RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW
PERMIT FOR LAND APPLICATION OF COMMERCIAL SLUDGE - LIQUID
WASTE MANAGEMENT, INC. , AND MARIE LOUISE GOLLNER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 14th day of March, 1990 , at the hour of 10 : 00 a.m.
in the Chambers of the Board for the purpose of hearing the
application of Liquid Waste Management, Inc. , and Marie Louise
Gollner, 900 Coffman Street, Suite D, Longmont, Colorado 80501,
for a Site Specific Development Plan and Special Review Permit for
land application of commercial sludge on the following described
real estate, to-wit:
Part of the N; and N§ SEA , Section 27 ,
Township 4 North, Range 67 West of the 6th
P.M. , Weld County, Colorado
WHEREAS, said applicants were represented by Roger Bohannan,
of Liquid Waste Management, Inc. , and
WHEREAS, Section 24 .4 .2 of the Weld County Zoning Ordinance
provides standards for review of said Special Review Permit, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the applicants and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2 . It is the opinion of the Board of County Commissioners
that the applicants have shown compliance with Section
24 .4 .2 of the Weld County Zoning Ordinance as follows:
a. This proposal is consistent with the Weld County
Comprehensive Plan' s Environmental Quality and
Natural Resource Goals and Policies, Transportation
Goals and Policies, Urban Growth Boundary Area
Goals and Policies, and the Agricultural Goals and

Policies. The Weld County Comprehensive Plan Urban
Growth Boundary Area Goals encourage the
maintenance of urban growth boundary areas that
provide an official definition between future urban
and agricultural land uses. The proposed use is
not considered to be an urban type development.
The Agricultural Goals and Policies of the Weld
County Comprehensive Plan encourage the location of
agricultural businesses and industries in areas
that minimize the removal of prime agricultural
land from production. The location of the Special
Review Permit site and the attached Conditions and
Development Standards will ensure consistency with
the goals and policies of the Weld County
Comprehensive Plan.
b. The proposed use is consistent with the intent of
the Agricultural Zone District and is provided for
as a Use by Special Review. This proposal will not
remove prime agricultural land from production.
c. The use will be compatible with the existing
surrounding land uses and with the future
development of the surrounding area as permitted by
the existing zoning . The surrounding land uses
include farm production, oil and gas production,
and rural residences.
d. No overlay districts affect the site.
e. Special Review Development Standards will provide
adequate protection of the health, safety, and
welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the application for a
Site Specific Development Plan and Special Review Permit for land
application of commercial sludge on the hereinabove described
parcel of land be, and hereby is, granted subject to the following
conditions:
1 . The attached Development Standards for the Special
Review Permit shall be placed on the Special Review plat
prior to recording the plat. The plat shall be
delivered to the Department of Planning Services and be
ready for recording in the office of the Weld County
Clerk and Recorder within 15 days of approval by the
Board of County Commissioners.

2 . The Special Review activity shall not occur nor shall
any building or electrical permits be issued on the
property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and
Recorder.
3 . The operator shall submit the following to the Weld
County Health Department on or before January 1st of
each year for review and approval:
a. A written report on the application methods and
rules.
b. The total number of dry pounds of sludge applied
per acre per year.
c. The grade of the sludge applied.
d. Evidence that the sludge meets stability criteria
established by the Colorado Department of Health.
e. A screen analysis of the sludge.
4 . Prior to recording the Special Review Permit plat, a
Road Maintenance Agreement for the haul route from the
Special Review Permit site north to the paved portion of
Weld County Road 19 shall be submitted to the Weld
County Engineering Department for review and approval by
the Board of County Commissioners.
5 . This Special Review Permit shall automatically expire 3
years from the date of approval by the Board of County
Commissioners as indicated in Paragraph 1 of the letter
dated November 6 , 1989 , to Wes Potter, Weld County
Health Department, from Roger Bohannan, Liquid Waste
Management.
6 . Prior to recording, the Special Review Permit plat shall
be amended to show all areas having slopes of 6% or
greater.

