Planning Commission had put a cap on the maximum number of users per day. Mr. Butcher said the maximum they anticipate would be 3000 barrels per day, which would be about 30 trucks per day. He said, however, if the demand dictated, they would enlarge the facility. Ms. Adler clarified they would need to amend the permit to enlarge, and 30 trucks per day is the limit as noted in their application. Commissioner Baxter suggested when they received their capacity, they would then need to close for the day. Commissioner Harbert questioned where the trucks hauling water would enter and wait, if there were a two or three hour wait. Mr. Butcher explained that they would be able to unload four trucks at one time, and there is adequate space for six trucks to wait. He noted that the trucks take only 15 minutes to empty. In response to a question from Commissioner Hall, Mr. Butcher said the treatments of chloride would be from $200 to $300 per treatment, which would be done quarterly, and he estimated the paving at $15,000 to do the entire 1000' and the access road. He said the nearest resident is 800' to the north on Road 53. After further discussion, Mr. Butcher said the initial cost for chloride would be about $1,500. Roger Knoph, Environmental Technical Services, said the chloride applications they have done in the past have satisfied the Health Department's dust abatement requirements, even with 200 to 300 vehicles per day. In response to a question from Chairman Harbert, Mr. Knoph confirmed the stabilization would be $1,500, then about three applications per year would be needed. Commissioner Baxter stated his concern of muddy conditions with the heavy trucks. Mr. Knoph said the road will seal over and have a high compaction with a good road base; therefore, the surface will stay hard. Commissioner Harbert said her understanding is that the chloride cannot be graded. Mr. Knoph said they can reapply after each grading. In response to a question from Commissioner Hall, Mr. Knoph said they will need material to build the road base, and they would like to pay the County to lay it. Mr. Scheltinga said the standard design procedures for structural value are 3" of pavement and 6" to 8" of basecourse, which is what will be needed to support this level of traffic. He said cost for 3" of magnesium chloride treated material will not be of value, because it will fail in severe weather, which will cause a continual major maintenance problem. Mr. Scheltinga estimated one-fifth of a mile would cost approximately $10, 000 to $15,000 to prepare and another $10,000 to $15,000 to pave. He estimated four applications per year of chloride over ten years would be $8,000, which would not include the cost of extra materials or equipment. 930142 RE: HEARING CERTIFICATION - CONQUEST OIL COMPANY PAGE 3 Mr. Scheltinga said it is a matter of paying the cost up front for paving or spreading it out over ten years for chloride applications. He said, however, the difference in service is going to be dramatically different. Mr. Scheltinga said in other similar projects, Weld County pays for basecourse and preparation, and the applicant pays for paving. In response to questions from the Board, Mr. Scheltinga said Weld County pays for long-term maintenance. He also said the road is not designed for overloads, which would increase the cost dramatically; however, the standard design should handle the truck traffic. Mr. Scheltinga said the low speed traffic will decrease the dust on a gravel road; however, the structure of a paved road is not affected by speed. Commissioner Webster said he does not want the County to have to do additional grading or provide preferential treatment for the facility. Mr. Scheltinga reiterated that if the road is paved, there will be no problems; however, if the chloride is used, there will be a continual on-going maintenance problem. Commissioner Hall questioned, since the road is not currently capable of handling the traffic, what the cost would be to bring the road up to standard. Mr. Scheltinga said the matter is a question as to the level of service. He explained that with this many trucks the same structural design for chloride versus pavement will not provide the same level of service. He reiterated that the chloride will probably cost more than paving in the long run. Mr. Pickle commented on seismic activity relative to injection wells. He said there are devices which can be installed to detect such activity; however, in areas where there are no faults or prior earthquake activity, they are not necessary. He said Amoco has an agreement with the School of Mines to detect activity for their facility. Ms. Adler said, per a geologist who was present at the Planning Commission meeting, there are no faults in this area. In response to a question from Commissioner Kirkmeyer concerning the explosion at Wright's Disposal, Mr. Pickle and Trevor Jiricek, Health Department, said it is a hazardous facility because of the petroleum in