RE: APPROVE AUTHORIZATION FOR PEST INSPECTOR TO HAVE DUTCH ELM
DISEASED TREE REMOVED
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Pule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Pest Inspector has advised the Board that Larry
and Helen Magnuson, owners of certain property located at 20915
Weld County Road 54 , being more particularly described as the Ei
SE} of Section 21 , Township 5 North, Range 65 West of the 6th
P.M. , Weld County, Colorado, has been notified by letter that a
tree infected with Dutch Elm Disease has been found on said
property, and
WHEREAS, the owners have been contacted several times
concerning the removal of the infected tree, including a ten-day
notice which was mailed on September 13 , 1990 , and
WHEREAS , the Pest Inspector has requested that the Board
authorize him to have said Dutch Elm diseased tree removed from
the property, and
WHEREAS, after study and review, the Board deems it advisable
to authorize the removal of said tree , pursuant to 35-4-107 (1) ,
CRS, with the owners being responsible for the expense of the
removal.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Pest Inspector
be, and hereby is, authorized to have said Dutch Elm diseased tree
removed.
BE IT FURTHER RESOLVED by the Board that the owners of the
hereinabove described property be responsible for the expense of
the removal of the Dutch Elm diseased tree on their property.

The above and foregoing Resolution was, on motion duly made

Dear Weld County Commissioners:
I am seeking your approval under the Pest Control Law, CRS
35-4-107(1) , to enter upon the land listed below, to remove a Dutch elm
diseased tree. The diseased tree is located at:
Larry & Helen Magnuson
T51\1 R65W SEC 21 E2 SE4

I personally contacted the landowner on August 15, 1990, concerning.
the diseased tree. At that time he said he would have the tree removed.
On September 13th, I sent a 10-day notice requiring the removal of the
tree. He again called and said he would have the tree removed. As of
today, no action has been taken by the landowner. If this tree is allowed
to stand it will be a source of infection for other elm trees in Northern
Weld County. I wish to have this tree removed at the landowners expense,
pursuant to CRS 35-4-107(3) .