1. The Site Specific Development Plan and Special Review Permit
is for land application of liquid sludge as submitted in the
application materials on file in the Department of Planning
Services and subject to the Development Standards stated
herein. This Special Review Permit shall automatically
expire three years from the date of approval by the Board of
County Commissioners.
2 . Approval of this plan may create a vested property right
pursuant to Article 68 of Title 24 , C.R.S. , as amended.
3 . Waste oil, antifreeze, and other associated liquid and solid
wastes, shall be stored and removed for final disposal in a
manner that protects against surface and groundwater
contamination.
4 . No permanent disposal of wastes other than approved sludge
shall be permitted at this site.
5 . The operator shall handle and dispose of sludge in a manner
that controls fugitive dust, blowing debris , odor, and other
potential nuisance conditions.
6. Ground water monitoring shall not be required until the
sludge, soil, or plant tissue analysis indicates a
significant adverse change or impact.
7 . Sludge shall be incorporated into the ground within four
hours of application.
8 . Odor shall not exceed the 7 : 1 dilution/threshold according to
Regulation #2 of the Colorado Air Quality Control
Regulations.
9 . The application rate of the sludge shall not exceed one dry
ton per acre.
10 . No livestock shall be allowed to graze on the field within 30
days after sludge application.
11 . No surface runoff shall occur during sludge application.

12 . No on-site storage of sludge shall occur at the Special
Review Permit site.
13 . Sludge shall be applied only during dry weather periods upon
unsaturated, nonponding areas, and no sludge shall be applied
to areas of the site having slopes of 6% or greater.
14. The sludge shall undergo analysis for total solids, volatile
solids, volatile solids reduction, pH, organic, ammonia,
nitrate, nitrogen, total phosphorus , total potassium,
cadmium, copper, lead, nickel , zinc, and PCB' s prior to
application in the second and third years .
15 . The soil shall be analyzed for pH, total ammonia, nitrate,
total phosphorus, conductivity, cadmium, copper , lead,
nickel , zinc, soil texture, cation exchange capacity, organic
matter, and available phosphorus prior to sludge application
in the second and third years and one year following the
final sludge application.
16 . Plant tissue monitoring shall be conducted for total
nitrogen, nitrate, total phosphorus, cadmium, copper , lead,
nickel, and zinc within one month following sludge
application after the first, second, and third years of
sludge application.
17 . If the sludge analyses, soil analyses, or plant tissue
analyses indicate significant adverse changes , the applicant
shall notify the Weld County and State Health Departments in
writing within 7 days to reevaluate the rate and frequency of
sludge application.
18 . Results of the sludge analyses, soil analyses, and plant
tissue analyses shall be submitted to the Greeley Soil
Conservation District, Weld County Health Department, and the
State Health Department within 60 days following sampling.
19. No crop from this site shall be used for direct human
consumption.
20 . Soil moisture tests shall be conducted during crop production
to determine the appropriate irrigation times and rates to
mitigate excessive soil moisture, water percolation, and
runoff.
21 . No transfer/off-loading operations shall be conducted within
60 feet of a County road.

22. All construction on the property shall be in accordance with
the requirements of the Weld County Building Code Ordinance.
23. The property owner or operator shall be responsible for
complying with the Design Standards of Section 24 .5 of the
Weld County Zoning Ordinance.
24 . The property owner or operator shall be responsible for
complying with the Operation Standards of Section 24. 6 of the
Weld County Zoning Ordinance.
25 . Personnel from the Weld County Health Department, State
Health Department, and Weld County Department of Planning
Services shall be granted access onto the property at any
reasonable time in order to ensure the activities carried out
on the property comply with the Development Standards stated
herein and all applicable Weld County Regulations.
26 . The Special Review area shall be limited to the plans shown
herein and governed by the foregoing Standards and all
applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall
require the approval of an amendment of the Permit by the
Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning
Services.
27 . The property owner or operator shall be responsible for
complying with all of the foregoing Development Standards.
Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of
County Commissioners.

A public hearing was conducted on March 14, 1990, at 10:00 A.M. , with
the following present:

Commissioner Gordon E. Lacy

Health Department representative, Wes Potter
The following business was transacted:
I hereby certify that pursuant to a notice dated January 31, 1990, and
duly published March 1, 1990, in The New News, a public hearing was
conducted to consider the request of Liquid Waste Management, Inc. , and
Marie Louise Gollner for a Site Specific Development Plan, Special
Review Permit, and Certificate of Designation for land application of
commercial sludge. Lee Morrison, Assistant County Attorney, made this
matter of record. Keith Schuett, Planning Department representative,
entered the favorable recommendation of the Planning Commission into
the record. Wes Potter, Health Department representative, explained
that a Certificate of Designation is required for this operation
-because industrial waste will be applied, rather than municipally-
generated sludge. Roger Bohannan, of Liquid Waste Management, Inc. ,
came forward to represent the applicants. He explained how and when
this product will be applied to the farm ground. Rondel Gillenwater
and Ron Ptosnik, both representing Scottsdale Ranch, came forward to
voice concerns about drainage across the property and their liability
in the event their cattle should get into this pasture and graze within
30 days of the application of sludge, in violation of conditions
stipulated by the Colorado Department of Health. Mr. Potter said his
staff has determined that this sludge does not have a high
concentration of minerals and would have no negative impact if it is
washed off the site. He also said his staff does not see any problem
if cattle should stray onto this property. Commissioner Lacy pointed
out that application would occur when there is no crop on the land.
Mr. Bohannan stated that his company is prepared to leave a 50-foot
buffer zone along slopes which would go down to the river.
Commissioner Lacy moved to approve this request for a Site Specific
Development Plan and Special Review Permit, subject to the Conditions
and Development Standards contained in the Planning Commission's
recommendation. Seconded by Commissioner Kirby, the motion carried
unanimously. Commissioner Lacy moved to approve the Certificate of
Designation, subject to the Conditions in the Planning Commission's
recommendation. Commissioner Kirby seconded the motion, and it carried
unanimously.