the brinewater. Mr. Pickle also stated he feels a notification of emergencies policy needs to be established. There was further discussion regarding the notification procedure, and Mr. Barker said the applicant should address requirements pursuant to the State for emergencies, and the Office of Emergency Management should notify County departments. Bruce White, representing the applicant, said they are aware of all State and Federal regulations which they need to meet. He said the two berms address spillage, and the well is located 150' to 200' from the facility for safety. He said the water is skimmed and recycled; therefore, nothing at the well is combustible. Mr. White noted that Wright's fire was in an open tank, and all of Conquest's tanks will be closed. He said the only danger of fire would be from the storage tank where there will be a small amount of oil. Mr. White submitted a Newsletter of the Rocky Mountain Association of Geologists, The OUTCROP, as Exhibit K for the record, concerning the Rocky Mountain Arsenal's seismic activity. John Benton, Engineer representing the applicant, reiterated that there are no faults in the area, and the there would be minimal seismic activity from the injection well. He explained the difference in the formations beneath the Rocky Mountain Arsenal and this facility. In response to a question of Chairman Harbert, Mr. Benton said there are zero chances of brinewater seeping below the 9,200' because the formation is capped and is not fractured. Mr. White said they would like to request that the chloride be used on a trial basis. He said the dust will not be extreme, they will pay for the additional material for the structure of the road, and treatments will be started. Mr. White said they will not ask for additional maintenance and will coordinate treatments with grading. He said if that does not work, then they will pave. Chairman Harbert stated a concern with heavy traffic and safety. After discussion, Ms. Adler said they can include in the road maintenance agreement that the matter will be reviewed in one year. In response to a question from Commissioner Baxter, Mr. Barker said the Board will make the final decision as to whether or not to pave. Mr. Scheltinga recommended if the chloride is done for a trial period, the grading should be the applicant's responsibility. He noted the chloride method is presently done only on low traffic areas, and during bad weather this area will fall apart. He reiterated that the applicant should be responsible for all maintenance. Chairman Harbert said the grading needs to be done to a certain standard to provide safety 930142 RE: HEARING CERTIFICATION - CONQUEST OIL COMPANY PAGE 4 for all other traffic, and Commissioner Webster said the applicant will coordinate with the grader. Mr. Scheltinga explained that the applicant will be having problems with their road at the same time the County is having problems with other roads. He also noted that the County will be cutting the applicant's cost by providing grading. After further discussion, Ms. Adler read proposed language for Condition of Approval #7 into the record. Mr. Barker suggested adding that the matter be reviewed by the Board and the Board should make the sole determination for paving or applications of chloride. Mr. Scheltinga said the applicant should be responsible for maintenance, and Weld County has the authority to require maintenance and treatment as needed. Commissioner Webster suggested extending the hours to 10:00 p.m. Chairman Harbert and Commissioner Kirkmeyer said they would prefer 8:00 p.m. After further discussion, Commissioner Webster moved to extend the hours of operation to 10:00 p.m. , and the motion was seconded by Commissioner Baxter. The motion carried three to two, with Chairman Harbert and Commissioner Kirkmeyer voting nay. Mr. Scheltinga recommended if the Board approves a trial period for one year, the applicant should be required to work out the final agreement, with the specifics to be discussed upon approval of said agreement. Commissioner Webster moved to amend Condition of Approval #7, and Ms. Adler read the language into the record. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. Commissioner Webster noted that the applicant had consented to a vault system as recommended by the Health Department, and he included said fact in his motion to approve the request of Conquest Oil Company for a Site Specific Development Plan and Special Review Permit for an oil and gas support facility (brinewater disposal) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Hall, and it carried unanimously. This Certification was approved on the 17th day of February, 1993. CASE NUMBER: USR-996 (Continued from January 19, 1993 regular meeting. ) APPLICANT: Conquest Oil Company REQUEST: A Site Specific Development Plan and a Special Review permit for an Oil and Gas Support Facility (Brinewater Disposal) in the A (Agricultural) zone district. LEGAL DESCRIPTION: Part