RE: APPROVE AGREEMENT FOR GRADING AND SNOW REMOVAL WITHIN THE BOUNDARIES OF
THE TOWN OF GROVER AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for Grading and
Snow Removal within the Boundaries of the Town of Grover between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, on behalf of the Weld County Public Works Department, and the Town of
Grover, with terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement for Grading and Snow Removal within the
Boundaries of the Town of Grover between the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the
Weld County Public Works Department, and the Town of Grover be, and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 13th day of June, A.D. , 1994.

AGREEMENT FOR GRADING AND SNOW REMOVAL
WITHIN THE BOUNDARIES OF THE TOWN OF GROVER
THIS AGREEMENT, made and entered into this 5th day of May,
1994 , by and between the TOWN OF GROVER, hereinafter referred as
"Town" and the COUNTY OF WELD, STATE OF COLORADO, by and through
the Board of County Commissioners of the County of Weld, Colorado,
hereinafter referred to as "County. "
WHEREAS, Town wishes to have County perform grading and snow
removal services on certain roads within the Boundaries of the Town
of Grover, and
WHEREAS, County is agreeable to rendering such services
pursuant to the terms and conditions hereinafter set forth, and
WHEREAS, Agreements between County and other governmental
entities are authorized and provided for by the provisions of
Section 29-1-203 C.R. S. , and so provided for Section 2-3 of the
Weld County Home Rule Charter.
NOW, THEREFORE, pursuant to the terms of the aforesaid statute
and Weld County Home Rule Charter, it is agreed as follows :
1 . That the County, by way of the Public Works Department,
agrees to provide road grading and snow removal services
on WCR 390, 89, 122, and 120 . 75 within the boundaries of
the Town of Grover.
2 . That the County shall furnish and supply all labor,
supervision and equipment for said services . (The Town
understands that county projects will be given priority
and that grading and snow removal will be scheduled so as
not to interfere with county work. )
3 . The Town agrees to return any and all County road and
bridge revenue as long as this agreement is in effect.
4 . The Town agrees not to charge the County for their
monthly water and sewer usage for the Grover motor grader
shed site.
5 . The Town shall indemnify the County, it ' s officers and
employees, against liability for injury or damage caused
by any negligent act or omission of any of it ' s employees
or agents in the performance of this agreement, and shall
hold the County harmless from any loss occasioned as a
result of the performance of this agreement.

6 . This agreement shall run from year to year unless
terminated by either Town or County, providing the
party seeking to terminate this agreement gives
the other party ten ( 10) days written notice .
IN WITNESS WHEREOF, the parties hereto agree to the terms
and conditions stated forth herein as of this /3'`Z