Site Specific Development Plan, Special Review Permit, and
Certificate of Designation - Land Application of Commercial
Sludge
I will be out of the state on March 14, 1990 and unable to attend
the public hearing on the subject special review permit and
certificate of designation. However, I want to go on record as
an owner of land next to the proposed sludge dump, as strongly
objecting and adamantly opposed to the approval of the special
review permit and certificate of designation.
The value of the farm land in the area has been seriously
affected by other land use deviations, such as the St. Vrain
Nuclear Power Plant. This is another incident of a change in
land use that will profit the single land owner, and adversely
effect the other neighboring land owners. The potential for
pollution of the air and aquifer by such use is great. I urge
the Board of County Commissioners to disapprove the requested
permit.

Dear Mr. Schuett:
The Board of Trustees for the Town of Milliken met with Mr. Roger Bohannan
of Liquid Waste Management and Mr. Joe Mahlberg of Coors Biotech on
Wednesday, January 24, 1990 and reviewed the request for certificate of
designation and special review permit as described in your correspondence
of December 27, 1989.
The questions and concerns expressed previously by the Board of Trustees
regarding odor, runoff from rainfall, the sludge content and incorporation
were responded to by Mr. Bohannan and Mr. Mahlberg and the Board is of the
opinion that the proposal does not pose a threat to the Milliken community
as previously supposed.
The responses to the concerns along with Mr. Mahlberg's assurance that the
application would cease if there is any problem was greatly appreciated by
the Board.
Therefore, the Town has no conflict with the proposal.
Thank you for your assistance during our review of the proposal.

from the industrial plant only at Coors Bio-Tech and Will not contain any
domestic sewage. He has reviewed the recommendation of the Department of
Planning Services staff and is not in agreement with Development Standards
#7. Because of the nature of the sludge, it is not possible to work it into
the soil immediately, but it will be worked into the soil 3 to 4 hours after
surface application.
The Chairman called for discussion from the members of the audience. There

Judy Schmidt reported the Health Department does not have a problem with a
four hour delay.

6th P.M. , Weld County, Colorado
LOCATION: South of and adjacent to Weld County Road 6 and west of US Highway
85.
APPEARANCE:
Gary Tuttle, Tuttle and Applegate, represented the applicant. This is a 110
acre site approximately 3 miles north of Brighton. They are within the
Urban Growth Boundary Area of the County Comprehensive Plan. To make a
water storage reservoir, they will have lined pits. After the land is
mined, they will landscape the property. They will comply with fugitive
dust and noise requirements. There is a ready-mix concrete plant on-site
that is not being used. They will also enter into a road agreement with
Weld County. They have reviewed the recommendation of the Department of
Planning Services staff and agree with the requirements with the exception
of Condition #2. The former landowner entered into a signed agreement with
Central Colorado Water District in 1975 and the applicants feel the
agreement is still binding.
The Chairman called for discussion from the audience.
Kim Lawrence, Attorney, Central Weld County Water District, stated they do
not agree that the agreement is binding. It is their feeling the property
was being used for agriculture and this is a completely different use.
Therefore they asked that Condition #2 not be amended.
Lee Morrison explained no sentence could be struck from this condition
because one sentence is contingent to the other.