of the SE4 SE4 of Section 8 , T4N, R64W of the 6th P.M. , Weld County, Colorado. LOCATION: On the north side of Weld County road 46 , approximately 450 feet west of Weld County Road 53 . Dale Butcher, representative, Conquest Oil Company, explained they operate 35 wells in Weld County and were established in 1984. This request for a Use by Special Review permit is for a commercial brinewater disposal facility. Approximately 4 acres will be permitted under the Use by Special Review. An injection well will be drilled 9,200 feet to the Lyons formation, a very thick porous non-productive zone. The facility will consist of two buildings and 10 holding tanks. Water deliveries will be accepted from dawn until 8:00 p.m. , and the facility will be manned during those hours. The facility will pump water up(nit -- •? E'h�b�� SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING February 2, 1993 Page 2 to 24 hours a day, if necessary. The noise level will be one-half the maximum allowable by the County and the water will be trucked to the facility in 20 to 30 truck loads a day. For safety, the entire facility will have a berm and all tank batteries will also be bermed. The maximum storage at any time on the premises will be 400 barrels. Dale Butcher said Conquest Oil appreciates the Planning Department' s recommendation for approval; however, they have concerns. Microseismic equipment can run up to $70,000. Conquest Oil believes this procedure is unnecessary due to the characteristics of the formation. Conquest Oil would like to enter into an agreement with the County to maintain the existing road instead of paving Weld County Road 46, as stated in the Planning Services' recommendation. Also, Conquest Oil feels the septic and water requirements in the recommendation are too extreme. They will have a maximum of one employee on the premises and feel a properly maintained portable toilet facility and bottled water for drinking purposes would be adequate. Bill O'Hare asked for an explanation of microseismic monitoring. John Benton, Registered Petroleum Engineer, Orbis Engineering, representative, Conquest Oil Company, explained they investigated the cost of installing a microseismic monitoring device. It measures the amount of seismic movement in a local area that would potentially result in any deep well injection into fault zones . They recommended against it because there aren' t any fault zones in the area or in the formation to which they plan to inject. Bill O'Hare asked John Pickle why this was a Health Department recommendation. John Pickle explained there have been two previous applications for two injection wells where this has been a recommendation. In this particular situation this is a recommendation, the Health Department stands by the recommendation, but would not necessarily require it. Don Feldhaus asked with 20 to 30 trucks coming into this facility what does Conquest Oil intend to do to provide them with restroom facilities and water services. Dale Butcher explained this facility will only be used for the employee. In an emergency situation Conquest Oil would allow outsiders , but for the most part no services would be provided. Bud Clemons asked how they could refuse services to the drivers. Dale Butcher said they could not completely refuse services but this facility would be maintained by a credible professional portable toilet supplier that would be on a schedule that would sufficiently handle the usage. Bud Clemons asked about the wetland below the ditch. Lanell Adler explained the U.S. Army Corps of Engineers reported on this and Conquest Oil redesigned their application due to the wetlands issue. Bud Clemons also questioned the dust abatement issue with 20 to 30 trucks traveling the road daily. Dale Butcher said they would operate 6 days a week. Don Feldhaus asked how many total employees would man the facility. Dale Butcher said they would hire two employees who would work shifts. Bill O'Hare asked about lights for the facility. John Benton said Conquest Oil would proved adequate lighting, probably mercury vapor. Bud Clemons was concerned about trucks traveling into the facility after dark. The Chairperson asked if there was anyone in the audience who wished to speak for or against this application. David Bates, surrounding property owner, said he lives 2-1/2 miles northeast of the proposed well. With the volume of injection being so high he is concerned about where the water is going and what it is going to do. He strongly recommends requiring microseismic monitoring. Don Feldhaus asked how close the recently submitted injection well is to this proposal. Lanell Adler said the other one is down near the City of Ft. Lupton. Don Feldhaus also wanted to know the life expectancy of the well and if there were other ways of monitoring the well. Dale Butcher said 8 to 10 years is the life expectancy of the well and the best indicator for monitoring is the injection pressure. Bud Clemons moved a new Development Standard be added to regulate deliveries to daylight hours only. "The facility will accept waste during daylight hours only" . Bill O'Hare seconded the motion. The Chairperson asked the secretary to poll the members of the Planning Commission for their decision. Judy Yamaguchi - has empathy for the company and their income, but is also concerned about the health and safety who live in the area, traffic wise. Bud Clemons - has concerns about the neighborhood. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s office within 15 days of approval by the Board of County Commissioners. 2. Evidence that the requirements of the U.S. Army Corps of Engineers have been met pursuant to Section 404 of the Clean Water Act. 4. Prior to any injection of waste into the well, a copy of the drilling log must be submitted to the Weld County Environmental Protection Services Division. 5. Prior to pressure testing at the facility, the Weld County Environmental Protection Services Division shall be informed of the specific dates in order to observe the process. 6. The Site Specific Development Plan and Special Review permit is for an Oil and Gas Support Facility (Brinewater Disposal) in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. A manager, knowledgeable in operating an injection well, shall be on- site when the facility is receiving waste. 4. A safe and adequate sewage disposal system shall be available on the facility premises. A vault system shall be acceptable. 5. A safe and adequate fresh water supply shall be available on the facility premises. 6. A 3-foot by 4-foot sign shall be posted at the entrance gate listing wastes accepted, hours of operation, and twenty-four hour emergency telephone numbers. 7. The name of the facility at which the filters will be disposed, and copies of any required analysis, shall be provided to the Weld County Environmental Protection Services Division. 8. No disposal of waste other than Class II, as defined by the Environmental Protection Agency is permitted. Any change from the approved Class II use would require an amendment to this Special Review permit. 9. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes . 10. Fugitive dust shall be controlled on the site. 11. The haul route shall be Weld County Road 46 east to Weld County Road 53. No hauling shall be allowed on Weld County Road 46 west of the site to Weld County Road 49. 12. The facility/operation shall comply with the approved road maintenance and improvements agreement. f"TA •ry DEVELOPMENT STANDARDS, USR-966 Conquest Oil Company Page 2 13. A spillage retention berm shall be constructed around each tank battery. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. The surface area within the tank battery berm shall be constructed of at least a 24-inch compacted or in-situ earthen materials or other low permeability materials, so as not to exceed a seepage rate of 1 x 10-7 cm/sec. The operator shall have available suitable evidence that a completed lining meeting these requirements is in place. 14. All chemicals stored on-site shall be stored in locked buildings, on an impervious surface, provided manufacturer recommendations for safe storage and handling are in accord. In any event, manufacturer recommendations will take precedence. 15. Any required Air Emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health. 16. The surfaces around the disposal area shall be constructed of an impervious material and graded to insure that all spilled waste is contained within the unloading pad. 17. The facility shall be entirely fenced and maintain locking gates during periods when the facility is closed. 18. Any analysis of waste shall be forwarded to the Weld County Health Department, Environmental Protection Division. The Division reserves the right to require additional, more extensive monitoring at a later date. 19. The sludge pit shall be lined. The pit shall be constructed of fiberglass or alternative materials, provided that they are at least as durable and impervious as fiberglass. 20. The drainage pits located at each disposal pad shall be constructed of materials as required for the sludge pit. 21. The facility shall maintain compliance with the proposed Treatment and Disposal Methods for the Waste Materials Associated of Oil and Gas Exploration and Production Regulations. 22. This facility shall comply with the laws, standards, rules and regulations of the Air Quality Control Commission, the Water Quality Control Commission, the Hazardous Materials and Solid Waste Division, the Colorado Oil and Gas Commission, and any other applicable agency. 23. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 25. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 26. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 27. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 28. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 29. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Special Review activity shall not occur on site until the following is provided: A detailed diagram of the injection well which has been approved and permitted by the Oil and Gas Conservation Commission shall be submitted to the Weld County Environmental Protection Services Division for review and documentation. A plan for microseismic monitoring. The plan shall be reviewed and approved by the Weld County Health Department. Evidence that the requirements of the U.S. Army Corps of Engineers have been met pursuant to Section 404 of the Clean Water Act. 4. Prior to any injection of waste into the well, a copy of the drilling log must be submitted to the Weld County Environmental Protection Services Division. 5. Prior to pressure testing at the facility, the Weld County Environmental Protection Services Division shall be informed of the specific dates in order to observe the process. 6. Prior to commencement of the special use activity, the facility and injection well shall be reviewed and approved by the Colorado Oil and Gas Commission. 7. Prior to recording the Special Review permit plat, a road maintenance and improvements agreement shall be approved by the Board of County Commissioners. The agreement shall address paving of Weld County Road 46 to Weld County Road 53 and shall designate a restricted haul route on Weld County Road 46 to Weld County Road 53. SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Conquest Oil Company USR-996 1. The Site Specific Development Plan and Special Review permit is for an Oil and Gas Support Facility (Brinewater Disposal) in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. A manager, knowledgeable in operating an injection well, shall be on- site when the facility is receiving waste. 4. An individual sewage disposal system is required for the proposed facility and the system shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 5. A safe and adequate fresh water supply shall be available on the facility premises. 6. A 3-foot by 4-foot sign shall be posted at the entrance gate listing wastes accepted, hours of operation, and twenty-four hour emergency telephone numbers. 7. The name of the facility at which the filters will be disposed, and copies of any required analysis, shall be provided to the Weld County Environmental Protection Services Division. 8. No disposal of waste other than Class II, as defined by the Environmental Protection Agency is permitted. Any change from the approved Class II use would require an amendment to this Special Review permit. 9. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 10. Fugitive dust shall be controlled on the site. 11. The haul route shall be Weld County Road 46 east to Weld County Road 53. No hauling shall be allowed on Weld County Road 46 west of the site to Weld County Road 49. 12. The facility/operation shall comply with the approved road maintenance and improvements agreement. DEVELOPMENT STANDARDS, USR-966 Conquest Oil Company Page 2 13. A spillage retention berm shall be constructed around each tank battery. The volume retained by the spillage berm shall be greater than the volume of the largest tank inside the berm. The surface area within the tank battery berm shall be constructed of at least a 24-inch compacted or in-situ earthen materials or other low permeability materials, so as not to exceed a seepage rate of 1 x 10-7 cm/sec. The operator shall have available suitable evidence that a completed lining meeting these requirements is in place. 14. All chemicals stored on-site shall be stored in locked buildings, on an impervious surface, provided manufacturer recommendations for safe storage and handling are in accord. In any event, manufacturer recommendations will take precedence. 15. Any required Air Emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health. 16. The surfaces around the disposal area shall be constructed of an impervious material and graded to insure that all spilled waste is contained within the unloading pad. 17. The facility shall be entirely fenced and maintain locking gates during periods when the facility is closed. 18. Any analysis of waste shall be forwarded to the Weld County Health Department, Environmental Protection Division. The Division reserves the right to require additional, more extensive monitoring at a later date. 19. The sludge pit shall be lined. The pit shall be constructed of fiberglass or alternative materials, provided that they are at least as durable and impervious as fiberglass. 20. The drainage pits located at each disposal pad shall be constructed of materials as required for the sludge pit. 21. The facility shall maintain compliance with the proposed Treatment and Disposal Methods for the Waste Materials Associated of Oil and Gas Exploration and Production Regulations. 22. This facility shall comply with the laws, standards, rules and regulations of the Air Quality Control Commission, the Water Quality Control Commission, the Hazardous Materials and Solid Waste Division, the Colorado Oil and Gas Commission, and any other applicable agency. 23. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 28. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. We have received a revised site plan which shows two entrances at either edge of the property. The two entrance site plan is not acceptable because trucks will be exiting and entering on Weld County Road 46 at steep angles which will reduce visibility. In the original site plan truck turning will be done on the site and trucks will enter and exit at right angels to Weld County Road 46. Also, the addition of a second entrance doubles the maintenance problems associated with entrances such as drainage restrictions and culvert cleaning. Item 13 in the application materials addresses storm water from the standpoint of regulations that are administered by the Health Department. I am reviewing drainage from the standpoint of increased runoff due to development. That aspect was not addressed in Item 13, however, the plans indicate an earth berm is to be built around the equipment. If that berm will retain storm water within that area, increased runoff would be adequately addressed. Weld County Road 46 is a gravel road that is not capable of supporting the estimated twenty to thirty trucks a day anticipated by the applicant. Weld County Road 46 will have to be improved, including paving, from Weld County Road 53 to the site. An individual sewage disposal system, is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 3. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 4. A safe and adequate fresh water supply shall be available on the facility premises. 5. A detailed diagram of the injection well which has been approved and permitted by the Oil and Gas Commission must be submitted to the Weld County Environmental Protection Division for review and documentation. 6. A 3-foot by 4-foot sign shall be posted at the entrance gate listing wastes accepted, hours of operation, and twenty-four hour emergency telephone number. 7. The facility at which the filters are intended to be disposed, must be provided to the Weld County Environmental Services Division, including copies of any required analysis. 8. Maximum permissible noise level shall not exceed the industrial limit of 80db(A) , as measured according to 25-12-102, Colorado Revised Statutes. 9. No disposal of waste, other than Class II, as defined by the Environmental Protection Agency is permitted. Any change from the approved Class II use would require an amendment to this Special Review Permit. 10. Fugitive dust must be controlled on this site. 11. A spillage retention berm shall be required around each tank battery. The volume retained by the spillage berm should be greater than the volume of the largest tank inside the berm. en Oh a . 12. PROPOSED USE: Conquest Oil Company (Conquest) has a pending purchase contract, contingent on receipt of all necessary permits, for property in Weld County (Eight acres in the SE/4 SE/4, Sec. 8, T4N, R64W, 6th P.M.). Approximately four acres of the property will be used for a facility for disposal of water that is produced with oil and/or gas as part of normal operation of such oil and gas wells. The facility, hereafter the "Facility", will be used to treat, filter and separate produced water so that it can be injected into a well by means of a reciprocating pumping unit. An application for a permit from the Colorado Oil and Gas Conservation Commission is being prepared at this time. The well will be drilled to the Wolfcamp formation with an approximate total depth of 9,200 feet. The Facility will have water storage/separation tanks in containment berms as well as three skid mounted buildings that will house pumps and filters for water treatment before injection and provide office space. The wellhead will be located more than 150 ft. away from the skid mounted buildings. The property will remain in compliance with the existing agricultural zoning restrictions. 2. NEED FOR USE: Currently oil and gas producers use several commercial facilities such as Roggen, Wright's, and Northern Colorado Brine and to dispose of production water. The nearest such facility to the proposed Conquest site is approximately fifteen (15) miles. Given the number of existing oil and gas wells and the high level of drilling activity in the vicinity, a closer disposal facility is in demand. 3. EXISTING USES ON SURROUNDING PROPERTIES: All surrounding areas are zoned for agriculture and there are eight residential dwellings within approximately one-half (1/2) mile of the Facility. The proposed facility is surrounded by farmland. 4. DISTANCE TO RESIDENTIAL STRUCTURES IN EACH DIRECTION: The nearest residence to the facility is approximately 800' north. The nearest home to the south is 1000 ft. away and the closest residence to the west is 3/8 mi. There are no homes within 1/2 mile to the east. 5. MAXIMUM NUMBER OF USERS: The expected normal operation of the Facility will be 20-30 (80-130 Bbls. ea.) water trucks a day. 6. NUMBER OF EMPLOYEES AND HOURS OF OPERATION: It is anticipated that there will be an employee on site while water deliveries are accepted. Hours of delivery will be dawn to 8:00 p.m. The facility will be automated and dispose of produced water 24 hours a day, 7 days a week. When the facility is not manned it will be secured with locking gates. 