HomeMy WebLinkAbout900073.tiff RESOLUTION RE: APPROVE INTERNSHIP AGREEMENT BETWEEN UNIVERSITY OF NORTHERN COLORADO AND WELD COUNTY HEALTH DEPARTMENT AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Internship Agreement between the University of Northern Colorado and the Weld County Health Department, and WHEREAS, the terms and conditions are as stated in the Agreement, a copy being attached hereto and incorporated herein by reference, and WHEREAS, after review, the Board deems it advisable to approve said Agreement. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Internship Agreement between the University of Northern Colorado and the Weld County Health Department be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said Agreement. Kirby County Attorney Gord La y // ()/ . 4;7 900073 INTERNSHIP AGREEMENT 1990 This Agreement, entered into as of the 17th day of January , tR88, by and between the University of Northern Colorado, hereinafter referred to as "UNC" , and Weld County Health Department, hereinafter referred to as "Sponsor". WITNESSETH WHEREAS, UNC desires to establish relationships with organizations whereby interns of UNC may be placed in practical work experiences in order to further their education and/or training; and WHEREAS, the Sponsor desires to accept interns for the purpose of furthering their education and training; and WHEREAS, the parties desire to define their respective obligations and duties to each other and the intern/s; NOW THEREFORE, in consideration of the foregoing premises and the covenants and agreements hereinafter set forth, the parties agree as follows: 1. RESPONSIBILITIES OF UNC A. UNC will prepare and screen the applicants for internships with the Sponsor under established policy set forth in the document entitled, "UNC Internship Program. " This document is incorporated herein by this reference as if fully set forth. UNC will provide to the Sponsor copies of its internship program as may be developed from time to time and submit credentials of qualified applicants to the Sponsor for review. B. The UNC director will provide an orientation session with the Sponsor and the student at the commencement of any internship, in accordance with UNC internship program policies and, thereafter, on an "as needed basis, " based upon the reasonable requests of either sponsor or intern. C. Both UNC and the Sponsor agree to provide interns an appropriate orientation to the organization, its policies, rules and operations and the internship program. 2. RESPONSIBILITIES OF THE SPONSOR A. The Sponsor will screen the applicants after receiving the credentials of qualified and endorsed applicants from UNC. The Sponsor will screen the applicants for selection in accordance with all state and federal non-discrimination laws affecting the hiring process. The Sponsor agrees that it will provide the intern with an educational environment and work experience which is consistent with the customs and usages of the profession in which the intern is engaged. The Sponsor further agrees to establish a policy requiring its employees to meet the commitments of the Sponsor with respect to the internship program and to cooperate with UNC personnel in the administration of the internship program. 900073 B. Upon acceptance of an intern, the Sponsor agrees to appoint an employee (hereinafter referred to as "cooperating employee") who shall be responsible for the joint supervision of the intern in the internship program. The agency agrees to apply the following standards in selecting cooperating employees: A cooperating employee must have: 1. the desire to team with an intern 2. sufficient time available to cooperate with UNC and the intern in planning an acceptable internship program incorporating professional growth and educational experiences 3. at least two years satisfactory professional experience in the profession in which she/he is employed 4. demonstrated adherence to accepted professional work and conduct standards for a period of at least one year preceding involvement in the internship program. C. The Sponsor agrees to provide a work place and work environment, which is in compliance with applicable state and federal standards with respect to non-discrimination and safety, and agrees to save and hold harmless, UNC and the state of Colorado from any and all liability arising out of the relationship between the Sponsor and the intern due to the negligence or unlawful intentional acts of the Sponsor, its employees or agents or the failure of the Sponsor, its employees or agents to comply with state and federal laws or regulations. III. JOINT RESPONSIBILITIES A. The internship shall be suspended during any period of work stoppage or other job action, which affects the area of employment and the job duties and responsibilities of the cooperating employee or the intern. The intern may not perform work, which is within the jurisdiction, or, which is claimed by any labor organization, during the period of any work stoppage or other job action. Further, the sponsor agrees that the intern is required to attend all seminars and other educational experiences scheduled by UNC and agrees to coordinate the work activities of the intern, so as to allow his/her compliance with those requirements. B. It is understood and agreed between the parties hereto, that this agreement is not intended to be nor is it a contract to supply labor to the Sponsor or a contract to supply educational services by the Sponsor to UNC. This agreement is solely between the contracting parties, and individual intern/s are not intended beneficiaries hereof. C. UNC faculty, staff and interns are not to be considered Sponsor employees for any purpose and said persons may not hold themselves out as employees or agents of Agency or otherwise make any representation or commitments on behalf of Sponsor. D. Faculty and interns of the University of Northern Colorado are covered by the State of Colorado self-insurance program, Chapters 24-10, C.R.S. and 24-30, C.R.S. Certificates of liability insurance coverage for students and faculty will be provided at the request of the Sponsor. 900073 E. Participating interns shall carry mandatory health insurance coverage under the University's health insurance program or show proof of enrollment in a comparable accident and sickness health insurance plan. F. The University is covered by workmen's compensation insurance with the State Compensation Insurance fund. The coverage does include all students enrolled in on-the-job training programs except student teaching. G. Either party may terminate this agreement at the conclusion of any internship conducted under the auspices hereof by providing the other party and the intern written notice of such intent to terminate or at any time when no internship program is pending. Upon breach by sponsor of any of the terms and provisions of this agreement, UNC reserves the right to rescind this agreement and terminate any internships which are then pending. Any such rescissions shall not relieve the sponsor from payment of any amounts required to be paid under the terms of this agreement up until the time of rescission. UNC's right of rescission shall be cumulative of any other rights which it may have. The waiver of any breach of this agreement by either party at any one time, shall not be a waiver with respect to any such breach occurring at any other time. H. This contract shall be construed in accordance with the laws of the State of Colorado. It is further understood and agreed by and between the parties that this agreement and the documents incorporated herein by reference, contain the entire agreement between the parties and any modifications hereof shall only be binding, if reduced to writing and subscribed by the authorized representative of the Sponsor and the President of UNC. I. It is agreed that exclusive jurisdiction for any litigation concerning or arising out of this agreement must be venued in courts of Weld County, State of Colorado, to the extent those courts are reposed with subject matter jurisdiction. The parties hereto submit to the personal jurisdiction of those courts. IN WITNESS WHEREOF the parties hereto have executed this agreement as of the day and year first above written.