1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Planning Commission that the applicant
has shown compliance with Section 24.3 of .the Weld County Zoning
Ordinance as follows:
This proposal is consistent with the Weld County
Comprehensive Plan's Environmental Quality and Natural
Resource Goals and Policies, Transportation Goals and
Policies, Urban Growth Boundary Area Goals and Policies, and
the Agricultural Goals and Policies. The Weld County
Comprehensive plan Urban Growth Boundary Area Goals encourage
the maintenance of urban growth boundary areas that provide
an official definition between future urban and agricultural
land uses. The proposed use is not considered to be an urban
type development. The Agricultural Goals and Policies of the
Weld County Comprehensive Plan encourage the location of
agricultural businesses and industries in areas that minimize
the removal of prime agricultural land from production. The
location of the special review permit site and the attached
conditions and development standards will ensure consistency
with the goals and policies of the Weld County Comprehensive
Plan.

- The proposed is consistent with the intent of the
Agricultural zone district and is provided for as a use by
special review. This proposal will not remove prime
agricultural land from production.
- The use will be compatible with the existing surrounding land
uses and with the future development of the surrounding area
as permitted by the existing zoning. The surrounding land
uses include farm production, oil and gas production, and
rural residences.
- No overlay districts affect the site.
- Special Review Development Standards will provide adequate
protection of the health, safety, and welfare of the
neighborhood and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the
request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon
the following:
1. The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's office within 15 days of approval by the
Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. The operator shall submit the following to the Weld County Health
Department on or before January first of each year for review and
approval:
A written report on the application methods and rules;
- The total number of dry pounds of sludge applied per acre per
year;
- The grade of the sludge applied;

- Evidence that the sludge meets stability criteria established by the Colorado Department of Health; and
- A screen analysis of the sludge.
4. Prior to recording the Special Review Permit Plat, a Road
Maintenance Agreement for the haul route from the special review
permit site north to the paved portion of Weld County Road 19
shall be submitted to the Weld County Engineering Department for
review and approval by the Board of County Commissioners.
5. This Special Review permit shall automatically expire 3 years from
the date of approval by the Board of County Commissioners as
indicated in Paragraph 1 of the letter dated November 6, 1989, to
Wes Potter, Weld County Health Department, from Roger Bohannan,
Liquid Waste Management.
6. Prior to recording, the Special Review Permit Plan shall be
amended to show all areas having slopes of 6% or greater.

1. The Site Specific Development Plan and Special Review permit is for
land application of liquid sludge as submitted in the application
materials on file in the Department of Planning Services and subject to
the Development Standards stated hereon. This Special Review permit
shall automatically expire 3 years from the date of approval by the
Board of County Commissioners.
2. Approval of this plan may create a vested property right pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. Waste oil, anti-freeze, and other associated liquid and solid wastes,
shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
4. No permanent disposal of wastes other than approved sludge shall be
permitted at this site.
5. The operator shall handle and dispose of sludge in a manner that
controls fugitive dust, blowing debris, odor, and other potential
nuisance conditions.
6. Ground water monitoring shall not be required until the sludge, soil,
or plant tissue analysis indicates a significant adverse change or
impacts.
7 . Sludge shall be incorporated into the ground within four hours of
application.
8. Odor shall not exceed the 7:1 dilution/threshold according to
Regulation #2 of the Colorado Air Quality Control Regulations.
9. The application rate of the sludge shall not exceed one dry ton per
acre.
10. No livestock shall be allowed to graze on the field within 30 days
-after sludge application.
11. No surface runoff shall occur during sludge application.
12. No on-site storage of sludge shall occur at the Special Review Permit
site.

13. Sludge shall be applied only during dry weather periods upon
unsaturated, nonponding areas and no sludge shall be applied to areas
of the site having slopes of 6% or greater.
14. The sludge shall undergo analysis for total solids, volatile solids,
volatile solids reduction, pH, organic, ammonia, nitrate, nitrogen,
total phosphorus, total potassium, cadmium, copper, lead, nickel, zinc,
and PCB's prior to application in the 2nd and 3rd years.
15. The soil shall be analyzed for pH, total ammonia, nitrate, total
phosphorus, conductivity, cadmium, copper, lead, nickel, zinc, soil
texture, cation exchange capacity, organic matter, and available
phosphorus prior to sludge application in the second and third years
and one year following the final sludge application.
16. Plant tissue monitoring shall be conducted for total nitrogen, nitrate,
total phosphorus, cadmium, copper, lead, nickel, and zinc within one
month following sludge application after the first, second, and third
years of sludge application.
17. If the sludge analyses, soil analyses, or plant tissue analyses
indicate significant adverse changes, the applicant shall notify the
Weld County and State Health Departments in writing within 7 days to
reevaluate the rate and frequency of sludge application.
18. Results of the sludge analyses, soil analysis, and plant tissue
analysis shall be submitted to Greeley Soil Conservation District, Weld
County and the State Health Department within 60 days following
sampling.
19. No crop from this site shall be used for direct human consumption.
20. Soil moisture tests shall be conducted during crop production to
determine the appropriate irrigation times and rates to mitigate
excessive soil moisture, water percolation, and runoff.
21. No transfer/off-loading operations shall be conducted within 60 feet of
a county road.
22. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
23. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
_Ordinance.

24. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.
25. Personnel from the Weld County Health Department, State Health
Iepartment, and Weld County Department of Planning Services shall be
granted access onto the property at any reasonable time in order to
-ensure the activities carried out on the property comply with the
Development Standards stated hereon and all applicable Weld County
-Regulations.
26. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
27. The property owner or operator shall be responsible for complying with
all of the foregoing Development Standards. Noncompliance with any of
the foregoing Development Standards may be reason for revocation of the
Permit by the Board of County Commissioners.

Weld County Zoning Ordinance as follows:
This proposal is consistent with the Weld County
Comprehensive Plan's Environmental Quality and Natural
Resource _Goals and Policies, Transportation Goals and
Policies, Urban Growth Boundary Area Goals and Policies, and
the Agricultural Goals and Policies. The Weld County
Comprehensive plan Urban Growth Boundary Area Goals encourage
the maintenance of urban growth boundary areas that provide
an official definition between future urban and agricultural
land uses. The proposed use is not considered to be an urban
type development. The Agricultural Goals and Bolicies of the
• Weld County Comprehensive Plan encourage -the location of
agricultural businesses and industries in areas that minimize
the removal o₹ prime agricultural land from production. The
location of the special review permit site and the attached
conditions and _development standards will ensure ronsistency
with the -goals and policies of the Weld County Comprehensive
Plan.
The proposed is consistent with the intent of the
Agricultural zone district and is provided for as a use by
special review. This proposal will not _remove prime
agricultural land from production.

- The use will be 'compatible with the existing surrounding land
uses and with the future development of the surrounding area
as permitted by the existing zoning. The surrounding land
uses include farm production, oil and -gas production, and
rural residences.
- No overlay districts affect the site.
- Special Review Development Standards will provide adequate
protection of the health, safety, and welfare of the
neighborhood and County.
This recommendation is based, in part, upon a review of the application
submitted by the applicant, other relevant information regarding the
request, and responses from referral entities.
The Department of planning Services' staff recommendation for approval is
conditional upon the following:
1. The -attached Development Standards for the -Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be -delivered to the Department
of planning Services and be -ready for recording in the Weld County
Cl-erk and Recorder's office within 15 days of approval by the
Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of -the Weld
County Clerk and Recorder.
• 3. The operator shall submit the following to the Weld County Health
Department on or before January first of Each year for review and
approval:
- A -written report on the application methods -and rules;
- The total number of dry pounds of sludge applied per acre per
year;
The grade of the sludge applied;
- Evidence that -the sludge meets stability criteria -established
by the icolorado Department of Health; and

A screen analysisof the sludge.
4. Prior to recording the special Revi-ew Permit Plat, a Road
Maintenance agreement for the haul route from the special review
permit site north to the paved portion o₹ Weld County Road 19
shall be submitted to the Weld County Engineering Department for
review and approval by the Board of County Commissioners.
5. This Special Review permit shall automatically expire 3 years from
the date of approval by the Hoard of County Commissioners as
indicated in -Paragraph 1 of the letter dated November 6, 1989, to
Wes Potter, Weld County Health Department, from Roger Bohannan,
Liquid Waste Management.
6. Prior to recording, the Special Revi-ew Permit Plan shall be
amended to show all areas having slopes of 6% or greater.

1. The Site Specific Development Plan and Special Review permit is for
land application of liquid sludge as submitted in the application
materials on file in the Department of Planning Services and subject to
the Development Standards stated hereon. This Special -Review permit
shall automatically expire 3 years from the date of approval -by the
Board of County Commissioners.
2. Approval _of this -plan may create a vested property right pursuant to
Article £8 of Title 2-4 C.R.S. , as amended.
3. Waste oil, -anti-freeze, and other associated liquid and solid wastes,
shall he -stored and removed for final -disposal in a manner -that
protects against surface and groundwater contamination.
4. No permanent disposal of wastes _other -than approved sludge shall he
permitted -at this site.
5 . She operator shall handle and dispose of sludge in a manner that
controls fugitive dust, blowing debris, odor, and other potential
nuisance conditions.
6. Ground water monitoring shall not be _required until the sludge, soil,
or plant tissue analysis indicates a significant adverse change or
impacts.
7. Sludge -shall he incorporated into the ground at -the time of
application.
8. Odor -shall not exceed the 7:1 dilution/threshold according to
Regulation #2 of the Colorado Air Quality Control -Regulations.
9. The -application rate of the sludge shall not exceed one dry ton -per
acre.
10. No livestock shall ±e allowed to graze on the field within 20 days
after sludge application.
11. No surface runoff shall _occur during sludge application.
12. No on-site storage of sludge shall occur at the Special -Review permit
site.