7. WATER SOURCE FOR PROPOSED USE: Since the Facility will have only one employee on site, a fresh water source is not necessary. The employee will be required to bring a container of fresh water, for personal use, to the site daily. Fresh water will be trucked in and used to control any dust problems around the delivery and access points to the Facility. Since the entry point to the Facility and the truck turnaround will be graveled, dust problems will be minimal. f; 8. ACCESS ROUTE TO BE UTILIZED FOR THE PROPOSED USE: All access to the Facility will be from Weld County Road 46 into a single driveway for entry and exit. 9. TYPE, SIZE, WEIGHT AND FREQUENCY OF VEHICULAR TRAFFIC: Vehicular traffic will consist of 80-130 barrel capacity water trucks with approximate gross vehicle weight of 85,000#each when full of water. The estimated number of vehicles a day is twenty to thirty (20-30). 10. SEWAGE FACILITIES: There will be no sewage facilities for the proposed site. A portable toilet will be placed on site and will be maintained by a professional service company. 11. FIRE PROTECTION MEASURES: There are no plans for any additional structures at the Facility. Fire extinguishers will be placed at strategic locations on the premises. 12. TYPE AND SIZE OF ANY WASTE, STOCKPILE OR STORAGE AREAS: There will be no stockpiling of any waste on the Facility. Storage/separation steel tanks (8) will be used to hold the produced water until it is disposed down the wellbore. A steel condensate tank (1 - 300 Bbl.) will be used to store any oil that is separated from the produced water. These tanks will be periodically cleaned as required. As a result of the filtering process for the water, bacterial residue and particulates will be accumulated. The waste will be disposed of offsite at an approved disposal facility. Chemical treating of the produced water is necessary to protect above ground equipment and wellbore material from corrosive elements. These chemicals will be stored onsite in 55 gallon drums surrounded by a containment berm. 13. STORM WATER RETENTION FACILITIES: A stormwater construction discharge permit is not required as the site is less than five (5) acres. The site would also be exempt from the Heavy Industrial Stormwater Discharge Permit until or unless a reportable spill of oil or water or other chemicals occurs during a storm runoff event. Therefore, there is no scheduled installation of storm water retention facilities for the water disposal site. If runoff occurs it will tend toward the southeast end of the site. 14. TIME SCHEDULE AND METHOD OF REMOVAL AND DISPOSAL OF DEBRIS, JUNK AND OTHER WASTES: Waste will come as a direct result of water filtration. This waste (bacterial residue and particulates) will be stored and transported to an approved waste disposal site. Any other waste material will be disposed of by the use of trash bins and hauled away on an as-needed basis. 15. LANDSCAPING AND EROSION CONTROL: Aesthetically pleasing landscaping will be accomplished by the planting of trees along the east side of the property. The tanks and buildings will be painted tan to blend in with the natural environment surrounding the facility. RECLAMATION PROCEDURES TO BE EMPLOYED UPON CESSATION OF THE USE BY SPECIAL USE ACTIVITY: Reclamation of the Facility area will be the return of the area to farmland in the event the area is abandoned. Equipment, and tanks, will be dismantled and removed upon abandonment of the Facility. The well will be plugged and abandoned in accordance with COGCC Rules and Regulations. 17. TIME TABLE FOR CONSTRUCTION AND START-UP: The disposal well for the Facility will be drilled and completed upon receipt of use by special review permit. It is estimated, after receipt, a time of 6 weeks (weather permitting) is necessary for the drilling, completion, equipment installation and start-up. 18. STATEMENT RE: WELD COUNTY COMPREHENSIVE PLAN The proposed use is consistent with the Weld County Comprehensive Plan for the following reasons: A. The Facility is designed to be an environmentally preferred produced water disposal option versus what is presently available (evaporation pits, etc.). B. The traffic impact will be acceptable since established, well-maintained, paved and gravel roads will be used to access the Facility. A posted speed limit for vehicles will be enforced by Conquest to ensure the safety of surrounding areas. C. The Facility is consistent and compatible with oil and gas development and facilities throughout the area, including wells, pipelines, tanks batteries and other disposal facilities. The Comprehensive Plan allows for mineral owners and lessees to have the right to develop their property. D. The facility will only be visited during the hours of dawn to 8:00 p.m. for delivery and maintenance purposes. 