WHEREAS, after consideration, the Board deems it appropriate to approve the
hereinabove mentioned assignment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the assignment of said Leases from Mile Hi Oil and Gas,
Inc. , to E. Russell Koeniger and Debra L. Koeniger, be, and hereby is, approved.

U a TO HAVE AND TO HOLD the interest herein transferred and assigned unto Assignee,
it g his heirs, devisees, personal representatives, successors and assigns, forever, subject
only to the following terms and provisions : that

el 0 A. T1ie overriding royalty interest herein transferred is payable out of and only

out of the oil and gas produced, saved and marketed, pursuant to the terms and provisions
M44 of the above described oil and gas lease.
B. The overriding royalty interest herein provided for shall not, in any event,
be paid or accrued upon any oil, gas, casinghead gas and other hydrocarbon substances used
for operating, developmentmr production purposes upon the above described lands or unavoid-
ably lost; and no overriding royalty shall be paid upon gas used for repressuring or re-
cycling operations or pressure maintenanceoperations benefitting said lands.
C. This assignment of overriding royalty is made ,without warranty of title,
either express or implied.
D. If Assignor' s interest in the above described oil and gas lease is less than
the entire interest, or if said oil andgas lease covers less than the entire fee title,
then the above overriding royalty interest shall be reduced proportionately.
IN WITNESS WHEREOF, Assignor has executed and delivered this assignment of over-

RE: Assignment of Oil and Gas Lease for Property Located in: Section
5, Township 8 North, Range 59 West of the 6th P.M. , Weld County,
Colorado
Dear Mr. Koeniger:
The Board of County Conunissioners of Weld County, Colorado, has received your
Assignment of Oil and Gas Lease for the above described property.
Pursuant to Weld County Ordinance 84-L, lessees who wish to assign oil and gas
leases must pay Weld County the sum of $25.00 for each assignment. A copy of the
ordinance is enclosed herein.
Please remit the sum of $50. 00 to the Board of County Commissioners of Weld
County, P.O. Box 758 Greeley, CO 80632. Once the Board receives your $50.00
payment, it will then consider your Assignment.