13. Sludge -shall be applied only -during -dry weather -periods upon
unsaturated, nonponding areas and no sludge shall -be applied to areas
of the site having slopes of b% or greater.
14. The sludge shall undergo analysis for total solids, volatile solids,
volatile solids reduction, pH, organic, ammonia, nitrate, -nitrogen,
total phosphorus, total potassium, cadmium, copper, lead, nickel, zinc,
and -PCB's prior to -application in the 2nd and 3rd years.
15. The soil shall be analyzed for pH, total ammonia, nitrate, total
phosphorus, conductivity, cadmium, copper, lead, nickel, zinc, soil
texture, ration exchange capacity, organic matter, and available
phosphorus prior -to sludge application in the second and third years
and one year following the final sludge application.
lb. Plant tissue monitoring shall be conducted for total nitrogen, nitrate,
total phosphorus, cadmium, copper, 1e ad, nickel, and zinc within one
month -following sludge application -after the first, second, and third
years of sludge application.
17 . If the sludge analyses, soil analyses, or plant tissue analyses
indicate significant adverse changes, the applicant shall notify the
Weld County and State Health JDepartments in writing within 7 days to
reevaluate the rate and frequency of sludge application.
18. Results cf the sludge analyses, soil analysis, and plant ti-ssue
analysis shall be submitted to Greeley Soil Conservation District, Weld
County and the State Health Department within 60 -days following
sampling.
19. No crop from this site shall be used for direct _human consumption.
20. Soil moisture tests shall be conducted during crop production to
determine -the appropriate irrigation times and rates to mitigate
excessive soil moisture, water percolation, and runoff.
21. No transfer/off—loading operations shall be conducted within 60 feet of
a county road.
22. All construction on the property shall be in accordance with the
requirements of the Weld County -Building Code Ordinance.
23. The property owner or operator shall be responsible for tomplying -with
the Design Standards of Section 24.5 of the -Weld County Zoning
Ordinance.

24. The property _owner or operator shall be responsible for complying with
the Operation Standards of -Section 24.6 -of the Weld County Zoning
Ordinance.
25. Personnel from the Weld County Health Department, -State Health
Department, and Weld County Department of Manning Services shall be
granted -access onto the property at any reasonable time in -order to
ensure the activities carried out on the property comply with the
Development Standards stated hereon and all applicable Weld County
Regulations.
26. The Special :Review area shall -be limited to the plans shown hereon and
governed by the foregoing -Standards and -all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the
Permit -by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any -other changes shall be filed in the
office of the Department of -Planning Services.
27. The property own-er or operator shall be responsible for complying -with
all of the foregoing Development Standards. Noncompliance with any of
the foregoing Development -Standards may to reason for revocation of the
Permit by the _Board of County Commissioners.

In a telephone conversation with Boger Bohanna of liquid Waste Management,
Inc., I was informed there would be two semi tractor-trailer trucks per
hour for a period -of two to -three weeks during the spring and fall. This
was different from my understanding when I first revie-wed the application.
Although the hauling will be more intense, it will be ever a relatively
short period of time. Mr. Bohanna indicated he -would -have no objection -to
the _Special Conditions requiring Liquid Waste Management to repair road
damage from their hauling, or to stop hauling when directed. I recommend
those requirements be included in the Special Conditions -as indicated in
my memo of ,January 10, 1990.

on the haul route, particularly the unpaved portions of Roads 19 and 42.
However, particularly -because they will not be able to -haul during wet
weather, I do not believe a Road Improvements and Maintenance Agreement is