19. CONSISTENCY WITH THE INTENT OF THE DISTRICT: The proposed use is consistent with the intent of the Agricultural Zoning District. The site location is small and will have little impact on the surrounding farmland and is in a relatively unpopulated area. EFFORTS TO CONSERVE AGRICULTURAL LAND: The site for the Facility was chosen because it is near existing oil and gas production surface equipment and a paved county road. Any negative impact to the surrounding agricultural areas is considered minimal. 21. PROVISIONS FOR THE PROTECTION OF HEALTH, SAFETY & WELFARE OF THE NEIGHBORHOOD: A six-foot chain link security fence will be installed on the site to prevent any harm to either livestock or unauthorized personnel. If emergency assistance is needed, the site is serviced by the Platte Valley Fire District. A containment berm will be installed to contain any spillage that would occur in the tank battery and chemical storage area. 22. COMPATIBILITY WITH EXISTING SURROUNDING LAND USES: As stated above, the Facility is compatible with the other oil and gas development in the immediate area and throughout Weld County. The primary use of the surrounding land is agricultural, and the Facility will have minimal impact on such agricultural activities. 23. FUTURE COMPATIBILITY WITH SURROUNDING AREA: The long-range future uses of the surrounding areas is likely to be agricultural and mineral development. 24. FLOOD PLAIN, GEOLOGIC HAZARD, AIRPORT OVERLAY: The facility is not located in a flood plain (Panel #080266-0775C dated September 28, 1982), geologic hazard or airport overlay. 25. PROOF OF WATER SUPPLY: No fresh water supply is required for the Facility because the lone employee on the site will provide the small quantities of water necessary on a daily basis. 26. COPY OF DEED: Conquest's contract to purchase the property is attached hereto. 27. NOISE REPORT: The Facility's power and pumping equipment will be housed in buildings and noise levels will be less than 70 decibels. The nearest residence is approximately 800 feet to the north. The Gilmore Ditch is between that residence and the facility and will serve as a noise buffer. 28. SOIL REPORT: A description of the soil types from the Soil Conservation Service is enclosed herewith. SITE SOILS Excerpted from Soil Survey of Weld County. Colorado Southern Part United States Department of Agriculture Soils Conservation Service. 4. Aquolls and Aquepts, flooded. This nearly level map unit is in depressions in smooth plains and along the bottoms of natural drainage ways throughout the survey area. Aquolls, which have a dark colored surface layer, make up about 55 percent of the unit. Aquepts, which have a lighter colored surface layer, make up about 25 percent. About 20 percent is soils that are well drained and soils that have sandstone or shale within 48 inches of the surface. These are deep, poorly drained soils that formed in recent alluvium. No one pedon is typical. Commonly the soils have a mottled, mildly to moderately alkaline loamy or clayey surface layer and underlying material that extends to a depth of 60 inches or more. In places they have a gleyed layer in the underlying material. Most of the acreage is subject to excessive runoff. The water table is at or near the surface in spring and during the peak of the irrigation season. These soils are used for rangeland and wildlife habitat. Some small areas are irrigated pasture. The potential native vegetation is dominated by switchgrass, prairie cordgrass, saltgrass, alkali sacaton, big bluestem, indiangrass, western wheatgrass, slender wheatgrass, sedge, and rush, Cattails and bullrush grow in the swampy spots associated with these range sites. Potential production ranges from 4,000 pounds per acre in favorable years to 3,000 pounds in unfavorable years. As range condition deteriorates, the tall and mid grasses decrease, production drops, and saltgrass, sedge, and rush increase. The farming and irrigation in adjacent areas has increased the amount of salts on much of the acreage. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Swithcgrass, big bluestem, indiangrass, western wheatgrass, pubescent wheatgrass, intermediate wheatgrass, tall wheatgrass, and tall fescue are suitable for seeding. The plants selected should meet the seasonal requirements of livestock. For successful seeding, a firm prepared seedbed in needed. A grass drill should be used. seeding early in spring has proven most successful. Tillage is needed to eliminate the undesirable vegetation. Wetland wildlife, especially waterfowl, utilize this unit. The wetland plants provide nesting and protective cover as well as some food. The nearby irrigated cropland, where wildlife obtain much of their food and fmd protective cover, makes this unit valuable to both wetland and openland wildlife.
