HomeMy WebLinkAbout930578.tiff RESOLUTION RE: APPOINTMENTS TO THE LOCAL JUVENILE SERVICES PLANNING COMMITTEE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, as Section 19-2-1602.7 of House Bill 93-134 provides that a local juvenile services planning committee which shall be appointed by the chief judge of the judicial district from persons recommended by the board of commissioners of each county within the judicial district and the committee, if practicable, shall include but not be limited to a representative from the county department of social services, a local school district, a local law enforcement agency, a local probation department, the division of youth services, private citizens, the district attorney's office, and the public defender's office, and a community mental health representative of the concerns of municipalities, and WHEREAS, House Bill 93-134 provides that the committee, if created, shall meet as necessary to develop a plan for the allocation of resources for local juvenile services within the judicial district for the fiscal year, and WHEREAS, the Board of County Commissioners of Weld County and the Chief Judge of the Judicial District have agreed to create said Local Juvenile Services Planning Committee, and WHEREAS, the following agencies and person have been proposed: AGENCY NAME TITLE County Government Constance Harbert Commissioner District Court L. BE IT FURTHER RESOLVED by the Board that the above representation on the committee be, and hereby is, established. Box 758 Greeley, Colorado 80632 Dear Commissioner Harbert: During the recent session of the Colorado General Assembly, the legislature enacted Senate Bill 93-134. It is expected that Governor Romer will sign this bill into law shortly. This letter is to advise you of the specific provisions in the new law to be administered by the Division of Youth Services which will directly benefit your county and your judicial district. The new provisions are enabling legislation for implementing Senate Bill 91-94, which allocates funding from the state to communities for the development of local alternatives to the placement of delinquent youth in state detention and institutional treatment facilities. This follows successful pilot programs which were instituted in eleven counties in 1992. The new legislation will now provide for funding of similar programs in all of the judicial districts in Colorado. The formal planning process will be outlined to the Chief Judge in your judicial district by the DYS-Regional Director with the Chief Probation Officer in the next few weeks. I am asking your help in nominating representatives from your county for appointment by your Chief Judge to the local Juvenile Services Planning Committee in your judicial district. This group will develop the local service plan for utilizing the resources allocated by the state. The committee is established in the law as follows: 19-2-1602 .7 IF ALL OF THE BOARDS OF COMMISSIONERS OF EACH COUNTY OR THE CITY COUNCIL OF EACH CITY AND COUNTY IN A JUDICIAL DISTRICT AGREE, THERE SHALL BE CREATED IN SUCH JUDICIAL DISTRICT A LOCAL JUVENILE SERVICES PLANNING COMMITTEE WHICH SHALL BE APPOINTED BY THE CHIEF JUDGE OF THE JUDICIAL DISTRICT FROM PERSONS RECOMMENDED BY THE BOARDS OF COMMISSIONERS OF EACH COUNTY OR THE CITY COUNCIL OF EACH CITY AND COUNTY WITHIN THE JUDICIAL DISTRICT. THE COMMITTEE, IF PRACTICABLE, SHALL INCLUDE BUT NOT BE LIMITED TO A REPRESENTATIVE FROM THE COUNTY DEPARTMENT OF SOCIAL 930`15, 78 SERVICES, A LOCAL SCHOOL DISTRICT, A LOCAL LAW ENFORCEMENT AGENCY, A LOCAL PROBATION DEPARTMENT, THE DIVISION OF YOUTH SERVICES, PRIVATE CITIZENS, THE DISTRICT ATTORNEY'S OFFICE, AND THE PUBLIC DEFENDER'S OFFICE AND A COMMUNITY MENTAL HEALTH REPRESENTATIVE AND A REPRESENTATIVE OF THE CONCERNS OF MUNICIPALITIES. THE COMMITTEE, IF CREATED, SHALL MEET AS NECESSARY TO DEVELOP A PLAN FOR THE ALLOCATION OF RESOURCES FOR LOCAL JUVENILE SERVICES WITHIN THE JUDICIAL DISTRICT FOR THE FISCAL YEAR. SUCH PLAN SHALL BE APPROVED BY THE DEPARTMENT OF INSTITUTIONS. The Division of Youth Services, through the regional directors, will be available to provide technical assistance to the local planning committees. The DYS-Regional Director will also be available to address any of your questions or concerns.