Operational Data-Section 30-20-103 :
Liquid Waste Management is seeking approval from Weld County
to land apply sludge on agricultural land located in the Nz of
NW4 , all of NEa and Nz of SEa section 27 T4N , R67W. Section 27 is
in the SE corner at an intersection of Weld County roads 42 and 19 ,
which consists of approximately 400 acres .
The sludge will be from lagoons located at the Coors Bio-Tech in
Johnstown , Colorado . The site includes approximately 300 acres , most
of which is farmed or idle ground . The manufacturing process under
Coors ownership has been limited to production of high fructose corn
syrup and dry cornstarch.
The waste treatment plant processes only waste corn by-products ,
corn starch and sugars , producing an innocuous sludge . All sanitary
wastes are processed in Johnstown city plant .
L.W.M. will be cleaning , transporting and land applying the
sludge for beneficial use to agricultural land as fertilizer , and as
a soil conditioner at no cost to the farmer . The application will be
performed by surface applying with immediate incorporation .
The total dry tons applied by acre is calculated by the agro-
nomic rate of the crops grown with the soil , also set by the Colorado
Department of Health .
The site will be operational between the hours of 7 : 00 am to
6 : 00 pm Monday through Saturday; both sites will be supervised during
all working hours .
We will be using 4 to 5 tractor-trailer units which will load
6500 gallons of sludge in liquid form at the lagoons located at the
Coors Bio-Tech plant . They will haul in closed tankers from Coors
Bio-Tech , East bound on highway 60 approximately a mile to Weld
County Road 19 , South on 19 approximately 3 miles to county road
42 , East on 42 z mile to site entrance .
Trucks will be driving in fields in low gear and using spreader
bars on tanks to fan out sludge in a uniform rate , then returning
by the same route .
Supervisor will be on site with tractor disk to immediately
incorporate sludge and soil to keep odor to a minimum, and to prev-
ent any surface runoff .
Work on this project will only take place during such weather
as to allow us to disk and incorporate . No work will take place
during rain , snow or when the ground is frozen .

Liquid Waste Management has had Empire Laboratories core drill
said site to evaluate depth to bedrock and anticipate seasonal high
water table . Ground water depth was found to be below 15 feet . Col-
orado Department of Health Requirements states this is adequate depth
to ensure that no leachate could take place in ground water in load-
ing rate per acre .
Minimum Standards-Section 30-20-110 :
a ) Sludge will be incorporated immediately to reduce odors and pre-
vent insect breeding and infestation .
b) Disposal site will stay in compliance with all zoning and ordinance
of Weld County. All regulations put into place by Weld County ,
State Health Departments and Federal and •E .P .A. will be complied
with at all times .

son with soil and tissue samples to evaluate projects impact on
site, and to show any build-up of trace elements left in the soil .

APPLICATION REQUIREMENTS
1 . Liquid Waste Management will be working at sludge ponds on
site at Coors Bio-Tech , located in Johnstown -Colorado . We will
be pumping sludge from lagoons into tractor-trailer units in
the amount of 6 , 500 gallons per load , and hauling to an agri-
cultural field for beneficial reuse of the sludge which is also
an excellent soil conditioner .
The sludge and the soil has been analized for compatability
and loading rates of nitrogen to crops grown . -The sludge has a
classification rate of grade 1 by the Colorado Department of
Health .
The trucks will be surface applying at the site , with a
tractor plowing and disking the soil and sludge daily , within
a twelve hour period of application to make subsurface incorp-
oration of substances , this will keep odors to a minimum and
prevent surface run-off . Soil and tissue will be tested annually
for any kind of metal build-up or loading rate change . Crops
will be grown and harvested as usual .

1) Liquid Waste Management is under contract with Coors Bio-
Tech at Johnstown , to clean , transport and dispose of treated ra
sludge under all State Federal and County Regulations , from
their lagoon systems . The sludge will be beneficially used as
fertilizer and soil conditioner on agricultural land , at an
agronomical rate set by the Colorado Department of Health .
2) Coors Bio-Tech has storage lagoons that need cleaning out
because of solid build-up , keeping them from running their
Treatment Plant efficiently .

4) We feel adequate provisions have been taken in ground water depth ,
soil samples and location of site , along with the Colorado Department
of Health , setting the loading rates of dry ton per acre .
5) All permitted ground will be planted and harvested along with
all surrounding land properties adjacent to the property .
6) The existing zone is agricultural on the proposed site . The
work that will take place is agricultural , and would not cause any
problems with current or future development .
7) Liquid Waste Management went to Weld County Department of
Planning Services and talked with Lanell J . Curry , current planner ,
and was shown that the area proposed was not in a flood plain ,
geological hazard or Weld County Airport overlay district .
8) The actual work that will take place requires no water ; drinking
water and restroom facilities will be available at Coors Bio-Tech ,
located in Johnstown Colorado .

