RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1402 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1402, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1402 was submitted by David R. and Lee Ann Heldt for property which is located in part of the S₹ of the NW* of Section 18, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 5.3 acres and 5 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. COLORADO April 1, 1992 Board of County Commissioners Weld County Centennial Complex 915 Tenth Street Greeley, CO 80631 Subject: Recorded Exemption 1402 Dear Commissioners: This request for a recorded exemption is submitted by David R. and Lee Ann Heldt. The parcel of land on which this request is being made is described as part of the S2 of the NW4 of Section 18, TEN, R67W of the 6th P.M. , Weld County, Colorado. The property is located north of Weld County Road 68 1/2, southwest of Weld County Road 13. The request is to divide a 10.3 acre parcel of land, which is the total contiguous land holdings of the applicants, into two lots of 5.3 and 5 acres, more or less. It is the opinion of the Department of Planning Services' staff that this application should be denied. This 10 acre parcel is a portion of Lot B of Recorded Exemption 278 approved in 1977. Recorded Exemption 278 created a 2.687 acre parcel and a 77 acre parcel, more or less. In 1982, Recorded Exemption 535 further divided Lot B of Recorded Exemption 278 creating a new Lot B comprised of 17.473 acres. In 1986, the 17.473 acre lot, which was Lot B of Recorded Exemption 535, was divided by Recorded Exemption 878, creating two new lots of 10.319 acres and 7.154 acres. This request i to divide the 10.319 acre parcel into two new lots. There currently exist fi building site where one existed prior to 1977. Approval of this request would create a s1 h building site. The staff is concerned about the level of development that has occurred in this area and the potential for continued divisions. The Board should consider whether it wants to allow this type of piecemeal development to continue. Continued divisions may evade the intent and purpose of the Weld County Subdivision Regulations. Residential development in rural areas necessitates an increased demand for road maintenance, police and fire protection, school busing, snow removal, utilities, and other urban services. We would like to divide our property into two lots because David ' s in-laws will move on said property. They are an elderly couple who will help with our small calf operation (presently 32 head ) when we have to be out of town. We raise baby calves up to about 300 or 400 hundred pounds . Baby calves need alot of attention . This operation is Lee Ann 's only source of income . In the future we would like the option of retiring on the property without the livestock setup. 5 . This proposal is consistent with the policies of the Weld County Comprehensive Plan . 6 . This proposal is consistent with the intent of the agricultural zoning in which it is located . The land is presently a pasture ground . In the summer and fall we graze calves on it . The property is not prime farm ground . There is a well, but it cannot produce enough water to raise any kind of good crop on it . It would remain pasture ground except where the house is located . 7. The property will be used for a single family dwelling. This will enable us to leave when necessary the existing calf operation. The remaining ground will be pasture as it has in the past . The surrounding areas consist of a large dairy with prime farm ground, pasture ground in which we have also rented for grazing livestock, and a few small acreage lots . 8 . Although there are subdivisions and the Town of Windsor within a 3 mile radius, we see the property remaining basically agricultural with the set up that is in existance . 9 . The proposal is consistent with eficient and orderly development . Weld County road 13 borders one side of it and the No . 2 Irrigation Canals also borders it . 10 . The property has access to North Weld water . See attached letter from North Weld Water District . A septic type sewage disposal method is proposed as used in surrounding area homes . 11 . The property is not located in a flood zone or geologic hazard or in the Weld County Airport overlay district . 12 . We feel that by dividing the property and allowing family coverage of our livestock will be an asset to us . We are only using pasture and not prime farm ground .
