RESOLUTION RE: APPROVAL OF RENEWAL REQUEST FOR RETAIL LIQUOR STORE LICENSE ISSUED TO RONALD FAHRENHOLTZ, DBA C J'S LIQUORS - EXPIRES AUGUST 15, 1994 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Ronald Fahrenholtz, dba C J's Liquors, presented to the Board of County Commissioners of Weld County, Colorado, an application for the renewal of a Retail Liquor Store License for the sale of malt, vinous and spirituous liquors for consumption off the premises only, and WHEREAS, pursuant to Weld County Ordinance No. 6, Section II, C., said applicant has paid the sum of $87.50 to the County of Weld for the renewal of the existing license, and WHEREAS, said applicant has exhibited a State Liquor License for the sale of malt, vinous and spirituous liquors for consumption off the premises only, outside the corporate limits of any town or city in the County of Weld at the location described as follows: 3907 Highway 119, Longmont, Colorado 80504-9543 WHEREAS, on June 16, 1993, the Board of County Commissioners approved a Stipulation and Agreement with the applicant as a condition for the renewal of said license. FAHRENHOLTZ, d/b/a CJ'S LIQUORS, 3907 HWY 119 Longmont, Colorado 80501 Weld County Colorado THIS AGREEMENT BETWEEN, Ronald L. Fahrenholtz, d/b/a CJ's Liquor, 3907 HWY 119, Longmont, Colorado 80501, is offered for the purpose of settlement of the matters detailed in a Notice of Proposed Denial delivered to the Licensee. This matter is set before the Board of County Commissioners on June 16, 1993, at 9:00 a.m. Parties have entered into a Stipulation for suspension and vacating the hearing of Proposed Denial and Renewal of the License. For their Stipulation, the parties state as follows: 1. CJ's Liquors, has in the past twelve (12) months had two (2) violations of the Colorado Liquor Code. Specifically, in July of 1992, CJ's Liquors sold an alcoholic beverage to an underaged person. In May of 1993, CJ's Liquors sold an alcoholic beverage to an underaged person. CJ's Liquors admits to such violations. 2. CJ's Liquors will be suspended for five (5) days. Four (4) days of the suspension, shall be held in abeyance on the condition that CJ's Liquors does not have any similar violations for a period of six (6) months from the date of this Stipulation. CJ's Liquors will serve one (1) day of the suspension. CJ's Liquors will pay a fine in lieu of suspension, pursuant to C.R.S. 12-47-110(3a). The fine calculated, pursuant to the above mentioned statute, is Three Hundred Two Dollars and Ninety Seven Cents. ($302.97). 3. The Board of County Commissioners stipulates that the fine imposed will achieve the desire disciplinary results and the public welfare and morals will not be impaired by permiting the Licensee to pay a fine in lieu of suspension, and the Licensee is not otherwise ineligible to pay a fine in lieu of suspension. 4. The Licensee had four (4) employees complete the T.I.P.S. Training Program, on June 6, 1993. The remaining employees will complete the T.I.P.S. Training Program on June 27, 1993. 93'05'69 5. The Licensee will check each individual who attempts to purchase alcoholic beverages, to ascertain that the customer is of appropriate legal age. 6. WHEREAS, the Board did Find that the Tavern Liquor License of June Faudoa, dba La Garra, be renewed, but shall be suspended to and until December 5, 1987,rand said _renewal shall also be subject to the following conditions 1. The applicant shall have paid security guards within the tavern on Friday and Saturday evenings. 2. Identification must be provided by all patrons upon entering the tavern. 3. The tavern shall only be open on Friday, Saturday and Sunday, pursuant to the stipulation as stated by the applicant. 4. As stipulated the tavern on Sunday, she approval. FINDINGS OF THE BOARD CONCERNING RENEWAL OF TAVERN LIQUOR LICENSE FOR JUNE FAUDOA, DBA LA GARRA - PHASE I HEARING WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 5th day of October, 1987, the Board heard testimony concerning alleged violations of the Colorado Liquor Code and Weld County Ordinance No. 102-A, and determined that a Renewal Hearing be scheduled to consider the renewal of a Tavern Liquor License for June Faudoa, dba La Garra, and WHEREAS, Phase I of said Renewal Hearing was conducted on October 19, 1987, and WHEREAS, at the hearing of October 19, 1987, the Board did Find and Determine that the burden of proof was met in showing that: 1. Whether there have been any violations in the last one-year period by the licensee or by any of the agents, servants, or employees of this licensee of the provisions of the Colorado Liquor Code, or any of the rules or regulations authorized pursuant to the Colorado Liquor Code or any of the terms, conditions, or provisions under which the license was issued. BE IT FURTHER ORDAINED that Phase II of such public hearing shall be a determination of whether the following items mitigate or aggravate the effects of the four factors listed above, if any one of the Phase I factors are found to exist, such factors to be considered in determining whether denial of renewal is justified: a. Seriousness of the factor in terms of the affront to the public. b. Corrective actions taken by the license holder. c. Prior violations, offenses, and occurrences at the licensed premises and effectiveness of prior corrective action. d. Prior violations and offenses by the licensee. e. Violation, offense, or occurrence as a repeated course of conduct or as a single event. f. Likelihood of recurrence. g. All circumstances surrounding the violation, offense, or occurrence. h. Willfulness of violation(s), offense(s), or occurrence(s). i. Length of time the license has been held by the licensee being disciplined. j. Previous sanctions imposed against the licensee. k. Other factors making the situation unique to the licensee or premises subjected to discipline.