INTRODUCTION:
This letter report presents the results of our chemical
analysis of samples collected by Coors Biotechnology
Division personnel .
Y!!$POSJE AND SCOPE:
The purpose and scope of our work includes the deter-
mination of silver and polychlorinated biphenyls (PCBs) in
soil and sludge.
INVESTIGATION AND PROCEDURE:
Grab samples of soil and sludge collected by Coors
Biotechnology Division personnel were -delivered to our
laboratory in Fort Collins, Colorado. The sample numbers,
sample names, and the persons testing the samples are
listed in Tables 1 and 2 . All samples received at our
laboratory were tested and analyzed in accordance with the
latest edition of the following applicable standards :
1 . atapdard methods for Examination of Water and Waste-
Water, 16th Edition, 1985, ALMA, AWWA, WPCF.
2. ASTM Standards, Part 31, Water, American Society for
Testing and Materials.
3 . Methods for Chemical Analysis of Water and Waste,
USEPA, 1983 .
4 . most Methods for Evaluating Solid Waste; Physical/
Chemical Methods, SW-846, 3d Edition, USEPA, 1986 .

All samples were run in multiple tests and tested against
known EPA reference samples to verify our _results. -Our
work and procedures were closely supervised by key
personnel. Control charts were utilized to maintain a check
of consistency for individual -determination.
_RESULTS :
Please see Tables 1 and 2 .
DISCUSSION: '
No PCB-like peaks were detected in the chromatogram for the
Coors Biotechnology sludge. The soil, however, did _
indicate PCB-like peaks, but the concentration associated
with these peaks was less than our detection limit of D. 1
-mg/kg.

t,TMITATIONS:
This report has been prepared to aid in the evaluation of
sludge and soil collected by Coors Eiotechnology Division
personnel . The test results shown in the enclosed tables
are based upon grab samples received at Stewart Environ-
mental Consultants, Inc. 'e laboratory on July 14 , 1988 .
Environmental conditions and other factors may influence
the characteristics of samples. If variations from the
-conditions present at the time of sampling for this report
are encountered during subsequent sampling, this report may
be nullified and should be revised and possibly re-issued.

Dear Mr . Potter ,
I am writing in response to your letter dated October 10 ,
1988 regarding the S,ett-er of Intent for the disposal of sludge
from the Coors Bio-Tech plant at Johnstown, Colarado . I would
like to inform your department at this time that there will not
be a continual application of sludge at this site , since the
sludge comes from -a lagoon system. We will only be -applying
seasonally as required by the plant , and accessibility to the
site (weather , craps etc . ) is feasible . It is our best judgement
at this time , that it will be in the fall of each year for the
next 3 years , if all requirements of the sludge screening and
site monitoring regulations are met .
We do not wish to submit on -alternate disposal site at this
time because , -this is not going to be a continual year around
application . The plant uses a lagoon type system, and aft-er the
initial application at this site , they will have holding capacity
for some time . To this extent we would then be able to find
alternate sites .
The sludge produced is a Grade 1 -as outlined in the regulations ,
and the plant is a . 2 mgd . To that extent our detailed monitoring
plans for each site will be set up as outlined in Table -6 , Frequency
of Monitoring , Page 29 of the regulations . The procedures for
follow up soils monitoring will alto follow the -guidelines in Table
5 ,b and 7 of the same regulations . -Please find the plans attached
to the application .

Measures to preclude the subject crop from entering the food
chain are addressed as a letter from the landowner/farmer verifying
that said crop from this site will not go directly to the food chain .
They also are att-ached to the site application.
I hope that the enclosed information is complete to the extent
that your department can expedite your decision , as the lagoon
system at this time is overloaded and causing problems with their
general operation. Removal of some of the sludge as soap as possible
would alleviate their problems .

Gentlemen:
We are pleased to submit the results of our groundwater and
soils evaluation for the above-referenced property. The purpose
of this evaluation was to determine the depth to bedrock,
depth to groundwater and anticipated seasonal high water table
on these sites .
This investigation was carried out on October 26 , 1988 and
consisted of drilling, logging and sampling twenty-two ( 22 )
test borings to depths of ten ( 10) to fifteen ( 15 ) feet . The
locations of the test borings are shown on the test boring
location plan included in this report . Boring logs prepared
from the field logs are also presented in this report . These
. logs illustrate the soils encountered, depth of sampling ,
elevations of subsurface groundwater at the time of the investi-
gation, along with anticipated seasonal high water tables .
These seasonal high water tables were anticipated by evaluating
the moisture content of the soil above the existing water
table . It should be noted that these moisture contents indicated
that a perched water table condition has previously existed
for approximately one ( 1 ) foot above the bedrock stratum in
almost all areas tested . The drilling operations were performed
under the supervision of a geotechnical engineer from Empire
Laboratories , Inc. , who made a continuous visual observation
of the soils encountered.
